Do What it Takes to Prevent Challenges

Estate planning is approached differently by different individuals. Some people are very diligent about envisioning the future and they do everything possible to make things simple for the loved ones that they will be leaving behind. Others fail to plan ahead adequately. We are not suggesting that they care about their families any less, but for one reason or another they are not properly prepared and often times difficult situations emerge.
One such situation would be a challenge to an estate.There are times when someone intentionally disinherits a family member or former family member.These cases are sometimes contested, so you have to anticipate the possibility and make sure that your estate plan is ironclad.

In another type of case there may be someone who passes away with a set of estate planning documents that are not up to date given the family dynamic that was in place at the time of death. A celebrity example that comes to mind is that of the pioneering soul singer James Brown.

Brown executed his last will before marrying Tomi Rae Hynie and before his final child was conceived. As a result, neither party was named in the Will and a challenge ensued after the death of the Godfather of Soul.

The intelligent course of action is to keep your estate plan up-to-date at all times while being aware of the way that your decisions will be received by interested parties.If you clearly communicate your wishes to a good central New Jersey estate planning lawyer you will walk out of the office with a truly airtight estate plan that should be able to withstand any challenges that may present themselves.
