Law Firm Overview

Bennett Aiello Cohen & Fried was founded by two trial lawyers who decided to build their practice in 2001. Not only does this law firm represent clients in the Florida area, but they also handle cases in the Caribbean and South America. These attorneys represent mortgage companies, banks and several other financial institutions. Real estate brokers, landlords and employment agencies are a few other types of clients represented by these lawyers.

The firm currently represents many types of clients, including banks, mortgage companies and other financial institutions, insurance companies, real estate developers, landlords, tenants, leasing companies, manufacturing companies, wholesalers, retailers, contractors, real estate brokers, jobbers, physicians, employers, employees, employment agencies, investors, and owners of a wide array of businesses.

Our clients include companies as well as individuals, located inside and outside the state of Florida and the United States. Also, the firm represents many clients located in Central America, South America, and the Caribbean. Many of our clients do not have in-house counsel, and eventually hire us to represent all of their business litigation needs.

- Commercial Litigation

Our attorneys routinely handle commercial litigation that involves: breach of contract and contract enforcement, involving all manner and types of business agreements; litigation under all articles of the Uniform Commercial Code (UCC); and commercial collections. The lawyers of Bennett Aiello & Cohen have represented businesses in a wide range of disputes involving business torts or statutes that govern business practices, such as: fraud and conversion; civil theft and RICO violations; unfair competition; trademark, trade secret, and trade dress infringement; unfair and deceptive trade practices and other consumer protection statutes, including, without limitation, the Truth in Lending Act, Fair Debt Collection Practices Act, and the Fair Credit Reporting Practices Act.

- Corporate Litigation

Bennett Aiello & Cohen has represented shareholders, members, owners, managers, officers, and directors of corporations, general partnerships, limited and limited liability partnerships, limited liability companies, and other entities organized under Florida law and the laws of foreign states and countries in disputes that involve: derivative claims by stockholders and other owners; claims for improper dilution of minority interests; valuation of minority interests; judicial dissolution and receivership proceedings involving “deadlocked” entities; conflict of interest claims; officer and director liability claims; securities fraud; and accounting.

- Mass Torts / Toxic Torts Litigation

Our toxic tort group seeks to develop successful trial strategies based upon the testimony and learned treatises of medical and scientific experts from a diverse group of disciplines. We have litigated cases in many jurisdictions, including Florida, Ohio, Virginia, Maryland and New York. Often, the number of plaintiffs in complex tort litigation ranges in the thousands. We know how to manage costs in complex cases like these, and we are often selected to manage large dockets of complex litigation and class actions. Some of our lawyers have tried to verdict and participated in the appeals of a number of toxic tort cases. -

- Real Estate Litigation / Broker Disputes

Our experienced trial lawyers have represented people in a variety of residential and commercial real estate disputes, including, without limitation, the following: mortgage and lien foreclosures; condominium litigation, including claims against developers; specific performance; restrictive covenants; nuisance claims; Interstate Land Sale Act (ILSA); quiet title and ejectment actions; partition actions; premises liability; real estate fraud and nondisclosure; zoning and unsafe building litigation; historic building and landmark designation contests; and homestead litigation. At Bennett Aiello & Cohen, we have been involved in the prosecution and defense of numerous disputes against the various professionals involved in real estate transactions, including lawyers, real estate agents, mortgage brokers, mortgage lenders, surveyors, licensed pest control services, and home inspection companies.

- Construction Litigation

At Bennett Aiello & Cohen we have represented numerous owners, architects, engineers, building contractors, subcontractors, and investors involved in disputes over the construction of commercial and residential real estate throughout South Florida. Our experienced trial attorneys represent clients involved in a variety of construction disputes, including: mechanic’s lien enforcement; substantial completion disputes; delay damage claims; design suitability and negligent supervision; construction contract disputes; construction defects and negligence; building code compliance; and building permit disputes. As a result of our extensive experience in the litigation of construction disputes, clients also seek our assistance in the negotiation and drafting of agreements related to construction, architectural, and engineering services.

- Landlord and Tenant Litigation

Bennett Aiello & Cohen represents landlords and tenants in connection with a wide variety of disputes, including, for example, large commercial evictions and suits to recover security deposits. Attorneys at Bennett Aiello & Cohen seek to protect their clients from the hazards of litigation by negotiating and drafting favorable leases for both their landlord and tenant clients. - Labor and Employment Litigation

Preventing employment disputes is important to the success of any business. When employment litigation cannot be avoided, the disputes are often quite serious to the business owner in that this type of litigation often involves an allegation that state or federal statutes have been violated. From the employee’s standpoint, employment disputes not only involve a loss of earnings, but also potential damage to the employee’s reputation. Proactively dealing with any employment dispute is the first step in avoiding costly litigation, morale declines, and poor productivity. We also can work with you to draft thorough employee handbooks, non-compete agreements, confidentiality agreements, and employment contracts. We represent executives and other highly compensated individuals in the negotiation and drafting of employment agreements.

- Debt Collection

Bennett Aiello & Cohen in Miami, Florida, represents creditors throughout the world who wish to collect judgments against debtors with real estate or other property in Florida. Even after obtaining a legal judgment, it can be difficult to obtain payment, particularly in Florida, which is considered to be a debtor-friendly jurisdiction. Bennett Aiello & Cohen has extensive experience in litigating the exemptions available to debtors in this state. We represent numerous creditors each year. We have quickly converted judgments into cash, either by garnishing bank accounts and wages of debtors who cannot meet the head-of-household exemption or by attaching and selling non-exempt real estate and other assets. We know how to unwind fraudulent transfers and find assets before the debtor liquidates property and moves money beyond the reach of the creditor.

- Professional Liability

Bennett Aiello & Cohen has significant experience in the litigation of claims that involve malpractice, misrepresentation, breach of fiduciary duty, or other errors and omissions by professionals, such as lawyers, accountants, and business consultants. We have represented both the claimants and the defendants in malpractice litigation. The Firm also has represented broker dealers and agents before the NASD in arbitrations relating to securities transactions. In addition, we have defended insurance and real estate agents accused of various errors and omissions.

- Fiduciary Breach Claims

Corporate officers and directors owe the fiduciary duty to act in the best interests of the corporation they serve. We are quite familiar with the standards of care, loyalty, and good faith that are owed by officers, directors, managers, and agents to the corporation or other entity they serve. We also understand the legal doctrines that immunize those who owe fiduciary duties, such as, the business judgment rule.
