Practice Areas
Practice Areas Description
- Employment Law for EmployeesEmployees have the right to perform their job duties in a workplace free from discrimination, retaliatory actions, and unfair treatment. Attorney Ed Broderick represents employees who face discrimination, retaliation, and unfair treatment through the conduct and policies of their employers. Employment discrimination is a sensitive topic that underlies many serious problems in the workplace, such as poor morale, lack of productivity, and needless man hours spent over legal matters that good leadership would have prevented. Mr. Broderick is familiar with both laws and policies that can be used to reduce and circumvent employment discrimination, as well as educate employers to prevent such activity.
- Employment Law for Employers
Employment law for employers should focus on measures to prevent and diffuse disputes and lawsuits from former and current employees. Attorney Ed Broderick offers educational and legal services to employers who are concerned about what they can and cannot do within the parameters of the law. Employers cannot prevent all lawsuits and disputes, but efforts can be taken to minimize problems in the workplace.
- Employment Discrimination
Employees and employers benefit from a work environment that is free from discrimination. However, when a discrimination claim arises, Ed Broderick, the head of our employment law practice, can put his employment law experience to work for you.
- Sexual Harassment
If you are an employer, a sexual harassment lawsuit can tie up significant amounts of time and resources. If you are an employee, you may think that you have nowhere to turn when you feel you have been sexually harassed in the workplace. At Broderick, Newmark & Grather, P.C., we represent employers and employees in a variety of sexual harassment matters. Whatever side of the issue you are on, you will find our law firm to be respectful, knowledgeable and dedicated to achieving your goals.
- Hostile Workplace
A work environment free from discrimination and other hostile actions should be a right for all employees in the workforce. Unfortunately, employees in all industries experience these actions, and all too often employers fail to correct them.
- Land Use and Zoning
Martin Newmark , our land use and zoning attorney, represents real estate developers, as well as individual property owners, who are involved in developing properties. Mr. Newmark serves as a spokesperson for residential, commercial, and industrial projects. He will develop an effective strategy and present the development plan to municipal, planning, and zoning boards.
- Real Estate Litigation
Real estate disputes can arise over contracts, land use, and rights of parties. At Broderick, Newmark & Grather, P.C., attorneys Martin Newmark and Alan Baldwin combine experience in real estate and civil litigation to effectively represent clients in real estate litigation. Our firm represents buyers, sellers, real estate brokers, landlords, tenants, builders, and others who have encountered a real estate dispute.
- Commercial Real Estate
Our real estate lawyers handle all transactional matters related to commercial real estate. We also undertake litigation on behalf of clients who are involved in disputes such as lease disputes, breach of contract matters and land use and zoning conflicts.
- Real Estate Brokers
As a licensed professional, a real estate broker has a fiduciary duty to his or her clients. This means that the broker has an obligation to exercise fidelity and good faith, with a primary devotion to the interests of his or her principal. This includes an obligation to keep certain kinds of information confidential. Brokers also have obligations to the public and cannot conceal material defects in a property from a buyer... Real Estate Brokers are also subject to liability, under some circumstances, under the New Jersey Consumer Fraud Act, which entitles an aggrieved consumer to an award of triple damage.
- Personal Injury
Has a serious accident left you dealing with injuries, medical bills and lost time from work? Have you lost a loved one in a fatal accident? At Broderick, Newmark & Grather, P.C., attorneys Alan Baldwin and Ed Broderick represent people who have suffered injuries in car accidents, slip-and-fall accidents and from defective products or inadequate security.

- Slip and Fall Accidents
It is the obligation of commercial landowners to maintain the safety of their properties for patrons. When they fail to do so, serious injuries can happen. If you have been injured in a shopping mall, stairwell, grocery store, parking lot, parking garage or any other commercial property, the law firm of Broderick, Newmark & Grather, P.C., can help.
- Construction Accidents/Premises Liability
At Broderick, Newmark & Grather, P.C., our personal injury attorneys represent clients in construction accident litigation and premises liability claims. The firm builds upon the experience of our lawyers to provide clients with full service representation in personal injury and wrongful death litigation.
- Professional Malpractice
Architects, engineers, real estate brokers and lawyers are all professionals, licensed to practice their profession by the state. When a licensed professional fails to perform up to the standards of the profession, this is called professional negligence, or malpractice. Individuals or companies who believe that a professional has not performed to the standards of the profession may be able to recover damages or other remedies.
- Legal Malpractice
When you hire an attorney, you place your trust in his or her skill and ethical standards. When an attorney fails to live up to these standards, the attorneys at Broderick, Newmark & Grather, P.C., can help you hold the lawyer accountable for his or her malpractice.
- Probate Litigation
Probate litigation over a will or trust can be emotionally exhausting for all parties involved. It is a sensitive matter, sometimes causing people to question the relationships they had with the decedent. Probate litigation can result in anger and harsh feelings towards other family members. Attorney Frank Grather represents spouses, disinherited heirs, estates, executors of wills, and administrators of wills. He is sensitive to the often-difficult nature of such matters.
- Construction
At Broderick, Newmark & Grather, P.C., we represent clients in construction disputes. We understand that the slightest delay or mistake can cost you time and money. We will work hard to resolve your construction dispute efficiently and cost-effectively for you or your business.
- Architects and Engineers
An error in design or engineering can cause expensive mistakes and costly delays in a construction project for both the design professional and his or her client. At Broderick, Newmark & Grather, P.C., we represent architects, engineers and their clients in design disputes and litigation.
- Divorce
Divorce can be a difficult and emotional time. If you are going through a divorce, it is important to be able to put your trust in an experienced Morristown divorce attorney who can guide you and protect your interests during the process.
- Mediation
Are you interested in mediation of all or some of the issues attendant upon your separation or divorce? Mr. Grather, a trained mediator, has found that a desire to "bury the hatchet" (in the ground) is why many couples are choosing mediation over litigation.
- Alimony (Spousal Support)
Alimony is a regular payment awarded to a spouse (husband or wife) to assist that spouse in maintaining the marital lifestyle after divorce, where that spouse was the economically dependent spouse during the marriage. Alimony awards are usually confined to those cases where the marital assets and division are insufficient to allow the parties to maintain the marital lifestyle without the assistance of an alimony award. Mr. Grather has wide-ranging experience in the field of alimony and defending against claims for alimony.
- Prenuptial Agreements
A Prenuptial or Pre Civil Union Agreement can be beneficial to anyone who is interested in protecting premarital assets. During the process of establishing the premarital agreement, it is necessary that each party is honest in identifying and disclosing all property and assets each spouse will bring to the marriage or civil union. Contributions can be financial or through other means. In the event of a divorce or dissolution of a civil union, an effectively drafted prenuptial agreement can protect premarital assets and provide structure for the settlement agreement.
- Parental Relocations
Following a divorce, one parent may want to move to obtain a better job, to be closer to family, or to get a fresh start in a new city. When a divorced or separated parent with primary residential custody wishes to relocate with the parties' child or children, there is a process to be followed. Because a move can interfere with the remaining spouse's custody and visitation rights, New Jersey law requires that both parents consent to a move. When one parent does not give consent to the move, family court becomes involved. The firm's attorneys represent both parents who wish to move and those who hope to prevent a move.
- Child Support
Child support and spousal support (alimony) payments are used to maintain lifestyles of a household and provide for the needs of the children. Attorney Frank Grather addresses clients' concerns regarding determining these payments. Child support payments are determined by a very strict guideline. Alimony payments are not based upon any specific formula and can become contentious.
- Child Custody
Social attitudes towards child custody and parenting time changed dramatically with the increase in the divorce rate in the last 50 years. Frank Grather has kept abreast of those changes as they are reflected in statutory and decisional law regarding parents separating and going through a divorce.
- Equitable Distribution
Equitable (fair) distribution of assets acquired during a marriage is one of the most important concerns facing divorcing couples. Some couples have little difficulty splitting up the property they have accumulated during their marriage. For other couples the process is not so easy. When trying to evaluate and divide complicated assets such as family owned businesses, stock options, deferred compensation plans, time shares, vacation homes, and investment accounts, a divorce lawyer who knows how to handle complex property division can be invaluable.
- Civil Unions
Civil unions between gay and lesbian couples have been legal in New Jersey since February 2007. Although civil unions continue to be an evolving area of the law, there are many things people in same-sex relationships can and should do to protect themselves, their partners, and their children. Because of the Federal Defense of Marriage Act, the federal government and most other states will not legally recognize a New Jersey civil union.
- Domestic Violence
