Law Firm Overview

At Burzynski & Young, our goal is to obtain justice for each client. Our Sarasota, Florida, law firm, helps homeowners and consumers resolve financial problems. We strive to fully understand our clients’ situations. This allows us to recommend and implement solutions that best meet their needs and goals. Whether that solution is filing bankruptcy or seeking relief from foreclosure, our attorneys stand ready to help. We understand that significant financial problems are frequently the result of external economic forces and circumstances beyond an individual's control. Debtors need someone who can help level the playing field and protect their rights. Our lawyers tell clients, "You don't have to do this alone."

Our foreclosure practice is led by Betsy Young; our bankruptcy cases are handled by Jeffrey Young. Since entering private practice, they have turned to family law, bankruptcy and foreclosure defense — areas that allow them to exercise their passion for justice. Both attorneys have been prosecutors, handling numerous jury trials involving felonies that included violent offenses and white collar crimes.

Our experienced paralegal, Polly Gaines-Williams has been with our firm for 17 years and is the first person clients talk with then they visit our office. Her presence greatly enhances our ability to serve clients effectively Her friendly and outgoing personality helps ease our clients' anxieties and fears about their financial difficulties. Equally important, her knowledge of our legal practice is critical to our ability to help clients.

Practice Areas

Practice Areas Description

- Chapter 7 Bankruptcy

Chapter 7 bankruptcy allows you to wipe the slate clean, eliminating most consumer debt, including credit card debt, motor vehicle debt and medical bills. At one time Chapter 7 bankruptcy was available to everyone. However, recent changes in the federal bankruptcy laws have made it more difficult to file under Chapter 7. In order to now file for this type of bankruptcy, a consumer must meet certain income requirements based on current median income data for the state of Florida. Even if you do not meet the income requirements, you may still be able to qualify for Chapter 7 by using the means test.

- Chapter 13 Bankruptcy

Chapter 13 bankruptcy is a good option for people who do not pass the Chapter 7 means test. Most people who do not qualify for Chapter 7 seek protection under Chapter 13 of the Bankruptcy Code. This type of bankruptcy, sometimes called a wage earners bankruptcy, will allow you to keep your property while you pay off your debts over three or five years.

- Foreclosure

The real estate market in Florida has been severely hit as a result of declining home values and a struggling economy. Burzynski & Young has maintained a full service foreclosure defense team. Our team defends your home as we would our own. The foreclosure defense team has been successfully fighting banks, in and out of court. We have experience in loss mitigation, mediation, and litigation. This vast experience uniquely qualifies us to defend homeowners in foreclosure matters.

- Deed in Lieu

If your Florida home is in foreclosure, you need to act right away. You do have options, but it is important to explore them quickly and identify the approach that fits your circumstances and meets your goals.

- Loan Modifications

Loan modifications have received a lot of publicity during these hard economic times. Television commercials make modifications look easy. However, many advertisers promising loan modifications actually have little of the legal knowledge needed to get you through this process smoothly.

- Deficiency Judgment

If your home is sold at auction in a foreclosure sale or the bank approves a short sale, you may be liable for the difference between what you owed the bank and the amount realized by the sale. This can result in a deficiency judgment. The amount may also be viewed as taxable income by the Internal Revenue Service (IRS).

- Investment Property Foreclosure

Some of the foreclosure alternatives available to residential property owners are not options if the home in question is a vacation home or investment property. If your second home is already in foreclosure or is at risk of foreclosure, it is important to seek knowledgeable legal counsel right away to learn about your options. Depending on the circumstances, it still may be possible to save your second home and minimize the financial consequences.

- Foreclosure Litigation

Even if you are ultimately able to keep your house, the foreclosure process can often leave you wanting to just walk away. If your home is in foreclosure or you know that foreclosure is just a few days away, get legal assistance fast, learn about your options and work to save your home. The lawyers at Burzynski & Young will walk you through foreclosure, helping you understand what is happening and making sure that we understand your goals.
