In Delaware, a creditor can seek a court order for a wage garnishment that, if granted, allows them to take 15 percent of the net earnings in your paycheck. - 341 Meeting

You and your attorney attend a Meeting of Creditors as part of your bankruptcy proceeding. Typically, this meeting involves, you, your attorney, and the bankruptcy trustee. Your creditors are permitted to attend, though in reality they almost never do. The meeting lasts approximately 5 minutes in most cases, although you can expect to be there for 30-60 minutes when you factor in waiting times.

- Tax Debt Issues

At Carucci Butler, we help people with a wide range of debt issues, including state and federal tax debt. One of the most common misconceptions about bankruptcy is that it relieves all debt in all situations. Tax debts are often not discharged through bankruptcy when other debts are. But certain types of tax debt can be discharged. In general, tax debt can be discharged if:

. The tax return due date was three years before the bankruptcy
. The return was actually filed at least two years prior to the bankruptcy
. The assessment from the IRS happened at least 240 days before the bankruptcy
. There was no fraud involved in your tax return
. You were not guilty of tax evasion
