Georgia does not have degrees of murder like many states. In other words, we do not have a crime known as first degree murder, which usually requires premeditation, and is sometimes referred to as premeditated murder. Nor does Georgia have an offense known as second degree murder.
- Manslaughter
Voluntary manslaughter means that homicide occurred under circumstances that the person acted as a result of a sudden, violent and irresistible passion caused by a provocation likely to excite such passion in a reasonable person. Felony involuntary manslaughter, which is punishable by one to ten years imprisonment, occurs when an individual causes the death of another person while committing an unlawful act other than a felony. Misdemeanor involuntary homicide involves the killing of another person while committing a lawful act in an unlawful manner.
- Vehicular Homicide
Vehicular homicide, which is called "homicide by vehicle" in Georgia, is the unlawful killing of a person while operating a vehicle. It is not necessary for the prosecution to prove either malice aforethought or intent to kill.
- Drug Crimes
Most charges for violations of the Georgia Controlled Substances Act involve small amounts of drugs. If you are a first time offender charged with possession of marijuana or other drug crimes, the odds of your serving prison time for a small amount of a controlled substance are not substantial. There are other consequences of a conviction for possession of drugs, such as the loss of a driver’s license and being ineligible for college financial aid, which are more than minor inconveniences.
- DUI Law
In order to be convicted of DUI, it must be shown that you were driving or in actual physical control of a moving vehicle. As a general rule, the burden is on the State to show that the officer had a reasonable, articulable suspicion for stopping or detaining the vehicle. However, if you were stopped at a roadblock, the prosecutor must show that the roadblock was set up in accordance with the Fourth Amendment to the U.S. Constitution.
- Sex Offenses
Sex crimes involving minors are considered some of the worst offenses, and the General Assembly has routinely increased punishment for these offenses down through the years. It is very difficult for any member of the legislature to vote against increasing the punishment for child molestation and similar offenses. If your friend or family member has been accused of one of these crimes, you must understand that a proactive approach is crucial.
- Rape
In Georgia the crime of rape is defined as having “carnal knowledge” of a female forcibly and against her will or when the female is less than ten years old. Any penetration is sufficient to sustain a rape conviction. Since July 1, 2006, the minimum sentence is 25 years in prison with no probation, parole, or other early release and the balance of the offender’s life on probation. A convicted rapist must also register as a sex offender. The maximum penalty is life imprisonment without parole.
- Sodomy
Sodomy consists of the performance of a sexual act involving the genitals (sex organs) of one person and the mouth or anus or another. Although private, consensual sodomy performed by adults is now lawful, all other cases of sodomy can still be prosecuted.
- Child Molestation
Child molestation involves the commission of any “immoral or indecent act” to or in the presence of a child under the age of 16 years with the intent to arouse or satisfy the sexual desires of the child or the defendant. As with statutory rape the offense is a misdemeanor if the victim is between 14 and 16 years of age and the defendant is under age 18 and no more than four years older than the victim.
- Probation Revocation
If you commit a new crime or fail to comply with the terms and conditions of probation, your probation officer will probably issue an arrest warrant and seek to have your probation revoked.
- Search & Seizure Law
The Fourth Amendment to the United States Constitution, as well as a parallel provision of the Georgia Constitution, protects us from unreasonable searches and seizures. The amendment itself is rather brief, so most of the law defining what is or is not reasonable has come to us from court decisions. As a general rule a valid warrant is required for a valid search. However, there are numerous exceptions.
