Practice Areas Description

Daley, DeBofsky & Bryant offers legal advise related to the following areas of law:

- Disability Insurance Law

When you bought your private disability insurance policy, you were probably perfectly healthy. But when you need to make a disability insurance benefits claim on that policy, you are most likely dealing with serious medical and financial problems. You need a firm of attorneys well-versed and highly experienced in employment and benefits law to help you deal with the insurance company and its lawyers. At Daley, DeBofsky & Bryant, we work with people every day offering our advice on qualifying for benefits and litigating lawsuits on behalf of those whose insurance or benefit claims have been denied.

- ERISA

While employers are not required to provide pension and retirement plans for their employees, they get tax benefits if they do. In exchange for those tax benefits, they must meet certain standards for funding and managing those plans. In 1974, Congress passed the Employee Retirement Income Security Act (ERISA) in order to make sure that benefits promised to employees were there when they needed them. Unfortunately, some employers still refuse or neglect to comply with the law. Pensions and other benefits that employees have earned and counted on turn out to be illusory promises. When that happens, the managers or owners of the business can be held liable.

- Employment Law

Every employer has an employee benefits package—sometimes the company has several packages that differ according job type or pay grade. Each benefit plan may define its eligibility standards differently. For example, some disability plans allow you to work with a partial disability, while others may not. Some allow you to receive catastrophic leave pay while you are waiting for your claim to be processed, while other plans may not have this option. Most people do not have the leverage to negotiate the terms of their benefits package when they begin a new job, but everyone should be aware of what those benefits are.

- Social Security and Medicare Attorneys

Almost everyone who deals with the Social Security Administration and Medicare agrees that answers are difficult to obtain from these agencies. Benefits can be even harder to get. Eligibility, qualifying events and claims, the frequency and amount of payouts, co-payments, and time limits for submitting and paying claims are all subjects of detailed regulations and caselaw. A knowledgeable and experienced Chicago Social Security Disability and Medicare attorney can tell you where you stand within the Social Security system and how to fight for your rights.

- Pension

Working people in Illinois often rely on pension benefits when planning for their retirement. These are crucial benefits many retirees need to make ends meet. After years of hard work and loyalty, retirees who participated in a pension plan are usually entitled to these benefits by law or contract. But despite extensive federal regulations governing private sector pension funds, some employers still try to cut their employees short.

- Railroad Retirement

If you are a current or former railroad worker, you may qualify for disability benefits from the United States Railroad Retirement Board's disability benefits program. Your injury does not need to be work-related, but you must not be able to continue to perform your job because of a disability. Railroad benefits are intended to provide benefits similar to those available to other individuals under the Social Security Act. Eligibility, qualify events and claims are closely regulated and decided by detail case law, similar to Social Security benefits.
