Howard University Accused of Disability Discrimination
The ADA is a law that prohibits employers from discriminating against an employee because of a disability. It also requires the employer to provide reasonable accommodations in order for the employee to continue to work. Howard University has been accused of disability discrimination in the District of Columbia.
The lawsuit was brought by U.S. Equal Employment Opportunity Commission (EEOC) because it found that the university had violated federal law when it refused to hire an applicant for a security position because of his disability which was diabetes.
The complaint alleges that Clarence Muse, who has Type 2 diabetes, was interviewed for positions by Howard’s employers. However, when he stated his shift preference during his interviews that he needed to be able to get dialysis treatments three mornings each week, he was denied the positions even though he was fully qualified for the jobs. This law also protects employees it because employers are prevented from retaliation against an employee for exercising their rights against disability discrimination. According to the Americans with Disabilities Act of 1990 under the US Equal Employment Opportunity Commission, it is illegal to diminish a person’s right to fully participate in all aspects of society based on physical or mental disabilities. However, many people with physical or mental disabilities have been precluded participating in all aspects of society because of discrimination. As such, Title VII of the Civil Rights Act of 1964 makes it illegal to discriminate against someone on the basis of race, color, religion, national origin, or sex.
