- Family Based Immigration
At Bagia and Associates, P.C. we can assist you in obtaining permanent residence for your spouse, fiance, children, parents, and siblings. It is our job to be up-to-date with the current immigration laws, required forms, and visa bulletins. In addition to obtaining permanent residence for your family members, we also assist in procuring employment authorization so that your family member can lawfully work in the US while their adjustment application is pending and in obtaining a travel document, which permits adjustment applicants to return to the US after traveling abroad during the pendency of their application. - Deportation Defense
At Bagia and Associates, P.C. we assist individuals who are in Removal Proceedings before the Immigration Court in both a detained and non-detained setting. in most circumstances, the United States government cannot deport a foreign national until they give that person an opportunity to respond to the allegations against them and to present a defense. This process is referred to as "Removal Proceedings." In Removal Proceedings, the foreign national has the right to be represented by an attorney. It is possible for a person without status to leave Removal Proceedings with their green card. It is also possible that Removal Proceedings will end with an Immigration Judge signing an Order of Removal from the United States. Since the consequences of Removal Proceedings are drastic, it is very important that you have a competent and diligent attorney to represent you. At Bagia and Associates, P.C. we handle a variety of cases in Removal Proceedings and have had success with many complex cases before the Immigration Court.
- Naturalization
Bagia and Associates, P.C. assists individuals who are trying to become United States citizens through the process of naturalization. There are many benefits in becoming a US citizen such as the right to vote and protection from deportation in most instances. The rules and regulations pertaining to eligibility for naturalization are very complex, especially when a person has a criminal history. We will conduct an in depth evaluation of your case and provide an honest assessment as to whether you are eligible for naturalization. If you are eligible, we will prepare all necessary forms and attend the naturalization interview with you to help preserve your rights. Generally speaking, a person must first be a lawful permanent resident of the United States for five years in order to be eligible for naturalization. A person who is married to a US citizen and remains living with their US citizen spouse only needs to have their green card for three years before being eligible for naturalization. The naturalization application can be filed 90 days prior to the person's eligibility date as explained above.
