Practice Areas

Practice Areas Description

- Mediation Arbitration and Trial Strategy

The Honorable James E. Rafferty (Retired) serves as of counsel to the firm and heads its Arbitration Mediation and Trial Strategy practice in Camden, Burlington and Gloucester Counties. With over 16 years of service on the bench, he retired as the Presiding Judge, General Equity for Gloucester, Cumberland and Salem Counties.

- Personal Injury

Being in an accident and suffering a personal injury can seem like a moment when control of your life was taken away. Depending on the severity of your injury, you may need the care of others for even simple tasks. You may be unable to work. Having your physical and financial independence threatened is bound to have a real impact.

- Estate Planning

Estate planning is often the final step that individuals and families take in protecting their assets, and is a step that is, unfortunately, frequently skipped. If you have not planned your estate, wish to change the provisions of your estate documents or arrangements, or have questions regarding estate planning, the law firm of Donnelly Ritigstein, LLC can help.

- Nonprofit Representation

A nonprofit organization differs from traditional business structure in that it is created to serve the public, not necessarily generate profits for its shareholders. Many religious organizations and public benefit corporations are organized under Internal Revenue Service code section 501(c)(3). This does not mean that a nonprofit cannot generate profits, but it is strictly limited under law as to what it can do with generated revenue.

- Business Transactional

If you own or manage a business, you are skilled, competent and experienced in managing an organization, strategizing business opportunities and adapting to an ever-changing economy and business climate.

- Business Sales and Purchase

When a major transaction is being considered, such as the purchase or sale of a business or significant asset or the merger of two businesses, the level of investment required to complete the transaction is likely to be significant enough to have an extremely detrimental effect on future transactions if not handled properly.

- Business Litigation

While business litigation and dispute resolution disputes can be regarded as a "cost of doing business," the costs are never welcomed and are difficult to plan for. Even businesses that intend to set aside funds to cover potential litigation costs are often unable to do so, due to other demands on company finances.

- Shareholder Litigation

As a minority shareholder or partner in a business venture, you have rights regarding how your involvement and your investment are treated. Those rights may derive from the bylaws, operating agreements or partnership agreements that were drafted while a business entity was being formed, they may originate in a relationship that creates a fiduciary duty, or your rights may stem from applicable laws or regulations.

- Business Planning and Start Up

There is always room for new businesses and business expansion by enterprising entrepreneurs and existing organizations. Donnelly Ritigstein, LLC can help with all the legal challenges relating to starting, planning, managing and growing your business in Southern New Jersey.

- Business Compliance

Successfully operating a business requires an ability to effectively balance a wide range of competing priorities. Genuine growth calls for an eye that is able to focus on increasing revenues. In order to achieve that focus, business leadership needs to be able to trust that other priorities are receiving the attention that they deserve.

- Commercial Collections and Asset Recovery

Lack of payment by negligent, careless or fraudulent debtors can deprive you of deserved and earned funds, and even jeopardize your personal and business finances. If you need legal help in pursuing your rights as a creditor, contact the law firm of Donnelly Ritigstein, LLC for assistance with commercial collections and asset recovery.

- Commercial Real Estate

Donnelly Ritigstein, LLC Law Offices, is skilled in helping firms and entrepreneurs navigate commercial real estate law. The firm is experienced at helping small- and medium-size businesses complete ownership and commercial lease transactions, reviewing property laws, land-use and compliance issues, and effectively managing lease, rental and other disputes.

- Business Succession Planning

Business succession planning is one of the most important, but often overlooked, components of estate planning. Business succession planning also puts you in control, so that your goals for your closely held company are reached.

- General Counsel

All businesses need the guidance of experienced counsel at various stages of their lifecycle. Some businesses take the approach of committing to maintaining inside counsel. Other businesses may try to proceed independent of any counsel.

- Franchisee Law

If you are thinking about establishing or buying into an existing franchise. Donnelly Ritigstein, LLC recommends you consult with an experienced franchise law lawyer.

- Estate Litigation

Brian Donnelly handled numerous litigated estates while serving as a lawyer and clerk for the Probate Judge for Gloucester, Salem and Cumberland Counties. Prior to founding his own firm, Mr. Donnelly worked as a litigator for a firm in Moorestown, New Jersey, and worked with complex financial instruments with a firm in Princeton, New Jersey. Donnelly Ritigstein, LLC Law Offices now provides experienced estate litigation legal services.

- Guardianships and Special Needs

Laws in place to protect the rights of special needs children and adults can be difficult to navigate, and can add to the challenge of providing care to special needs family members.

- Probate and Probate Administration

When a family loses a loved one, the deceased's estate will likely go through the county court's probate process to finalize the payment of outstanding debt and to distribute remaining assets. If you recently lost a loved one, an experienced probate lawyer can help your family resolve all outstanding issues regarding your loved one's estate quickly, efficiently and at a reasonable cost.

- Estate Tax

For many people, their estates represent much more than the simple accumulation of assets. Your estate may represent the accumulations of your efforts. It may represent a legacy that you wish to leave for the benefit of your loved ones. It may represent a way for you to help the next generation begin their lives from a better position.

- Intestate Succession

Have you had a relative pass without leaving behind a will to provide guidance regarding his or her estate? Dying without a will is referred to as intestacy. Similar to dealing with an estate where a will is present, someone must administer an intestate estate. Without the direction provided by a will, there may be disagreement among the relatives of the deceased regarding who will administer the estate.

- Charitable Giving

The decision to benefit a charity is always one in which multiple parties can benefit. The mission of the charity is furthered. The beneficiaries of the charity's efforts benefit. The benefactor of the charity knows that he or she has helped others.
