As a result, this firm has a national reputation not exceeded by any other firm. We have handled cases in 27 states. We have worked for clients and with other lawyers all across America.
"Attention to detail" and "a sense of urgency" best describes our approach to helping clients win. We believe in preparing every case for jury trial. That is the only way to make sure the settlement value of a case is maximized, should the client choose to settle. We believe in a true team approach, where a team of lawyers, paralegals, investigators and staff come together to work on your case for you.
Since our founding in 1988, we have been dedicated to representing plaintiffs in all types of civil litigation. From our offices in Georgia, we have developed a national litigation and trial practice.
Our Atlanta law firm has recovered millions of dollars for injured people and for families who have lost a loved one because of negligence in Georgia and many other states. We have successfully handled personal injury and wrongful death claims related to car accidents, hazardous property conditions, truck accidents, medical malpractice, food poisoning, auto defects, and more.

Practice Areas Description
Butler, Wooten & Fryhofer provides legal representation and services in the following areas of practice:- Personal Injury and Wrongful Death Claims
While our firm focuses on personal injury and wrongful death cases, we are not a personal injury mill. We do not handle a large volume of personal injury cases. Nor do we seek to settle claims as quickly as possible. Instead, we represent individuals and families who have legitimate, serious claims involving brain injury, spinal cord injury, severe burns and other catastrophic injury. The attorneys at our firm are prepared to take the time needed, and do the work required, to obtain the best results possible for our clients.
- Car Accidents
If you or a family member has suffered catastrophic injury as a result of a traffic collision, you are entitled to compensation for property damage (car and motorcycle repairs), medical bills, lost wages, pain and suffering and permanent injury or disfigurement.
Adjusters and insurers have one set of procedures for handling claims by individuals not represented by an attorney and a different set of rules for claims in which the victim has an attorney. You will rarely maximize your recovery by trying to handle your claim alone.
Our expertise in serious car accident litigation is broad. We know that in order to maximize compensation, an attorney must understand:
* The "rules of the road"
* The special duties imposed on commercial and public carriers
* The complex scientific and engineering principles necessary to determine how an accident occurred
* The medical evidence and literature used to evaluate catastrophic injuries
* The economic and accounting principles needed to evaluate losses
- Truck Accidents
Lawsuits based on accidents and collisions involving trucks, semis, tractor trailers or big rigs involve a complicated group of laws and large amounts of evidence. Because the trucking industry is heavily regulated, an accident involving a truck is significantly more complex than an automobile accident case. Based on our vast experience in representing plaintiffs in Truck Accident Cases we know that an action can be brought against both the truck driver and the trucking insurance company. We have the experience and specialized knowledge to lead the investigation into the cause of the truck accident and to help you collect the maximum amount allowed under the law.
The victims of truck accidents are entitled to compensation for property damage (car repairs), medical bills, lost wages, pain and suffering and permanent injury or disfigurement. Even after deducting attorney fees, the net recovery for an individual who is represented by an attorney in a truck accident case will be greater than an individual who tries to handle it alone.
- Motorcycle Accidents
Motorcycle accidents are often catastrophic, resulting in serious injury or death. At Butler, Wooten & Fryhofer, our personal injury attorneys understand how a catastrophic accident can impact you and your family. We are a national law firm servicing clients from our offices in Atlanta, and Columbus, Georgia, and also understand that you very likely only have one opportunity to obtain compensation for physical, mental, and financial injury from those responsible.
We assist victims and their families in all sorts of motorcycle accident claims, ranging from brain damage caused by a head injury from being thrown in a motorcycle accident, to a wrongful death caused from a collision in a car accident. Motorcycle accidents can be caused in many ways and we are equipped to handle all of them, including the following:
* Motorcycle accidents caused by defective motorcycles or motorcycle parts
* Motorcycle accidents caused by collisions with cars
* Motorcycle accidents caused by being sideswiped by a truck
* Motorcycle accidents caused by defective roadways and highways
* Motorcycle accidents caused by construction accidents
- Alcohol-Related Car Accidents
Despite the lowering of the blood alcohol concentration (BAC) limit from .10 to .08 and increased enforcement of DUI laws, innocent victims continue to be injured and killed in alcohol-related car accidents in Georgia and across the country.
If you were injured or a loved one was killed by a drunk driver, you deserve compensation. Unfortunately, drunk drivers often have little or no insurance available to compensate for your medical expenses, loss of income, pain, suffering, and other damages. In cases of wrongful death, there may not be enough coverage to pay for the funeral, let alone compensate the surviving family members for the loss of their loved one.
At Butler, Wooten & Fryhofer, we provide compassionate, yet aggressive, representation to victims of alcohol-related car accidents. Our firm knows how to hold drunk drivers responsible for their carelessness. We know how to recover benefits from the injured person's own uninsured or underinsured motorist insurance coverage, when available.
We also know how to seek additional compensation from irresponsible bar owners who serve alcohol to intoxicated customers. Georgia's Dram Shop Act provides that a bar, tavern, restaurant or other business that sells alcohol may be responsible for injuries caused by a drunk driver, if they:
* Knowingly sell, furnish or serve alcoholic beverages to a person who is in a noticeable state of intoxication, knowing that such person will soon be driving a motor vehicle.
You may be entitled to recover damages against a business or person that served or sold alcohol to the drunk driver who caused your accident. Your ability to recover damages depends on the facts of your case. Our firm has successfully litigated and settled several dram shop cases.
- Bicycle / Pedestrian Accidents
Bicycle and pedestrian accidents occur with alarming frequency. Because a cyclist or pedestrian is extremely vulnerable, being struck by a car, bus, or truck often results in a catastrophic injury or death.
- Railroad Accidents
Many railroad crossing accidents occur when a train crossing gate, arm, or signal fails to work properly, or when a sign is not posted alerting a driver of a railroad crossing.
At Butler, Wooten & Fryhofer, our nationally renowned personal injury attorneys, located in Columbus and Atlanta, Georgia, have extensive experience handling catastrophic injury claims, including personal injury and wrongful death claims from railroad crossing accidents, train wrecks, and premises liability from negligently maintained railroad property.
- Product Liability
If you have been injured by a dangerous or defective product, a products liability case can be filed against a variety of parties involved in the manufacturing and sale of the product. Defendants in the case may include a manufacturer of component parts, an assembling manufacturer, the wholesaler, and the retail store owner. Products are generally thought of as tangible personal property (automobiles, helicopters, airplanes, ladders, car seats, pharmaceuticals, medical devices, farm equipment, and household products and appliances); however, products liability lawsuits have also been based on natural gas, pets, real estate and maps.
At Butler, Wooten & Fryhofer, we approach a product liability case from every angle. In proving a product is defective, we must show that some or all or the following defects existed:
* Design defects exist before the product is manufactured.
* Manufacturing defects happen while the product is being constructed or produced.
* Marketing defects arise from improper instructions and failures to warn consumers about a dangerous aspect of the product.
Proving that the product was defective is the most difficult and important aspect of a products liability lawsuit and requires the services of a variety of experts and an attorney who knows how to effectively gather and organize the crucial information. At Butler, Wooten & Fryhofer, we have the resources and experience it takes to successfully pursue a products liability action.
- Auto Defects
From the founding of our firm in 1988, we have been on the cutting edge of automotive product liability litigation involving various defects in cars. Every car accident is different and has the potential of being caused not only by driver negligence, but may have also been compounded by a defect in one or both of the vehicles. Automobile Defect Cases make up a significant portion of our practice and we have achieved significant success at trial and during litigation.
- Medical Malpractice
When you entrust your health to a healthcare provider, you expect to be treated appropriately. And although most doctors provide exemplary care, medical negligence can and does occur. A medical malpractice case can be based on medical care provided by a range of medical providers, including physicians, nurses, hospitals, psychologists, and x-ray technicians.
* Misdiagnosis
Doctors perform a vital task in American culture -- keeping us healthy, curing us of disease, and healing our injuries. Unfortunately, doctors are also human, and humans make mistakes. One of the more serious mistakes a doctor can make is a medical misdiagnosis that, if performed properly, could have substantially increased your chances to obtain a cure, avoid many (or all) of the consequences, and, in some cases (such as certain cancer misdiagnoses), saved your life, or the life of a loved one.
Whether your doctor missed the signs of stroke, misdiagnosed colon cancer, or there was a misdiagnosis that led to unnecessary surgery, the nationally renowned medical misdiagnosis attorneys at Butler, Wooten & Fryhofer are prepared to fight for you. We will help you expose a misdiagnosis and assist you in obtaining fair and just compensation for any injury or loss suffered as a result of medical malpractice.
* Birth Injury / Cerebral Palsy
The birth of a new child is one of the most celebrated events for any family. Unfortunately, when a birth injury occurs that seriously injures the mother or baby, it can also be one of the most tragic events. Even more tragic, is when injury or death could have been avoided through exercising proper care during the birth and proper monitoring of the mother and infant during labor, during delivery, and after birth.
* Nursing Home Abuse and Neglect
Senior citizens and disabled persons deserve compassionate and competent care when they are no longer able to care for themselves. Unfortunately, too many nursing home and elder care facilities are more interested in profits than their residents' safety and well-being.
Was your parent, grandparent or other family member injured in a nursing home or assisting living facility? By exposing nursing home abuse or neglect, you may help prevent other residents from suffering the same treatment. Bringing a claim for injuries or death caused by mistreatment, abuse, or neglect can also help you recover compensation to pay for the medical expenses and other losses suffered by your loved one.
Nursing homes and assisted living facilities have a duty to provide proper care and service to patients. Nursing homes are not only responsible for the medical care that they provide to their patients, but also for the day-to-day supervision that their patients require. Injuries often caused by nursing home abuse include:
* Infections and Bed Sores - caused by failure to monitor a patient's skin, failure to reposition or move a resident who is in a wheelchair or bedridden, failure to treat bed sores which become infected, and unsanitary condition and inadequate infection control measures
* Broken Bones - and other injuries caused by failure to assess a resident's risk for falling and failure to take fall prevention measures
* Malnutrition and Dehydration - caused by failure to monitor a patient's food and water intake, failure to notify a physician when a resident is not eating or drinking
* Unexplained Bruising - or other injuries caused by physical abuse, assault, or sexual abuse by staff or other residents
* Restraints and Overuse of Drugs - injuries caused by improper use of physical restraints, medication overdose, and other medication errors
- Premises Liability
A premises liability case can be based on injuries occurring in residential and commercial buildings, shopping centers and parking facilities, hotels and casinos, amusement parks, airports, healthcare facilities, nightclubs and bars, as well as universities and public schools. The general rule of law is that the owner or operator of the premises has a duty to keep the premises in reasonably safe condition or at least warn customers of a dangerous condition of which the owner or operator caused, knows about, or should know about.
Premises liability includes far more complicated matters than a "slip and fall" accident in a grocery store. Perhaps one of the more common, but lesser litigated premises liability actions are those involving inadequate security. Inadequate security can give rise to assaults, robbery, sexual assault and homicide, and may be the result of a great variety of elements, including security guard operations, hiring, screening, training needs and supervision; and/or inadequate alarm systems and other security methodologies, including lighting and CCTV. At Butler, Wooten & Fryhofer, we know what it takes to make the strongest case possible to maximize our clients' recovery in any type of serious premises liability action.
We have represented clients in a variety of premises liability cases, which include:
* Assault due to inadequate hotel security
* Wrongful death due to inadequate fire safety protection and negligent management of the building
* Paraplegia as a result of negligent security at a shopping mall shooting
* Electrocution resulting from a dangerous condition
- Consumer Rights
At Butler, Wooten & Fryhofer, we stand up for consumers' rights and seek compensation for losses caused by consumer fraud and violation of state and federal consumer protection laws.
Our consumer rights attorneys have obtained many millions of dollars in class actions on behalf of consumers harmed by car dealer financial fraud, including failure to refund unearned premiums for credit insurance, extended warranty coverage and other insurance add-ons after a consumer pays off or terminates a loan.
We have the experience and legal knowledge needed to win large settlements and verdicts in a wide variety of consumer rights cases, including:
* Product liability actions for injuries and deaths caused by dangerous or defective products
* Identity Theft Claims against companies or individuals who obtain your personal information and SSN through fraud or use your identity illegally to obtain credit in your name
* Home Improvement Contractor Fraud against contractors, subcontractors and construction companies who take your money and don't perform the work you paid for
* Bad Faith Insurance Claims against insurance companies who fail to pay valid claims or unreasonably delay payment of insurance benefits
* Deceptive Trade Practices for violations of Georgia's Fair Business Practices Act, including trying to pass off used goods as new; bait and switch tactics; and making false or misleading statements about the quality of goods sold, sales prices, the origin or manufacture of the products
* Predatory Mortgage Lending, including lending to consumers who don't have the income to pay the loan, charging excessively high interest rates, loan flipping, large prepayment penalties and other fraudulent loan practices
* Unfair Debt Collection Practices, including continued collection calls after you have requested they stop, trying to collect debts which have already been paid, and other illegal and unethical debt collection tactics
* Foreclosure Rescue Scams by companies who falsely promise to help you avoid foreclosure or keep your house
* Inaccurate Credit Reporting, including reporting debts as past due when they are not, falsely reporting late payments and other mistakes in credit reporting
- Business Torts
If your business has suffered or has been placed at unnecessary risk because of the reckless, careless or intentional actions of others, you need a team of experienced business tort lawyers to pursue your interests. We will help you insure that your business interests are advanced and protected.
