Practice Areas
Practice Areas Description
- Family LawPeople change. Needs change. Circumstances change. It's tempting to let a family court settle the complex and emotional conflicts that result. But a judge's ruling may not reflect what's best for your family. At Becker Law Offices, we help couples and families find workable solutions that avoid costly, drawn-out and bitter legal fights. Our goal is a fair and practical agreement that allows all parties to move on from this difficult time.
- Divorce
The complex factors at play in divorce — the money, the children, the emotions and major life changes — make it easy to lose sight of reason. Misty D. Becker is a skilled attorney who will guide you through this difficult process to a fair and practical agreement.
- Property Division
All that you own can basically be divided into two types of property in Tennessee: real and personal. Real property includes land and home that you own. Personal property is almost everything else. Everything that you own, both real and personal property can be referred to as your marital estate.
- Alimony
Alimony, or spousal support, is sometimes necessary, but is not always awarded. However, it is awarded when one spouse would struggle to make ends meet and other has the ability to pay. Courts have latitude and take in to consideration many factors when determining whether when it applies, how much and for how long.
- Child Custody
At Becker Law Offices, we aim for out-of-court custody agreements that minimize the impact on children of divorce and preserve a healthy ongoing relationship between the parents. Memphis, Tennessee family law attorney Misty D. Becker helps negotiate a workable parenting plan and represents your interests in contested proceedings.
- Visitation
Visitation in Tennessee can also be called parenting time. It is the time a noncustodial parent spends with minor child or chlldren, whereas parenting time is when either parent spends time with the child or children. Typically, visitation, or parenting time, is set schedule during which time that parent with whom the children are physically with has complete control over the children.
- Child Support
The law will not permit a child to go unsupported. For this reason, once custody of a child is determined, (the law now calls the custodial parent, the primary residential parent in divorce situations) the noncustodial, or alternate residential parent, is required to pay support for the maintenance of the minor child to the custodial parent.
- Paternity
Paternity is establishing the father of a child when the parties are not related and having the law recognize him as the child's father. It is the first step with fathers' rights. This will allow the person established as the father through paternity suits the right to petition for visitation and have a say in the child's rearing, and it establishes the parent who must pay support for the child.
- Adoption
Whether you are formally adopting a child who already lives with you, or you are bringing a new baby or child into the fold, Attorney Misty D. Becker works to anticipate and overcome any legal barriers. She practices family law in the Memphis area and throughout Shelby, Fayette and Tipton Counties.
- Prenuptial Agreement
Prenuptial agreements, are simply contracts or agreements that parties enter into prior to their marriage that sets out what will happen in the event of a dissolution of the marriage. A good prenuptial, or as misspelled - prenumptial, can be used to protect both your assets prior to the time of the marriage and even possibly limit what is recieved at the time of the divorce depending upon the circumstances.
- Employment Law
James Becker's law practice is devoted to helping workers assert their rights and hold employers accountable for violations of civil rights and workplace regulations. He has achieved favorable results in hundreds of cases on behalf of employees in the Memphis area, Shelby County and throughout West Tennessee.
- Discrimination
Despite clear and strong federal laws, some employers believe they can get away with discriminatory treatment of certain people. Employment law attorney James Becker has a record of uncovering the truth behind employer actions and making them pay damages. Based in Memphis, Becker Law Offices represents workers in Shelby County, Fayette County and throughout West Tennessee.
- Sexual Harassment
If you have been subjected at work to unwanted touching, pressure for sex or other degrading behavior based on your gender, you must report it to the company before you can bring legal action. But it may be in your best interests to speak with an attorney first. Employment discrimination lawyer James Becker can explain how to document the incident or pattern of abuse, and steps to take when reporting it to a supervisor or human resources officer.
- Wrongful Termination
An employer cannot fire you or take other adverse action against you for exercising your rights as an employee or reporting illegal activities. Becker Law Offices stands up for workers who have suffered retaliation, no matter what trumped-up pretext the company offers as an excuse.
- Noncompete Agreements
In Tennessee, restrictive employment covenants are enforceable if they are reasonable under the particular circumstances. The law in Tennessee is clear that the enforceability of restrictive employment covenants rests upon the law and public policy of the state in which the enforcement is sought.
- Wage and Hour Law
Basic federal law provides that every worker who is paid hourly is entitled to be paid at least minimum wage (presently $5.15 per hour) for each hour worked. In addition to this, many employees are also entitled to also receive an overtime premium for hours worked in excess of 40 during a workweek. The overtime premium is commonly known as time and one-half of the employees regular rate.
- Employment Defamation
It is an unfortunate truth that many times after you have left a job, the problems that caused you to have to leave are not left behind. Welcome to the world of employment defamation. Defamation consists of statements, written (which makes it libel) or oral (which makes it slander), that are knowingly false or intentionally misleading that cause you to suffer an identifiable loss.
- Family and Medical Leave Act
The Family and Medical Leave Act (FMLA) is a federal law that provides many employees with up to 12 weeks of unpaid leave per year. This leave can be taken all at once or intermittently, depending on the need of the employee. It requires that the employee be permitted to return to his or her position or a comparable position and that the employee's group health benefits be maintained during the leave.
- Breastfeeding at Work
It is illegal for an employer to discriminate against you because you are breastfeeding. In fact, in Tennessee, it is the law that an employer must give an employee a reasonable, unpaid break time for expressing breast milk, and provide a room or other private area for an employee to express breast milk. An employer cannot tell you to use a bathroom stall.
- Damages
If you have been terminated for a discriminatory or retaliatory reason, or if you are the victim of employment defamation, the law will permit you to recover your lost wages and benefits. This is known as back pay. Depending on the facts of your case, you also may be able to recover damages for humiliation and embarrassment, loss of enjoyment of life, mental and emotional pain and suffering, as well as punitive damages.
