- DUI

Being charged with a DUI can be a terrifying experience. First you're handcuffed, arrested and transported to jail. You're confronted with the decision of whether or not to submit to a breath test. You are told that your decision to cooperate or not could mean the loss of your license and ability to drive. While you are encountering unfamiliar legal issues, you are not entitled to a lawyer. Regardless of your decisions on the night of your DUI, you may spend the night in jail. Finally, you are faced with fines, penalties, and possible incarceration.

- Criminal Defense

Our team consists of a former prosecutor and an experienced criminal defense attorney. * Juvenile Crimes

The Juvenile Justice System is different than the regular criminal court system because the focus is on rehabilitating rather than punishing the criminal offender. In the majority of cases, an individual under the age of 18 facing pending criminal charges will be in the juvenile justice system. In a minority of serious cases, the State Attorney will bring the charges against the individual in adult criminal court, even though he or she may be under 18 years of age. While juvenile court has a focus on rehabilitation, the financial and incarcerative consequences of a juvenile conviction can have long lasting effects on the juvenile and his parent. A conviction for a juvenile offense may result in two types of sentences: probation or commitment to the Department of Juvenile Justice.

* Battery

Felony Battery occurs when an individual actually and intentionally strikes another person against their will; also, when they intentionally cause bodily harm on the individual. Battery can be a misdemeanor or a felony, depending on the severity of the crime. Aggravated Battery is knowingly or intentionally causing great harm, permanent disability, and permanent disfigurement or uses a deadly weapon.

* Assault

Assault is the unlawful threat by word or act to do a violent act to do a violent act to another person, when the person threatening has a reasonable ability to actually commit the acts. Assault is typically a misdemeanor. Aggravated Assault, however, is a threat with a deadly weapon without the intent to kill, or with the intent to commit a felony. This will typically be punishable as a third degree felony.

- Divorce and Family Law

* Child Support

Florida Statute 61.30 addresses child support guidelines. Both parents have the obligation to pay for and support minor children. All questions as to how much child support needs to be paid by the non-custodial parent starts with the statutory guidelines. While this is a starting point for discussions, a wide array of factors can adjust the actual amount paid upwards or downwards. Issues such as day-care, after school activities, and school activities is not in the child support guidelines, and must be addresses separately.

* Child Custody

Florida Statutes, Chapter 61.13 (3) outlines the rules and guidelines for child custody and visitation arrangements. All family cases with minor children must establish a “parenting plan”. This plan defines how the parents will share and be responsible for the daily tasks associated with the upbringing of the child, the time-sharing schedule arrangements that specify the time the child will spend with each parent, and which parent is responsible for health care and school related matters. Time-Sharing is Florida’s term for visitation schedule.

* Mediation

Mediation is the most common alternative way to resolve your case without having to take it to court. Mediation provides an opportunity to negotiate and settle the important issues in your divorce without having to put your case in the fate of the Judge. Mediation’s benefits include less cost, less time, and less stress in resolving your pending divorce matter, so you can move on with your life more quickly. Make every effort to avoid taking your case to court.
