- Civil Rights

Davis Levin Livingston and its partners have made a life-long commitment to ensuring that civil rights and civil liberties are protected. Partners Mark Davis and Michael Livingston have both acted as staff and volunteer attorneys for the American Civil Liberties Union; Partner Stan Levin is the former lead litigation attorney for the Legal Aid Society of Hawaii; Partner Thomas Grande is the former executive director of Common Cause/Hawaii. We do not represent defendants who have been the cause of construction problems and only represent homeowners and community associations who have claims for construction defects at their homes. Our current cases are at the cutting edge of construction industry law in our attempt to assist homeowners who have purchased defectively constructed homes.

- Disability Rights

The rights of persons who are physically challenged have been championed by partner Stan Levin, who has been at the forefront of litigation involving the Americans with Disabilities Act as well as other state and federal statutes protecting the rights of the disabled. A few of the successes which Mr. Levin has achieved on behalf of the disabled include the following: A $3.7 million verdict for Hawaii Blind Vendors Association for monies improperly withheld for state-airport concession stands; Requiring the City and County of Honolulu to make sidewalk ramps accessible throughout the island of Oahu.

- Employment

We have represented and achieved significant results for employees who have been terminated, been discriminated or retaliated against and who have suffered sexual or other types of harassment. Some of our recent cases include the following: The largest sexual harassment settlement in Hawaii, won on behalf of a police woman who suffered sexual harassment at the hands of her fellow officers; Representation of a doctor whose contract was not renewed because of complaints about the quality of health care being delivered by the hospital she was working at.

- False Claim Act (Qui Tam)

Davis Levin Livingston has made a commitment to Help Stop Fraud by pursuing state and national initiatives to recover monies fraudulently billed to government health care programs, such as Medicare, Medicaid and Tri-Care. Our firm partners its qui tam cases with other attorneys both in Hawaii and across the country. The firm obtained the highest Medicare fraud settlement in Hawaii and is working with both private attorneys and public interest groups to help stop fraudulent health care billings which are threatening the very existence of our government health care systems.

- Health Care

Cases aimed at improving the quality of health care delivered to our citizens comprise an important part of Davis Levin Livingston's commitment to litigating cases which have important social effects. Some of our recent cases include the following: Settlement of a case which stopped a local doctor from fraudulent selling generic drugs to Medicaid patients, but charging the government for brand name rates; Litigation of a case against Kaiser Hospitals in California to stop Kaiser's practice of dispensing double dose pills and a pill splitter to its patients; Representing an anesthesiologist who refused to bill the government and supervise nurse practitioners while she was on-call and off the hospital grounds.

Most policyholders do not understand how the insurance industry works. This is especially true when an insurance company wrongfully denies payment of insurance benefits which are owed to an insured. Davis Levin Livingston has handled numerous insurance bad faith cases and achieved significant results on behalf of insurance policyholders.
