Law Firm Overview Free Consultation

At Clark, Byarlay & Sparks Attorneys at Law, we provide clients with competent representation at a reasonable price. Our firm is a general practice law firm that was organized in June 1988 by Andrew Clark and Tom Byarlay. Rusty Sparks joined the firm in 2003 and became a partner in 2007. We believe in the words found in Proverbs Chapter 13, verse 10: “Pride only breeds quarrels, but wisdom is found in those who take advice.”

No attorney knows everything there is to know about all areas of the law. The reason why it is called the “practice of the law” and not the “art of law”. However, by working together, our three partners bring to each case more than 80 years of combined legal experience. As a result, we are able to provide knowledgeable representation to clients in a variety of practice areas. Our focus is on bankruptcy, social security and family law, but we are also able to provide advice in many other areas.

Our clients receive personalized legal service and accessibility from our Little Rock Lawyers. Working closely with our clients, we take time to listen, educate them about the law, return their calls promptly and keep them informed throughout their cases.

Practice Areas

Practice Areas Description

- Bankruptcy

If you are struggling with the burden of unmanageable debt, bankruptcy may be the answer for you. Through bankruptcy, millions of people have been able to obtain the fresh start they need, free from the constant stress and worry of debt problems.

- Chapter 7 Bankruptcy

When people think about bankruptcy, Chapter 7 is the type of bankruptcy they typically imagine. It is the most common form of bankruptcy; millions of people have filed for Chapter 7 relief to wipe out debt and gain a fresh start.

- Chapter 13 Bankruptcy

Sometimes referred to as a debt restructuring bankruptcy, Chapter 13 bankruptcy allows people struggling with debt the opportunity to get back on strong financial footing and gain a fresh start.

- Chapter 11 Bankruptcy

If your business is struggling with debt problems, a Chapter 11 bankruptcy may provide the relief you require. Chapter 11 bankruptcy is a debt reorganization bankruptcy typically utilized by corporations and partnerships that are struggling with debt. Individuals with significant debt may also file for Chapter 11 bankruptcy.

- Creditor Harassment

Two of the most common reasons why people file bankruptcy are creditor harassment and the threat of home foreclosure. If you are at risk of losing your home to foreclosure, or you are sick of harassing collection calls, wage garnishments or other debt related problems, an experienced bankruptcy attorney at Clark, Byarlay & Sparks can help.

- Wage Garnishment

Being behind on your debts can cause many headaches. Two of the worst challenges a person with debt can face are wage garnishments and auto repossession. Through wage garnishment, creditors directly attack your paycheck. Before you see the reward for your labor, a portion of your paycheck is automatically deducted to pay a creditor. Through auto repossession, someone you do not know may actually come to your home and take your car when you are not looking.

- Credit Card Debt

If you are drowning in credit card debt or have medical bills you are unable to pay, bankruptcy may provide the relief you need. Through a Chapter 7 bankruptcy, credit card debt, medical bills and most other forms of consumer debt can be discharged. Chapter 13 bankruptcy can provide relief by creating an affordable payment plan to restructure your debts.

- Divorce

The final outcome of a divorce can have a significant impact on your parental and financial rights. With so much at stake, it is critical that you have qualified legal counsel.

- Property Division

Property division is a critical component of any divorce. The manner in which property is divided can have a significant impact on an individual's immediate and future security.

- Custody and Visitation

Nothing is more important to a parent than their child. If you are going through a divorce or other contested family law matter in which your parental rights are at stake, you want the most qualified attorney you can find who is dedicated to protecting your parental rights.

- Child Support

Child support in Arkansas is determined by a mathematical formula contained in the Arkansas child support guidelines. The guidelines take into account the income of both parents.

An experienced divorce and family law attorney at our firm can review your case and perform a guideline support calculation on your behalf to determine the amount of support you should be paying or receiving. While deviations from child support guidelines are uncommon, we can also review the facts of your case to determine if there are unique factors that may warrant a deviation from guideline support.

- Alimony

Spousal support (alimony) can be one of the most complex and potentially contentious aspects of a divorce. An experienced divorce lawyer can advise you of your rights, help you anticipate how a Court will analyze a spousal support claim, and ensure that your rights are protected.

- Social Security Disability

Filing for disability benefits can be a timely and difficult process. Unfortunately, many people who are eligible for Social Security Disability Insurance (SSDI) benefits or Supplemental Security Income (SSI) benefits stop seeking benefits because they are discouraged by denied applications and a complicated appeals process.

- Social Security Disability Appeals

Has your application for Social Security Disability benefits or Supplemental Security Income been denied? Contact an experienced Social Security Disability appeals lawyer at Clark, Byarlay & Sparks. Our attorneys aggressively pursue SSDI and SSI benefits for people whose applications have been denied. We have a proven record of results in SSDI and SSI appeals.

- Criminal Law

"Criminal Law" is the name given to the branch of law that governs an individual's relationship to the state. It includes the definitions of criminal offenses, which are usually established by Congress or state legislatures. The term "criminal law" also encompasses the rights of an accused and the criminal process, including arrest, arraignment, grand juries, pleas, discovery, pretrial hearings, trials, jury selection, evidence, motions and post-trial remedies. The main purpose of the criminal law is to set forth the punishment for criminal offenses. In order to prove any crime, no matter how serious, the prosecutor must prove that the accused committed an act beyond a reasonable doubt.

- Business Law

Business law is a branch of civil law that governs business and commerce in both the private and public sectors. It provides a legal framework within which businesses are created and organized as well as how business is conducted. Business law covers a wide variety of topics relating to the law of agency, corporations, partnerships, limited partnerships, franchises and limited liability companies. It involves such issues as fiduciary relationships, closely held corporations, shares and stockholders, directors and officers, dissolution and receivership, franchise relationships, management duties and liabilities, mergers and acquisitions, securities and antitrust. We have extensive experience in this area.

- Real Estate Law

"Real estate law" is the name given to the branch of civil law that covers rights to possess, use, and enjoy land and the permanent man-made additions attached to it. This includes the capacity to hold interests in real property, permissible interests in real property, relations between owners, relations between owners and the community, landlord and tenant relations, the transfer of interests in real property, and real property financing, including deeds and mortgages.

- Wills and Probate

In a will, a person expresses, in writing, what he (or she) wants done with his property after he dies. Arkansas requires that wills be signed and witnessed by at least two people.

Probate is a court proceeding in which final debts are settled and legal title to property is formally passed from the deceased person or "decedent" to his heirs. Probate proceedings take place in the Circuit Court in the county of the decedent's legal residence at the time of his death. If a person dies intestate, meaning without a will, state law determines how to distribute his property.
