Practice Areas Description

Coxwell & Associates, PLLC provides legal representation and services in the following areas of practice:

- Personal Injury

Many of our clients suffer serious personal injuries as a result of vehicle accidents. We have handled major truck accident cases and car accident cases. We fight for the rights of our injured clients to ensure that they receive fair, reasonable and just compensation for their harms and losses. Below are a few personal injury areas in which our attorneys concentrate:

• Auto Accidents

Our injury attorneys have helped individuals recover for their harms and losses caused by another driver’s negligence, carelessness or inattention. In many instances, the person who is injured may also have a claim against a company whose driver causes an injury. Our attorneys investigate each case thoroughly to make sure the injured person is fully and fairly compensated for their harms and losses.

• Trucking Accidents

Large semi-trucks are common on our highways. Unfortunately, due to their size and other factors, these trucks pose a number of dangers to other motorists. Truck drivers must deal with large blind spots, the size of their vehicle makes abrupt stops difficult, and the vehicle's high center of gravity may cause it to tip over. Additionally, semi-trucks hauling or carrying objects may lose control and spill its cargo onto the road and other motorists. It is important to seek legal counsel with qualified Mississippi accident attorneys after you have been injured in a trucking accident in order to obtain the compensation you deserve.

• Serious Bodily Injury

Serious bodily injury covers a wide range of cases in which an injury involves a substantial risk of disfigurement, dismemberment, physical and mental impairment, extreme physical pain, or death. Victims often have difficulty performing tasks they were able to perform prior to their serious bodily injury. The effects of the injury to the individual and those around him or her can be devastating, both emotionally and financially. It is of the utmost importance that victims of serious bodily injury seek out legal representation in order to obtain just compensation. We have represented clients who have suffered serious bodily injury as a result of: truck accidents, car accidents, defective drugs, medical malpractice, and, exposure to asbestos.

• Mesothelioma Liability

Mesothelioma is a rare cancer caused by asbestos exposure. The most commons symptoms of pleural mesothelioma are chest pains and difficulty breathing. Asbestos fibers can be inhaled into the body from on the job exposure. In the past asbestos exposure typically came from factories, shipyards, mining industries, power plants, oil refineries, steel manufacturing plants, construction and demolition removal jobs, etc. After the 1980's workplace exposure became rare, however, a person exposed might not develop the disease until many years later. Sometimes it takes the disease 20-40 years to become noticed in the human body. When you are fighting for your health and life against a cancer like Mesothelioma, it is essential that you get zealous and competent Mississippi premise's liability lawyer representing you in the legal system. The purpose of filing a civil action (lawsuit) is to obtain financial compensation for the harms and losses you suffer as the result of this Mesothelioma.

• Spinal Cord Injury

At Coxwell & Associates, PLLC our personal injury attorneys in Mississippi have helped people who suffered traumatic spinal cord injuries from serious auto accidents. Currently we are representing a woman who has spinal cord injuries after being hit from behind by a drunk driver. In another case we are representing a young man who is paralyzed from the waste down after being hit head on by another drunk driver.

• Brain Injury

Traumatic Brain Injury (TBI) occurs when the brain sustains damage due to an outside force. Some forms of brain injury involve penetration (such as a bullet wound) while other types of brain injury are classified as closed head (such as a concussion). Common causes of traumatic brain injury are auto accidents, falls, acts of violence, and even contact sports.

• Wrongful Death

Wrongful death claims can involve various incidents, from surgical errors to hit and run automobile accidents to a manufacturer’s defective products. In any case, the wrongful death results from negligence and the family of the victim has a right to compensation. At our Jackson, Mississippi firm, our wrongful death lawyers can give professional legal advice on how to file your claim. We are familiar with and highly experienced in federal and Mississippi state wrongful death law, so you can be assured that your case will be expertly handled by our attorneys.

• Pedestrian Injury

As personal injury lawyers in Mississippi we know that every year a large number of pedestrians are injured or killed by motor vehicles. Children are often at risk when they are going to and returning from schools. Statistics show that many of the auto/pedestrian accidents occur because the driver is:

. Failing to observe proper speed;
. Failing to yield to pedestrians in designated cross walks;
. Driving while intoxicated;
. Driving while tired;
. Driving while talking on a cell phone.

• Boating Accidents

As Mississippi injury attorneys, we recognize boating accidents are common in any area where there exists recreational or work-related boating. Injuries are quite common as a result of water skiing, jet skiing, fishing and other kinds of water sports. Boating accidents often include:

. Capsizing;
. Falling overboard;
. Collision with another vehicle or structure;
. Fire;
. Sinking or flooding;
. Alcohol related events.

• Motorcycle Accidents

As experienced personal injury attorneys in Jackson, MS, our firm understands motorcycles can provide their owners with tremendous fun and foster camaraderie with other riders. However, a motorcycle owner should always keep in mind that it is more dangerous to drive a motorcycle than an automobile. There are no steel bars or air bags to protect the motorcycle operator in the event of an auto accident. Some motorcycle operators state that they drive both “offensively and defensively.” This means that they always assume the approaching car might fail to detect them. If you are a motorcycle operator, always wear a helmet and protective clothing.

• Dog Bite Law

The law governing dog bites can be found in state laws, county and city ordinances, and rules developed from actual cases. Dog bites can fall under both civil (personal injury) and criminal law. One of the most interesting rules is an old English law called the “one bite rule.” This ancient law protected a dog owner from criminal or civil liability/responsibility until the owner had a certain degree of knowledge that his dog is dangerous. Most states have ended the “one bite rule” and now dog owners can be held liable if their dog bites a person and the victim was not trespassing or provoking the dog.

Clients call us every week after being arrested for possession of controlled substances (illegal drugs). There are two different jurisdictions that people can be charged with drugs. The first is within Mississippi state courts. The second place a person could be charged is Federal District Court. The penalties for both are severe and representation is a must in both cases.

• DUI Defense

Coxwell & Associates can answer any questions that you or someone you care about has about a DUI charge. Our lawyers have handled countless DUI cases over the years and have acquired valuable experience that can help you with your DUI defense.

• Felony Law

The word felony refers to a group of crimes that are considered to be the more serious and are distinguished from the lesser crimes called misdemeanors. In Mississippi the criminal justice system still uses the terms felony and misdemeanor, while other states have done away with the terms and classify crimes as Class A, B, C, etc. The kinds of crimes that are considered to be felonies include, but are not limited to murder, rape, arson, drug crimes, embezzlement, grand larceny and some repeat misdemeanors, such as a third offense for shoplifting or a third offense driving under the influence.

• Misdemeanor Law

The term misdemeanor is generally used to define a "lesser" crime charged against a person by the State, County or City. The United States Government also has Federal misdemeanors in the United States Code. The term "lesser" crime means that the crime is punishable by one year or less in jail and no more than a one thousand ($1,000.00) dollar fine, or both. People who are sentenced to jail for a misdemeanor crime will serve their sentence in either a County Jail or a City Jail. They will not go to the State penitentiary. The State Penitentiary is reserved for felony charges, which are the more serious crimes in Mississippi, and include drug crimes, grand larceny, armed robbery, murder, etc.

• Vehicular Manslaughter Defense

Any fatal motor vehicle accident could cause the surviving driver to face the risk of criminal prosecution. This is especially true if alcohol is involved in the accident. In other cases, the prosecutor can charge vehicular manslaughter in cases of gross negligence. These cases can be extremely technical and can depend on how the prosecutor and/or the jury view the facts. Facts that might lead to civil liability are not sufficient to result in criminal liability. If the driver has serious, negative prior driving history, a suspended license, or commits a serious driving offense, there is a strong possibility that a crime may be charged. Vehicular homicide carries a maximum of twenty (20) years in the State Penitentiary. Injuring another person while the driver is under the influence of alcohol; can lead to a sentence of twenty-five (25) years in the State Penitentiary.

• Banking Fraud

Bank and banking fraud, predatory lending and predatory servicing refers to a lending institution using fraud or deception to cause a person to lose or surrender their property. Bank fraud can be due to mismanagement by the institution but is often due to intention acts of fraud in order to increase profits through thins like bogus fees, illegal overcharges, and hidden fees. Sometimes the situation can be corrected by confronting the institution with the discrepancies, but when that does not work, which is all too often, it's time to take the lender to court.

• Predatory Lending

Predatory lending occurs when a bank, mortgage company, finance company, credit company, or other money lender uses tactics that unlawfully take advantage of the borrower. Predatory lending occurs in the form of overcharging loan fees, overcharging interest rates, not fully informing the borrower of his or her rights, falsifying credit reports, overcharging for insurance on the loan, or forcing you to purchase a type of insurance you do not need. Sometimes lenders may encourage you to refinance a loan when it is not in your best financial interest to do so. There are many other tactics that take advantage of unsuspecting borrowers.

• Insurance Bad Faith

Bad faith claims are based upon an insurance company denying a claim that a policyholder makes. The claim potentially originates when the denial occurs.
