- Divorce
Preparation and obtaining sufficient information are the keys to resolving the issues in any divorce. We handle divorce and dissolution of marriage and all related marital and domestic issues, including: divorce appeals, military divorces, property, division and equitable distribution, custody, parenting plans, time sharing and visitation, child support, spousal support and alimony. No one is automatically entitled to alimony or spousal support as part of a divorce settlement. The courts will consider a number of factors, including the length of the marriage, child rearing responsibilities and the parties' disparities in income. The primary consideration in determining whether a party will receive or have to pay alimony is whether one party has the need and the other has the actual financial ability to pay.

- Child Custody / Visitation
Custody disputes can be one of the most contentious issues between parents of minor children. When making a custody and visitation determine in Florida, the Judge is required to establish a parenting plan and time-sharing schedule. The Parenting Plan will address all issues related to the care and upbringing of all of the minor children born of the relationship. There is no "standard" time-sharing schedule. The Florida Courts are trending more towards "equal time-sharing" or rotating custody. Nevertheless, a competent attorney should evaluate the particular circumstances of your case pertaining to your child(ren) so it can be determined whether in fact a rotating time-sharing schedule is in the best interests of your children. In many cases, equal time-sharing is difficult to accomplish at best and in some cases it is simply detrimental to the interests of the children.

Issues involving child custody are generally always subject to modification which results in various issues after the entry of a Final Judgment of Divorce or Paternity. The request of one parent to relocate with the children to a distant location is especially difficult. Should you be seeking to relocate post the entry of any court order concerning custody and time-sharing there are specific legal steps which you must strictly adhere to accomplish your objective of relocating. On the other hand, every parent has legal rights to protect themselves and their relationship with their children. When one parent wants to relocate and take a child with them, it can result in a messy, stressful and time-consuming process. When a parent wants to relocate more than 50 miles away from the other parent, the move must be handled according to Florida's relocation statute. If both parents agree to the relocation, the process can simplified, but it generally advisable that any such agreement be approved by the Court.
