Law Firm Overview
Davis Elder & Disability Law Services is a small law firm dedicated to helping disabled or aging clients obtain State and federal public benefits. Our primary office is located in Wilkesboro, North Carolina and we represent seniors throughout northwestern North Carolina. We serve Social Security disability claimants throughout North Carolina, east Tennessee, Virginia and West Virginia. For our clients with disabilities, we offer assistance in pursuing Social Security Disability Insurance benefits and Supplemental Security Income benefits. We may also assist with obtaining North Carolina Medicaid benefits for the disabled. We represent both adults and children in disability claims. For those who have sacrificed for our country through military service, we assist in handling claims for compensation before the U.S. Court of Appeals for Veterans Claims.For our aging clients, we provide comprehensive elder law services. We assist seniors with planning to preserve their life savings in the event that they may need long-term or institutionalized nursing care in the future. We provide highly customized Durable Powers of Attorney for maximum flexibility in future financial planning, together with Health Care Powers of Attorney in the event of physical/mental incapacity. For clients who are imminently in need of such placement, or who are already residing in an assisted living or skilled nursing care center, we offer legal services to preserve as many assets as possible without jeopardizing quality health care. Our services include specialized Wills with Discretionary Trust Provisions to protect assets owned by spouses and other estate planning to prevent subjecting property to loss or claims by Medicaid estate recovery (claims by the State for reimbursement of money spent on Medicaid services). We further serve our clients by making Medicaid applications on their behalf and providing continuing legal representation throughout the processing of the application by the local Department of Social Services. In appropriate circumstances, we can assist with creating Special Needs Trusts or Pooled Trusts for the Disabled.
