Law Firm Overview Free Consultation

The Dominion Law Group is an experienced, dedicated family law firm located in San Jose, California. We value excellence in providing legal services to our clients. Although we are a small firm, our experience and technology allow us to handle family law matters of all size, from the simplest uncontested divorce to the most complicated child custody and visitation agreement or property division issue. We handle family law matters in Santa Clara, San Mateo and Alameda Counties.

Although lead attorney Kevin Hutcheson has a background in litigation, he recognizes that clients are best served if a case can be resolved without litigation. We work closely with clients to find the legal strategy which works for them.

The Dominion Law Group has the experience and creativity to see a better way. While there is a standard solution for every situation that comes up in divorce, the creative solutions are infinite. We use common sense and the law to develop a fresh approach to difficult problems.

The traditional process of dissolving a marriage can make matters worse. For this reason, we often use collaborative law as the best way to resolve divorce and domestic partnership issues when both parties agree to use this innovative new method of conflict resolution.

Our lawyers work with our clients to help make the divorce process as painless as possible. We also work hand-in-hand with other professionals such as therapists and financial professionals to ensure that our clients and their children receive the best possible advice and all the help they need to complete this process.

We want you and your children to thrive as you move on with your lives. We balance excellence with cost-effectiveness, knowing that our efforts are a means to an end, not an end in themselves. Above all, we take pride in the results we achieve for our clients.

Practice Areas Description

The Dominion Law Group provides family law legal services in these areas:

- Divorce

A divorce can be simple or complicated. It can be uncontested or bitterly contested. If you are considering filing for divorce, or if your spouse has already filed, you should talk to a family law attorney as soon as possible. At the Dominion Law Group, we are experienced family law and divorce attorneys. When we talk about your situation, we will listen carefully to the circumstances you are in, your goals, and your hopes for the future. Then we will explain the divorce process and how we may be able to achieve your goals.

- Property Settlement

California is a community property state. Determining what is community property and what is separate property can be complicated, especially when a divorcing spouse owns real estate, a business, or stock options. We can provide guidance and advice designed to preserve your property and rights in cases involving complex property division.

- Child Custody

Since the 1980s, California courts have ordered joint custody of children unless there are compelling reasons not to. However, you could have joint custody of your children and still only see them once a month. As a practical matter, one parent will have custody and the other will have visitation, which is also known as parenting time. At the Dominion Law Group in San Jose, California, we believe that children should not suffer because you and your spouse are divorcing. Children need two parents. The sooner we end the conflict and reach a resolution, the better it will be, not just for you but for your children.

- Child Support

In California, the parent without custody is typically ordered to pay child support. The court may also order one party to pay a certain amount of spousal support (or alimony) each month. At the Dominion Law Group in San Jose, California, we can explain what factors are used to determine support. We can also assist you both in modifying or enforcing support payments after your divorce.

- Spousal Support

The Dominion Law Group represents clients in all aspects of spousal support, including negotiation, litigation, and modifications to spousal support. Spousal support, also known as alimony or spousal maintenance, is not always a part of a divorce stipulation. In divorces in which the agreement was negotiated by the parties' attorneys, the issue of spousal support is one of many issues to be negotiated as part of the overall settlement. In litigation, the issue of spousal support is determined by the judge. At the Dominion Law Group, we are experienced negotiators and litigators. Whatever your situation, we will represent you assertively. In matters involving spousal support, we always work to protect the rights and interests of the client.

- Domestic Violence

Many California divorces begin not with a petition for divorce, but with a restraining order and an allegation of domestic violence. Sometimes these allegations are made not because there is domestic violence, but simply to create an advantage for the party making the allegation. The Dominion Law Group represents victims of false allegations of domestic abuse. We also represent parties who are victims of real violence and abuse. In all domestic violence matters, we work to protect the rights and interests of our clients.

- Collaborative Divorce

The Dominion Law Group in San Jose California provides collaborative law services as an alternative to the time, expense, and painful nature of divorce litigation. With collaborative divorce, you are more likely to be satisfied with the outcome of your divorce because you will be directly involved in the negotiations. Issues such as child custody and visitation, property settlement, child support, and spousal support can all be resolved through collaborative law techniques.

- Domestic Partners

California's 2003 domestic partnership law provides substantially increased community property rights to same-sex couples and unmarried heterosexual couples over sixty-five who have registered as domestic partners. The partners will have the same community property rights as married couples unless they specifically opt-out of community property rights at the time they register. The Dominion Law Group, experienced family law attorneys, can explain the new law to you and provide advice regarding your rights and responsibilities under the California domestic partnership laws. We handle all of the legal aspects of the dissolution of domestic partnerships, including community property division, property settlement involving real estate, and child custody and visitation rights for same sex couples with children.

- Legal Separation

Few people understand what it means to be "legally separated" in California. Some people believe that a legal separation is an interim stage, prior to a complete divorce. Others will ask for a legal separation assuming that it is cheaper or involves less paperwork than a divorce. However, neither of these assumptions is true. In fact, there is very little practical difference between divorce and legal separation. At the Dominion Law Group, we are experienced divorce and legal separation lawyers. We can explain all of the issues surrounding these legal proceedings and your options. Our attorneys provide customized and unique solutions in family law to each client, given his or her particular circumstances.

- Post-Divorce Actions

If your current child custody or child support agreement no longer fits your circumstances, the Dominion Law Group in San Jose, California, can help you seek a modification of the agreement. Modifications in child support and some visitation matters are routine. We can often obtain these quickly and at reasonable expense. Depending on the circumstances, other types of modifications such as those involving child custody can become quite contentious and involve extensive legal work to resolve.
