- Child Custody Litigation

- Marital Property Division
New York is an equitable distribution state. Whose name appears on the title is not the important factor. Often issues arise concerning property that was acquired prior to the marriage. This property is considered separate; however, any increased value in the property itself may be considered a marital asset. Another problem our office frequently encounters is hidden assets. We have seen spouses divert funds. Our divorce lawyers will subpoena financial records and examine them in-depth to find hidden assets and seek a court order to value the assets for equitable distribution.
- Child Custody
Child custody is based upon the best interests of the child or children. Usually the parent that is the full-time primary care giver will receive residential custody unless he/she is proven unfit. A person is not unfit if they have a boyfriend or girlfriend or committed adultery. Courts look at the best interest of the child when determining whether a parent is the best fit. Some examples of what a court would deem unfit include drug and alcohol abuse or serious emotional and psychological problems. Most times, both parents are fit and desire to continue to be involved in their children's lives. When the parties cannot agree and the courts must determine with whom the children shall live, a long, expensive custody battle can result. Our firm will advise you about the likelihood of your case prevailing, so that you can make informed decisions.
- Child Support
Child support is based upon the income of both parents. For one child the obligation is 17%, two is 25%, three is 28%, and four is 33%. The actual amount is figured based upon a proportion of the two parents' incomes. One of the biggest issues in child support cases often involves determination of incomes. If a party is a W-2 employee, it is usually easy to figure out. If a parent is self-employed calculating income can be difficult. Courts will look at spending habits and bank records to help determine someone's income. We have experience in dealing with these matters and conduct thorough investigations into the spending patterns of the other party to actually figure out the amount of child support they should be paying.
- Modifications and Enforcements
The main area where we help clients with modifications is with their child support and child custody agreements. To change child support one party must show that there has been a change in circumstances that warrants a modification of the original order. If employment or income has increased or decreased, then there may be a right to modify the child support order. We can help you determine if a modification is possible and will represent you in obtaining the modification.
- Separation Agreements
A separation agreement is a detailed contract prepared by attorneys containing the respective rights and duties of the couple regarding issues such as child custody, visitation, support, property distribution, and all other matters related to the marital relationship. Certain requirements must be followed or the agreement will not qualify as legal grounds for divorce. The agreement, or memorandum of separation, has to be filed in the county where either party lives.
- Prenuptial and Post Nuptial Agreements
If you have substantial assets and property, it is important to protect them prior to getting married. A prenuptial agreement can set out conditions regarding financial matters in case of divorce or death. At Carol W. - Collaborative Divorce
Collaborative divorce involves a series of meetings and negotiations between the parties and their lawyers where information is openly shared about various facts, issues, assets, money, debts, and custody and support as they relate to the marriage. Once the parties reach an agreement, the attorneys will draft a written document in the form of a traditional divorce pleading and present it to the court.
