Practice Areas Description
- DivorceGetting divorced in New York doesn't have to be a prolonged and emotionally draining experience. My goal as your lawyer is to help you complete your divorce as quickly as possible, while protecting your rights and helping you prepare for the future. My law office is conveniently located in Dongan Hills, Staten Island, New York.
- Mediation
I offer my clients the possibility of resolving divorce issues without getting lawyers involved. That's one of the reasons I provide divorce mediation services at my family law office in Dongan Hills, Staten Island, New York.
- Property Division
Before you and your spouse can divide marital property in New York, you need to form a plan. What will happen to the marital residence? Will you or your spouse move out of the house while your divorce is in process? My goal as your lawyer is to help you set your goals and make a life plan so you are not just divorced, but able to begin the next phase of your life.
- Child Visitation
At my law office in Dongan Hills, Staten Island, New York, I help my clients craft parenting plans that serve the best interests of their children. Some parents begin the divorce process by saying they want sole custody of their children. However, New York courts favor joint custody to ensure the child has a relationship with both parents. In the long term, the courts believe it is healthiest for children to have two parents.
- Child Support
As a parent, you have a fundamental responsibility to support your children, and that responsibility does not end in divorce. In New York, the parent who does not have primary residential custody parent is required to pay child support to the parent with custody. Those payments are determined by a formula that considers the incomes of both parents and the number of children.
- Alimony
At my law office in Dongan Hills, Staten Island, New York, I help my clients negotiate all issues of divorce, including whether or not there is an obligation to pay maintenance which used to be called alimony.
- Post Judgment Modifications
Child custody and support may be modified after divorce. However, if contained in an agreement, it can only be done if there is a substantial or unforeseen change in circumstances and a court approves the modification. If you simply stop complying with an existing order, you could be found in contempt of court.
- Domestic Violence
An order of protection can be used to protect yourself against an abusive spouse. Unfortunately, an angry spouse can misuse this order (also known as a restraining order) to kick you out of the home and gain the upper hand during a divorce dispute.
- Post Nuptial Agreements
The division of marital property can be one the most difficult issues to resolve in a divorce. For this reason, many people who bring significant assets to a marriage seek a lawyer's help to spell out property rights in advance through a prenuptial agreement.
- Will
Many people are uncomfortable with the topic of wills. But as uncomfortable as this topic may be, it is one that needs addressing. A will is the final say in determining what happens to your assets. Without a will, the state will determine how to settle your estate. Before you give up your rights to direct your estate how you see fit, consult an experienced Staten Island will attorney.
- Estate Management
There are a number of administrative steps that must be completed upon the death of a family member. While some of these tasks can be completed independently, there are certain tasks that may require assistance from a Staten Island estate management attorney.
- Probate
Probate is the legal process of administrating a will after an individual dies. Finalizing an estate can be a costly and time-consuming process. It is important for any individual or family to work with an experienced lawyer to ensure that the correct paperwork is filed, that deadlines are met, and that the process is completed according to New York law.
- Health Care
I am Staten Island power of attorney lawyer Anne-Louise DePalo. I take an organized and step-by-step approach to estate planning matters, working to protect the personal and financial interests of each of my clients. If you are looking to establish a power of attorney or health care proxy, I can walk you through the legal process and explain your rights and options.
