Banning LLP is a personal injury law firm with extensive experience in maritime and admiralty claims. We have offices in Southern California and American Samoa.
Our maritime and admiralty practice is international. Over the past 30 years, we have represented clients throughout the western United States, the Gulf of Mexico and the Pacific Basin. Through our office in American Samoa, we have effectuated vessel arrests in distant ports such as Pago Pago Harbor and Guam. We also represent clients injured on inland navigable waters such as the Colorado River, Lake Mead, Lake Mohave and Lake Powell.
In addition to handling maritime personal injury and death claims, our lawyers handle maritime property damage claims such as those arising from sinking vessels, fires and explosions. We also have significant expertise with marine insurance claims and charter party disputes, and we have represented vessel financing companies, shipping companies, ship brokers and marine insurance brokers in litigation in California and elsewhere.
Our lawyers are experienced in vessel arrests, vessel mortgage foreclosures and seamen wage claims. If you or your company is involved in any type of maritime dispute, we can help.
Practice Areas
Practice Areas Description
The following are the types of injury cases we regularly handle:- Commercial Fishermen's Accidents/Jones Act
At Banning LLP, our attorneys have a depth of experience in the laws that apply to injured fishermen. From our office in San Diego, California, we represent commercial fishermen of U.S. and foreign flag vessels worldwide that have a base of operations in the United States. Even if you are working on a foreign flag vessel, you may be entitled to claim rights under U.S. law.
- Maritime Law, Harbor & Boating Accidents
Our attorneys have a depth of experience in handling personal injury and wrongful death claims under the Jones Act, the Death on the High Seas Act, the Longshore and Harbor Workers' Compensation Act, and other maritime and admiralty laws. We handle personal injury and wrongful death cases involving: Boating accidents; Boat fires; Drownings; Jet ski accidents; Water skiing accidents; Diving accidents; Yacht and other boat collisions; and, Collisions between boats or between boats and fixed objects such as piers or fish pens (also known as allisions).
- Cruise Ship & Passenger Claims
If you have been injured as a passenger on a cruise ship or other vessel, it is important to contact an attorney as soon as possible. The cruise line will do everything it can to minimize or eliminate your chances of making a full financial recovery. For example, cruise ship injuries are typically covered by the general and statutory maritime law, which has a three-year statute of limitations for filing claims. However, the ticket stub for your cruise may contain information about specific notification of claim requirements and shorter statute of limitations. The ticket may also have foreign arbitration and forum selection clauses that would force you to resolve your claim in a setting most favorable to the ship's owner. Our attorneys have been successful in defending the rights of injured passengers against foreign arbitration and forum selection clauses buried in their ticket's small print.
- Offshore Oil & Gas Worker Injuries
Our attorneys represent injured oil workers, rig service workers and refinery workers whether they are injured on land or off shore. Our international law practice represents individuals of all nationalities. From our office in San Diego, California, our lawyers help oil workers who are injured in the Gulf of Mexico, the Pacific West Coast, and Alaska and other offshore oil rig platforms around the world.
- Hawaii Maritime Accidents
Many types of accidents occur to Hawaiian visitors, tourists and residents alike, including accidents on charter boats, whale-watching boat cruises, catamaran cruises, dinner cruises, ferries, para-sailing, military sightseeing boats, jet skis, snorkel boats cruises, scuba diving and other vessels. Our lawyers are well-equipped to handle these types of accidents which involve unique aspects of maritime law.

At Banning LLP, our maritime law attorneys have represented seaman and fishermen from the United States and all over the world. We have handled major personal injury and death claims arising out of injuries on tuna vessels sailing out of American Samoa and the Pacific. - Alaska Maritime Accidents
Our attorneys are equipped to handle commercial fishing accidents and maritime death claims under the Death on the High Seas Act occurring in Alaska and the Bering Sea, including the following types of vessels: crab boats, trawlers, fish processing vessels, squid vessels and long liners.
