Practice Areas

Practice Areas Description

- Divorce

Few life experiences are more difficult or stressful than divorce. In the weeks and months ahead, you will want a lawyer by your side who provides caring, competent and compassionate service and who is not afraid to fight aggressively to protect your rights and interests when needed.

- Child Custody

Florida courts will no longer be awarding child custody and visitation to parents after October 1, 2008. Instead, a parenting plan which the parents agree to (or which is imposed by the court), will govern parenting time after the divorce. Reflecting a nationwide trend toward co-parenting, Florida family courts will now presume that both parents will share parental responsibilities.

- Alimony

Unlike child support, there are no hard, fast mathematical calculations or formulas for alimony or spousal support. At Anne E. Raduns, P.A., we have represented the best interests of both husbands and wives in this challenging and sometimes contentious area of divorce law.

In some cases there is a presumption for alimony and in some cases there is a presumption against alimony. However, most situations fall into a gray area where judges can use their own discretion (or the two parties can reach an agreement) when deciding whether to order alimony and how much to award.

- Child Support

Aside from providing love and regular attention after a divorce or paternity case, parents have no higher obligation than to provide financially for their children after the divorce. Child support is more important than any other debt or financial obligation, but most people do not know what level of support will be required. A court will determine the amount, and a lawyer can help assure that the determination is fair under the law.

- Collaborative Law

Collaborative Law Divorce is a process that enables divorcing parties and parties involved in other family law disputes, each represented by counsel, to resolve the parties' differences in a non-¬adversarial setting. Collaborative divorce has been described by some as a softer, gentler technique for divorcing couples who need zealous legal representation, but also place a premium on avoiding litigation. A combination of angry litigants and unnecessarily aggressive attorneys can lead to long, drawn-out court battles. Collaborative divorce is about settlement, as opposed to difficult litigation.

- Paternity

Establishing paternity is important for asserting a number of legal rights and obligations in regard to children. Each of a child's parents has a responsibility to support the child and a right to maintain a strong parent-child relationship. Moreover, the children have a right to a relationship with both of their parents.

- Custody Change

We have assisted clients throughout North Central Florida with requests for child custody modifications, including modifications based on abuse or neglect of the children, or because of relocation issues. If your former spouse has developed a substance abuse issue , or other problem that could put your children at risk, custody and visitation arrangements may need to be modified.

- Prenuptial Agreement

Whether you are getting married for the first time or you have done this before, a prenuptial agreement is important. This document allows you to protect your property. It allows your future spouse to protect his or her property. It allows both of you to protect your respective estates so they can pass on appropriately to your children. Simply put, getting a prenuptial agreement is being proactive.

- Adoption

Adoptions come in many forms, but the most common is adoptions of stepchildren by stepparents. Not only does this adoption solidify the parental bond between stepparent and stepchild, it puts full legal responsibility in the hands of the stepparent. It also eliminates those responsibilities for the birth parent who is not living with the child, if that birth parent is alive.

- Domestic Violence

Domestic violence is an issue that can affect divorcing spouse's rights, including access to the house, access to other property, child visitations, and even custody. Attorney Anne E. Raduns has extensive experience with representing clients who have been victims of domestic violence, as well as clients who have been accused of domestic violence.

- Same-Sex Couples

Couples within the LGBT community are faced with many unique challenges when family law issues arise. Those challenges often require creative legal solutions.

At the law firm of Anne E. Raduns, PA, we have the experience to come up with family law solutions that work for lesbian, gay, bisexual and transgender individuals in same-sex relationships. No matter what challenge you're faced with, you can be confident in our ability to resolve it.
