Additional Practice Areas: Contract Disputes; Fraud/Unfair & Deceptive Trade Practices
Practice Areas Description
Our law practice includes:- Business Litigation
Contract Disputes
Today, contract disputes arise in many different contexts. We regularly encounter service contracts, construction contracts, employment contracts and the like. To be legally enforceable, a contract does not necessarily have to be in writing. We also routinely see cases involving shareholder or member disputes relating to closely held companies or Limited Liability Companies. If you find yourself in a contract dispute, it is important to seek competent legal counsel early in the process. Effective legal representation can often help to avoid litigation. Or, if litigation is unavoidable, your lawyer can help you to negotiate a favorable resolution, minimize exposure, or present a strong case to the Arbitrator, Judge or jury.
Eminent Domain
What happens when the government decides that it wants to take your real estate through the power of eminent domain? Often referred to as condemnation, the taking of real property by a governmental agency can lead to a complicated valuation analysis which relies heavily upon expert testimony. The legal process can be quite involved and lengthy. Often times eminent domain cases can be very emotionally taxing because you are having your property taken from you against your will. Arnold & Smith, PLLC is experienced in handling eminent domain cases.
Employment Law
Legal issues commonly arise in the employment context in the following areas: Noncompete Agreements; Trade Secrets Litigation; Retaliatory Discharge; Hostile Work Environment; Constructive Discharge; Unemployment Benefits; Discrimination; and, Equal Employment Opportunity Commission (EEOC) Claims. If you are facing any of these legal matters, it is important to seek competent legal representation to advocate on your behalf.
Fraud/Unfair & Deceptive Trade Practices
The ways in which fraud or unfair and deceptive trade practices may be committed are limited only by the imaginations of the ill intentioned. Whether facing a con-artist or an unscrupulous business, it is important to know your legal rights. Under North Carolina General Statutes Chapter 1D, punitive damages may be awarded in an amount up to $250,000.00 or three times the actual damages - whichever is greater. Similarly, a successful claim under North Carolina General Statutes Chapter 75 for unfair and deceptive trade practices will entitle the plaintiff to recover treble (triple) damages plus attorneys' fees.
