Law Firm Overview
Free Consultation
Davis, Saperstein & Salomon was established in 1981. Since then, the firm has concentrated on representing people rather than corporations. We represent individuals who have been injured from an accident, an act of negligence or a defective product. We have also represented people who were victims of medical malpractice. We are proud to have made a difference in the lives of the over 15,000 people or families whom we have had the privilege of representing. We like to think that our experience and legal talent helped achieve fair compensation to make up, in some way, for the loss they have suffered.
We take extra pride in both our professional and support staff. Our highly trained staff is committed to understanding the special needs of and the specific issues of their cases. They provide vital assistance in resolving each matter perform their work in behalf of our clients as part of a team. We consult with highly regarded and experienced and professional investigators, forensic photographers, and accident reconstruction experts, medical illustrators, and doctors, all of whom contribute to the successful resolution of cases.
We believe that we work for you. We prepare all cases to be ready to go to trial, indicating our commitment to pursuing fair compensation for injuries. Because of this preparation, few of our cases actually go to trial, as most insurance company defendants wish to avoid the expense and the publicity of a trial, especially one they might lose. But if they are unwilling to enter into a fair and acceptable settlement, we take the case to trial, letting a judge or jury decide the outcome. This approach has worked well since 1981. It would be our honor and privilege to represent you and your family.

Practice Areas Description
At Davis, Saperstein & Salomon, we offer legal services on the following areas of practice:- Personal Injury
Following an accident, the surest way to protect your right to obtain fair compensation is to secure the help of an experienced personal injury lawyer. At Davis, Saperstein & Salomon, P.C., we help people in New Jersey and New York, who have been injured because of negligence by another. Attorneys at our firm work to recover financial compensation for the pain and suffering, medical expenses, lost income and overall loss in quality of life our clients experience.
- Auto Accidents
Most serious car accident injuries require extensive medical treatment, including costly surgical procedures and rehabilitative care or physical therapy. Injuries may prevent victims from resuming work, maintaining their normal relationships with family members, and even performing basic functions of everyday life. For that reason, many car accident victims who have been seriously injured turn to legal action to recover damages, or compensation for their injuries.
- Trucking Accidents
Trucking accidents happen for a variety of reasons, including truck driver error, brake problems, speeding, driver fatigue, poor vehicle condition or overloaded vehicle, trucking company negligence, unfamiliar road conditions and unsafe road conditions. At risk truck driver behavior is a common cause of 18 wheeler accidents, semi-truck crashes, freight truck crashes and other tractor trailer accidents. Our firm has three decades of experience in investigating and representing persons who have been injured or killed in trucking collisions.
- Boating & Recreational Accidents
People boating on lakes of New Jersey including Lake Hopatcong or venturing onto the ski slopes of Mountain Creek do not expect accidents – they expect to have fun. Sadly, accidents occur all too often, with serious injuries or fatalities the frequent result. At the Teaneck, New Jersey, law firm of Davis, Saperstein & Salomon, P.C., our attorneys help people who have been injured or whose loved ones have been killed in recreational accidents. We develop strong cases for compensation for medical expenses, lost income, and pain and suffering for people injured by negligent behavior.
- Bus & Train Accidents
Mass transportation is presumed to be safe. Millions of people ride buses, trains, subways, and airplanes every day. When an accident occurs, many people can be injured or killed by one incident. At Davis, Saperstein & Salomon, P.C., we help victims of public transportation accidents. Our lawyers understand the applicable laws that apply in such cases, some of which are highly focused. For example, accidents to railroad workers are covered by FELA (Federal Employers Liability Act). The Federal Motor Carrier Safety Administration regulates passenger buses. The Federal Transit Administration covers subways and mass transit.
- Aviation Accidents
Our lawyers handle general aviation accident cases. Private plane accident cases can be complicated, requiring extensive knowledge of aviation law, pilot certification requirements, and product liability law. Our lawyers are well equipped in all these areas, bringing their extensive experience to their pursuit of claims arising from a plane crash. We offer the resources of our law firm and the dedication of our attorneys to people seeking compensation for their injuries or for the death of a loved one in an international or domestic airliner crash. We handle general aviation crashes as well as those involving helicopters, and commercial airliners.
- Motorcycle Accident
Each motorcycle accident presents a unique set of challenges. The case must be appropriately handled right from the beginning. Often the police report unfairly attributes a portion of the blame to the motorcyclist. Injured motorcycle riders are discriminated against because they do not have the benefit of Personal Injury Protection (PIP) benefits. Furthermore, if not properly educated by the trial attorney, a jury may conclude that a cyclist assumed the risk when he or she chose to ride a motorcycle.
- Catastrophic Injuries
Injuries resulting in a loss of a limb, paralysis, paraplegia, quadriplegia, brain injury or total disability are commonly called catastrophic injuries. Accident victims who suffer injuries so severe that their entire lives change permanently are often left with immense medical bills, lost wages, and financial instability. When an injury causes disability or other lifelong impairment of basic life functions, the entire family suffers. When those injuries are caused by negligence, legal action cannot undo the damage but it can help alleviate significant financial burdens.
- Wrongful Death Claims
Wrongful death cases can arise from nearly any kind of accident – if your loved one dies as the direct result of someone else’s negligence, then you may have grounds for a wrongful death claim. New Jersey law does not allow family members who have lost a loved one due to negligence to recover damages for grief. Because of this omission in our state’s law, qualified attorneys will examine a case involving wrongful death to determine the best way possible to obtain fair compensation.
- Drunk Driving Accidents
Our lawyers aggressively file lawsuits and claims against drunk drivers and their insurance companies to recover damages for their physical and emotional pain and suffering. In cases where the accident caused a fatality, our lawyers undertake wrongful death suits on behalf of surviving family and of the estate of the deceased. We know that no amount of money will truly compensate for the loss of your loved one. However, it will eliminate one source of stress – financial insecurity – so you can focus on rebuilding your family and your life.
- Birth Injury
There is nothing more tragic than a baby being injured at or immediately after birth. The birth of a child is normally a life changing experience for a parent; however the birth of a handicapped child requires major adjustment. When the illness or injury was caused by medical negligence during birth, parents often have nowhere to turn to find out what they can do. At Davis, Saperstein & Salomon, P.C., our lawyers have been helping families whose lives have been turned upside down by a catastrophic birth injury.
- Burn Injuries
The physical and emotional consequences of being in a fire are huge. The financial cost is equally large, as many fire victims require multiple skin grafts, plastic surgeries, and a lengthy hospital stay. At Davis, Saperstein & Salomon, P.C., our attorneys have been assisting clients since 1981 with claims for burn injuries. We help people receive compensation for injuries from fires, explosions, and chemical exposure. Recently, we have helped a client obtain a pre-trial settlement in excess of 7 million dollars for her burn related injuries.
- Traumatic Brain Injury (TBI)
An estimated 12,000 to 15,000 New Jersey residents suffer traumatic brain injury (TBI) each year, and about 1,000 of those injuries are fatal, according to the New Jersey Department of Health & Senior Services. Nearly 175,000 of the state’s residents suffer from TBI-related disabilities. Many of these serious head injuries occur on the job due to a vehicle accident, a fall or a blow to the head by a falling or flying object. At Davis, Saperstein & Salomon, P.C., our brain injury lawyers and our New Jersey workers’ compensation attorneys know that medical bills mount when a worker suffers traumatic brain injury.
- Animal Attacks and Dog Bites
At least one million people annually require medical treatment for a dog bite; many more go unreported. Dog bites can result in serious disfigurement and scarring, requiring reconstructive surgeries. Other consequences include nerve damage, blood loss, serious infections, rabies, and emotional trauma. When the victim is a child, the emotional damage can be as serious as the physical injuries, requiring extensive therapy. Our attorneys work hard to keep a child from being further traumatized by the legal process after a dog bite.
- Child Injury
Like adults, children suffer injuries due to the negligence of others. These injuries are frequently caused by unsafe recreational environment. Swimming pools, trampolines, monkey bars, ski lifts, and campgrounds can be dangerous environments for children if they are not adequately maintained. At Davis, Saperstein & Salomon, P.C., our lawyers have helped many parents whose children have been injured because of poor maintenance or faulty installation of recreational equipment.
- Spine and Back Injuries
Spinal cord injuries usually result in some degree of disability. Our attorneys have handled cases of paraplegia, quadriplegia, and other types of paralysis. We consult with a wide range of medical experts and other specialists to determine the impact of the injury on your life and on your family. We have in-house medical professionals who evaluate your case and monitor your medical treatment. We use our mock courtroom to make sure we have prepared a compelling case for our clients. We have used the Internet to allow clients who could not be moved to participate in their case.
- Medical Malpractice
Our New Jersey personal injury law firm features attorneys and staff that focus their practice entirely on medical malpractice cases. This means they have developed expertise in handling all types of medical negligence cases, including: Surgical errors; Birth injuries, including cerebral palsy cases; Emergency room negligence; Anesthesia errors; Brain injuries; Incorrect diagnosis; Medication errors; Prescription mistakes; Botched blood transfusions; Negligent amputations; Failure to treat a condition promptly; Hospital staff negligence; Surgical burns; Wrongful death.
- Nursing Home Abuse and Neglect
As the population of the United States ages, more and more people find themselves living in nursing homes and assisted living facilities. Many residents of these institutions are vulnerable-they are elderly, frail and often have cognitive problems caused by age and diseases such as Alzheimer’s. Nursing home residents often live far away from children or other loved ones, and have no one to monitor the care they receive. As such, they are frequently victims of abuse and negligence.
- Premises Liability
Often referred to as “slip and falls,” the cause of premises accidents due to negligence or misconduct by property owners may depend on a variety of issues. Slip and falls can result in such serious injuries as back injuries, head injuries and compound fractures due to a variety of property conditions: Accumulations of snow and ice; Defective stairways, railings and ramps; Potholes in parking lots or sidewalk deviations; Liquid or other foreign substances on floors; Poor or insufficient lighting; Falling debris or unsafe scaffolding; Unsecured store merchandise.
- Dangerous & Defective Products
In New Jersey, a manufacturer of a product is liable for injuries to a user of that product or machine. The Supreme Court of the State of New Jersey in the early 20th century established laws that made those manufacturers responsible for defects in their product. Whether the product or machine was used for business, work, or pleasure, it is your right as an injured victim to hold the manufacturer, wholesaler, or retailer responsible for the injuries their defective products have caused. We use our in-house courtroom to prepare cases, conducting focus group mock trials and videotaping depositions.
- Asbestos and Mesothelioma
For decades, thousands of workers were unknowingly exposed to asbestos, a hazardous material once commonly used for insulation at shipyards, factories, refineries and other industrial areas. Many workers have developed a highly malignant form of lung cancer called mesothelioma. The companies that owned or ran these toxic job sites are now accused of having known about the risks. Rare and slow to develop, there is no cure for mesothelioma caused by inhaling asbestos fibers released into the air by work site accidents, unsafe products and more. Victims suffer and their families are left devastated while those responsible continue to avoid liability.
- Workers’ Compensation
Major strides have been made to improve workplace health and safety. But no occupation in New Jersey is entirely free from accidents, injuries and illnesses. If you are a New Jersey worker who has become injured or ill on the job, you may be entitled to compensation in a workers’ compensation claim or a third-party liability claim. The money you recover can help you pay your medical bills and cover wages you have lost because of a temporary or permanent disability. Our New Jersey lawyers can review the facts of your case and help you to determine fault and available compensation for your work-related injury or illness
