Practice Areas Description
The Dolan Law Firm helps clients in all types of truck accidents including:- Auto Accidents
The roads and highways in the San Francisco Bay area are more congested than ever. Increased traffic, more heavyweight trucks on the road, and driver negligence are all factors which have contributed to an increase in auto accidents and traffic accident fatalities. If you have been injured in an auto accident in Northern California, the personal injury attorneys at The Dolan Law Firm can help you through the complicated insurance claims process and pursue compensation from the driver or entity that caused your accident and injuries.
- Conspicuity - Reflective Tape
Inadequate or insufficient reflectors can lead to a serious truck collision in California. Many auto to truck accidents in California occur at night, when a large tractor-trailer rig is pulling onto a road or backing into a driveway. If the tractor's headlights are directed toward the oncoming auto, it can create a "wall of glare" that conceals the fact that the trailer behind it is stretched dangerously across the dark road ahead. Notice in the photos below how the tractor-trailer big rig is dramatically more noticeable when the reflective tape is properly used.
- Defective Roadways
Was your car accident or truck accident at least partly caused by a defective roadway or dangerous highway? The Dolan Law Firm in San Francisco has handled dozens of cases against the California Department of Transportation (Cal Trans) and county and local governments for injuries and deaths caused by dangerous road conditions, defectively-designed highways, and poorly maintained streets.
- Emergency Vehicles Accidents
The California accident attorney with The Dolan Law Firm has handled many cases involving emergency vehicles. Emergency vehicles include vehicles such as fire engines, police cars, and ambulances. Although these types of emergency vehicles are not required to stop at all red lights, they are still required to operate safely. In order to qualify as an emergency vehicle, certain items must be met: It must be a verified emergency; A siren must be present; A red light should be visible from the front of the vehicle. If all three are not met, this is in violation of the vehicle code. The drivers do not have the right to operate the vehicle without reasonable care.
- Garbage Truck Accidents
During a recent study it was showed that on average, garbage trucks kill more pedestrians and cyclist per 100 million miles driven than any other vehicle on the road. Garbage trucks do not travel too many miles, spending the majority of time in neighborhoods — so the risk ratio is increased. Although certain provisions of the vehicle code do not apply to rubbish and garbage vehicles, they are not relieved of the duty to drive with care. For example, garbage trucks are allowed to drive on the opposite side of the road, but only if the front and rear turn signal lamps at each side are being flashed simultaneously.
- Log Hauler Trucks Accidents
Unlike other types of California big rigs and large trucks, log hauling trucks have special laws and codes that they must abide by. In California, log haulers: are not permitted on public roads on Saturday, Sundays, or on those days which are nationally designated legal holidays; log hauling on public road may be restricted or not permitted during commute in order to prevent a hazard to traffic flow, or during school or bus hours in order to prevent hazardous conditions that would endanger school children.
- Overloaded Trucks, Falling Debris Accidents
Many of the trucking accidents that occur throughout our California roads are as a result of an overloaded truck or because of debris that was not loaded properly. Items such as falling logs, pipes, and appliances can obviously be a serious road hazard to other vehicles on the road. More commonly, smaller items such as unsecured water coolers and garden tools can be just as hazardous.
- Override Truck Accidents
An override accident is one in which an eighteen wheeler "rides over" a car, motorcycle, or pedestrian. Override accidents in California typically occur when the front of a large truck crashes over the lower structures of a car. Therefore, there is a need for energy-absorbing and "lower to the road" frontal bumpers and overall design considerations to try to reduce the often lethal consequences of a massive truck colliding head on with a smaller passenger vehicle.
- Recreational Vehicle Accidents or Motor Home Accidents
With more and more people taking to the road, the number of recreational vehicles on our roads is increasing. Inexperienced drivers who operate oversized vehicles such as motor homes are a potential danger to other automobiles on our roads.
- SUV Rollovers
The propensity of sport utility vehicles (SUVs) to rollover first came to light in 1980 when CBS's 60 Minutes aired footage of an Insurance Institute of Highway Safety test in which a Jeep CJ rolled over while executing a "J" turn and during sudden quick turns. Since then the SUV has become one of the most popular vehicles in California and throughout the United States. Automakers have continued to disregard the safety of the public by ignoring SUV rollover problems. Drivers and passengers continue to die and be injured in SUV rollovers. According to the NHTSA 60 percent of SUV fatalities and 40 percent of SUV injuries are caused by rollover accidents.
- Tires - Blowouts - Treads
The Dolan Law Firm and their Bay Area truck accident attorneys understand that the condition of tires on trucks play a crucial role in the safety of our California Roads. Therefore, there are strict state laws in California that truckers and trucking companies must follow in regards to Tires.
- Tractor Trailer Brakes
The truck accident attorneys at The Dolan Law Firm represent people in the San Francisco Bay area and throughout California in personal injury and wrongful death actions against negligent or careless truck drivers and trucking companies. Many truck accidents stem from problems with the truck's air brakes, including improperly adjusted brakes, brake imbalance, brake malfunction, braking deficiencies and brake failure.
- Trailer Disconnect / Runaway Trailers
When a trailer disconnects from the cab of the truck, disaster is inevitable. California state law reads: "When trailed, truck and trailer combinations shall be connected with a safety strap or chain which shall be of sufficient strength to control the trailer in event of failure of the regular trailer hitch or coupling." According to the law, "Straps of 1/2 -inch plow steel or chains of ½-inch, high-test steel, with equivalent fittings, are considered adequate. Fitting shall be designed so that they cannot become accidentally unhooked.
- Transit Vehicles
Hundreds of people are seriously injured each year either by, or on, public transportation such as airplanes, charter buses, greyhound buses, Bart, muni, cable cars, ferries, excursion boats, and taxi cabs, elevators, movable walkways and escalators. The law refers to any individual or organization that charges to carry a passenger, or system or equipment that carries passengers as part of a business operation open to the public, as a Common Carrier. This includes elevators, escalators, ski lifts, airport shuttles, vanpools, stagecoaches, jitneys etc. These Common Carriers are required by law to use the highest degree of care and vigilance to ensure the safety of their passengers. They also are required under the law to provide vehicles that are safe and fit to transport passengers. This is a much higher duty than that required of a normal motorist, who is only required to use "reasonable care."
- Truck Driver Protection
Truck manufacturers and trucking transportation companies have an obligation to not only prevent injury to the general public including pedestrians and automobiles, but also have an obligation to ensure the safely of their employees and drivers. According to California state law: Trucks and truck tractors used to haul long steel structural members, poles, pipes, lumber, logs and similar materials shall be equipped with a barrier guard at the rear of the cab. It is designed to protect the truck driver employee from being crushed by shifting loads.
- Underride Truck Accidents
Current statistics show that hundreds of people throughout California are seriously injury or killed in rear underride collisions every year. A large vehicle traveling slowly on the highway poses a major risk to smaller vehicles observing the legal speed limit, especially at night. Perception of speed and distance can be negatively affected by many factors. Attorney Chris Dolan of The Dolan Law Firm has the experience and investigative skills necessary to identify all responsible parties and to extract just compensation for injured clients and their families. These types of accidents happen in a split second; the injuries, however, can last a lifetime.
