- Bankruptcy

Anyone can fall prey to debt. - Chapter 7 Bankruptcy

Many people hesitate to file bankruptcy because of unknown consequences. However, bankruptcy is designed specifically to give you the fresh start you need. Chapter 7 bankruptcy provides relief from: credit card debt, medical bills, personal loan debt, other secured and unsecured debts, wage garnishment and creditor harassment. Chapter 7 bankruptcy completely discharges all eligible debts immediately once the bankruptcy is complete. In most cases, our clients are able to keep all of their personal possessions and protect retirement accounts. They can also often stop repossession or foreclosure if they come current on secured loans or past-due mortgage payments and continue to pay them on time.

- Chapter 13 Bankruptcy

Chapter 13 bankruptcy gives people who do not qualify for Chapter 7 bankruptcy the opportunity to obtain debt relief through debt reorganization. Instead of discharging debts right away, it reorganizes them into a payment plan to be paid over three to five years. Once complete, all remaining qualified unsecured debts in the plan are discharged. A Chapter 13 will incorporate debts like: medical bills, vehicle loans, credit card debt, certain student loans, personal loans and homeowners' association fees. You can also include past due domestic orders, such as child support, and certain back-due taxes in your plan, but they must be paid back in full by the completion of the plan.

- Unsecured and Secured Debts

Secured debts are debts in which you have offered something else as a security in case you cannot pay back your loan, such as your home or your car. In addition to signing your loan, you also sign a security agreement (a lien) that states that the lender has the right to repossess the items or property if you default on your loan. Unsecured debts, however, are loans in which nothing is held. They could include: credit card debts, including most store credit cards, medical debt, personal loans, personal lines of credit and debts to check-cashing companies or pay-day advance companies. Bankruptcy will discharge your liability for most secured and unsecured debts except student loans, court-ordered payments such as child support, and certain tax debts. However, secured property is still subject to repossession if not handled properly due to your security agreement.

- Credit Restoration

Your credit score is one of the primary ways many businesses evaluate your financial stability. As such, many people who are struggling with debt hesitate to file bankruptcy. After all, doesn't bankruptcy ruin your credit score forever? On the contrary, bankruptcy gives you the opportunity to start over. Once free from burdensome debts — which have just as much, if not more, negative impact on your credit score — you can begin rebuilding your credit right away.

- Debt Relief

In debt settlement, our attorneys negotiate on your behalf for a lump sum payoff of your debts rather than costly monthly payments at high interest rates. In exchange, the creditor will report to credit bureaus that you have settled your debt and owe them nothing further. Our debt negotiation attorneys represent your interests throughout negotiations, working toward an amicable, mutually beneficial solution. Almost any type of debt can be settled. Our debt settlement attorneys have experience handling debt negotiations involving: credit card debt, business/commercial debt, utility bills, medical bills, mortgages, personal loans, legal costs, such as attorneys' fees or court judgments, bank account or wage garnishments, charge-offs and defaults.

- Bankruptcy Exemptions

California has one of the most generous exemptions plans in the United States. If you are a homeowner with equity in your home, California laws offer certain home exemptions based on factors such as your marital status and your age. They are: $75,000 if you are a single homeowner; $125,000 if you are married; and $150,000 if you are over the age of 65. If the amount of equity you own in your home is less than the exemption, you should be able to keep your home. If your equity exceeds the amount of the exemption, our firm will help you explore other solutions, such as Chapter 13 bankruptcy, if keeping your home is important to you.
