- Family Law

We approach every case with the understanding that no one can really "win" in a family law dispute. One party may "lose less" than another, but it's only in drastic cases that either spouse ends up better off than they were before. The damage in your life has already been done. You need an attorney who will work to mitigate that damage, who will help you negotiate thorny issues like property division and child custody without causing further harm to your family relationships.


- Child Custody

Child custody is often the most emotionally trying question a family must resolve. Children are so close to their parents' hearts that it can be difficult to "give in" and strike a compromise. At Avery & Upton, we take pride in our ability to help our clients resolve even the most heated and contentious disputes.


- Child Support

There isn't much room for negotiation when determining child support payments. Like most states, Maryland uses strict statutory guidelines based on the parents' income and expenses as well as the child custody arrangement to determine how much child support will be paid. Child support is not static. Life changes and child support can be changed to reflect the new situation.


- Prenuptial Agreement

Marriage and developing a relationship are hard work. No mature adult expects it all to be a rose garden. The ability to discuss complicated or difficult issues is essential throughout a marriage. A prenuptial agreement, also called a premarital agreement, is a legal document entered into prior to the wedding day. It does not "anticipate divorce" but rather sets out the financial outcome, should divorce be in your future.


- Child Support Calculator

The calculation factors in a dozen or so figures, including the number of children, amount of time spent with each parent, gross income of both parents, and obligations to support children from a prior marriage. Factors taken into consideration in setting the amount include health-related insurance and expenses, and day care expenses.


- Collaborative Practice

Not everyone who wants a divorce wants to hurt his or her spouse. Not every parent wants to separate the other parent from the children. Not every separating couple wants to rely on the legal system to help them resolve their situation. In fact, there is a growing movement among family law practitioners that says couples who can collaborate should. As divorce becomes more common and litigation more costly, more and more couples choose this option.

There are many ways to resolve a family law dispute. Some involve greater amounts of cooperation, and some involve greater amounts of conflict. - Divorce Agreement Drafting

Depending on the circumstances you can get divorced yourself. Perhaps despite appearances, the court system tries very hard to serve the public. The law in most states grants individuals the right to bring their own cases to court. This is called "pro se" representation. The wisdom of your doing so, and your own comfort level both depend on you as an individual and your particular circumstances.


- Domestic Violence

The State of Maryland takes allegations of domestic violence very seriously. If you are suffering from domestic abuse or if you are being accused of abuse, you should hire an attorney to help you handle this delicate issue – even if the Sheriff’s deputy or police officer says that you don't need one.


- Marital Property

The process of dividing marital property between two divorcing spouses is often plagued by conflict and contention. - Military Divorce

- Military Pension

The calculation of what portion of a military pension an ex-spouse is entitled to is extremely complex. We handle these issues for other lawyers because we know how to do it, and very few other attorneys do. As with any government entity, there are forms to complete and procedures that must be followed to determine or receive pension funds.
