Avoid Family Conflict by Hiring an Estate Attorney
May 9, 2012 By John M. O'Drobinak, P.C.
Estate plans can have many different goals. At a minimum, an estate plan sets out what will happen to your assets after you pass away. One thing you should consider when creating your estate plan is the potential for conflicts between your family members over your estate and how you can minimize that potential. Hiring an estate planning attorney can lessen the potential for conflict.
If you create your own estate plan from generic documents that you find online or in a book, you will probably leave a lot of ambiguities in the plan. For example, if you say that your two sons should each inherit 50 percent of your assets, you might be leaving the gray area of what assets each son's 50 percent entails. If your sons both want the same piece of property and you want a particular piece of property to go to one, or the other, and you don’t spell it out, they might fight over it.
When families fight over inheritances, it can quickly get costly. The disagreement often ends up in Probate Court with each family member hiring an attorney. Before too long the money you saved by not hiring an estate planning attorney is gone to Court costs and Attorneys' fees.
Hire an attorney to draw up your estate plan. The money you spend now is money your family saves later.
