Practice Areas Description
Our practice includes:- DWI
A successful Texas DWI defense is built on knowledge and experience, and I have both. Since leaving the judicial bench, I have established a criminal defense practice focused on defending those accused of DWI and DUI, including underage drinking and driving. I have attended, participated in and lectured at numerous DWI/DUI seminars across Texas and the U.S. I have advanced training as a Breath Test Operator of the Intoxilyzer 5000 - known as the breathalyzer machine - and I am a Certified Instructor of the police sobriety tests known as Standardized Field Sobriety Tests (SFSTs). In addition, I have attended the prestigious National DUI College at Harvard.
- Underage DWI
Texas takes underage DWI charges very seriously - if you are caught driving with a blood alcohol level of .08% or higher, you will be charged with Driving While Intoxicated (DWI); if you are under the age of 21 and are caught driving with any detectable amount of alcohol, you will be charged with Driving Under the Influence (DUI). The good news for minors convicted of an underage DWI for the first time, is that there will be no jail sentence. However, there are other significant penalties, including a fine and probation, and the possibility of community service and alcohol awareness classes. The minor's driver's license will also be suspended.
- Drug Charges
David Hunter Law Firm represents clients accused of all types of drug offenses in Texas state courts, including: Possession of a controlled substance (PCS); Delivery of a controlled substance; Possession of marijuana (POM); Possession of drugs or paraphernalia; Possession with intent to distribute; Narcotics trafficking; Manufacture or cultivation of drugs; Prescription drug fraud; Juvenile drug charges; and, Other drug charges and drug cases.
- Drug Possession
Arrest for drug possession often occurs in conjunction with car stops or domestic violence calls. In each instance, legal questions arise in regard to whether officers had probable cause to search a car, apartment or house and whether evidence was handled properly. As a former judge and county attorney, I understand how prosecutors and police think, the tactics used to blur Constitutional issues, how witnesses can be intimidated and when informant testimony is questionable at best. As your drug possession attorney, I critically review police statements, dashboard video of car stops, tapes of interrogations and other evidence in exposing mistakes and questionable tactics on the part of prosecutors and police officers.
- Domestic Violence
Arrest and conviction on domestic violence charges is a serious matter, which is why you need a knowledgeable, hard-hitting domestic violence attorney. A conviction for domestic or family assault will likely remain on your criminal record, impacting your ability to find a job and establish visitation rights with your children if you are divorced. Since most cases of domestic violence result in a restraining order, you could be required to relinquish ownership of your firearms or submit to electronic monitoring. Attorney David Hunter gathers all relevant information to create a strong domestic assault defense. He makes sure all the facts are brought forward, telling your side of the story before the court makes any determination.
- Juvenile Charges
If your son, daughter, or loved one is facing criminal charges, you need a strong and vigorous juvenile crimes defense effort. I am David Hunter, one of the most experienced juvenile defense attorneys in the state of Texas and a former Texas Juvenile Judge. I work to protect the rights and freedom of juveniles charged with crimes in Fort Bend County, Texas. I always seek a solution that will preserve the future career and educational options of your child or loved one if it is at all possible.
- Traffic Tickets
At The David Hunter Law Firm in Sugar Land, Texas, I represent clients charged with violating City of Sugar Land traffic laws. As your traffic ticket lawyer, I will work hard to obtain a dismissal or reduction of the charges whenever possible, or to minimize the consequences that you will face. I represent clients for all types of traffic violations in the City of Sugar Land, including: Speeding; Reckless driving; DWI and DUI; Driving without a license; Driving without insurance; Driving without seatbelts; and, And others. I also represent clients at administrative hearings for driver's license restoration.
- Bail Bond
I am David Hunter, a former Texas judge and an experienced bail bond attorney, and I represent clients accused of misdemeanor and felony crimes in Harris County, Texas and Ft. Bend County, Texas. If a family member or a loved one has been arrested and is in custody, you probably want to get them out of jail. The accused usually wants to get out jail for obvious reasons. However, by being free, the accused is in a much better position to fight their charges. When someone is arrested, the Court generally has two choices in cases where bail is an option. It can release the accused on his or her own recognizance (a personal recognizance bond or PR Bond), or it can require the posting of bail. In some cases where the bond amount is too high, we are successful in persuading the Court to lower the amount of the bail bond. As your attorney, I strive to protect your freedoms and rights.
- Drivers License
A drinking and driving or drunk driving arrest starts two legal processes - a criminal proceeding and an administrative process that can lead to a suspension of your driver's license. You can challenge the license suspension by requesting an Administrative License Revocation (ALR) hearing, but you must request the hearing within 15 days of your arrest. I am David Hunter, an experienced suspended drivers license attorney and former Texas judge. I can represent you in both the criminal process and at the ALR hearing.
- Expunction
Expunging your criminal records in Texas is a time consuming process that should not be done without a knowledgeable expunction attorney by your side. Only certain criminal offenses can be expunged for defendants. Some criminal offenses require a 5 year waiting period before a petition for expunction can be filed. Other types of crimes may only be eligible for “sealing”, or non-disclosure to the public. Find out which one you are eligible for, so you can begin a new life without a criminal past. I will do everything possible to give you a clean record.
