- Property Tax Appeals

In property tax appeals, you want to work with a lawyer who is intimately familiar with the unique administrative process, somebody who deals with the nuances of these cases on a regular basis. Attorney Tom Downey has served as counsel in a number of precedent-setting property tax cases, and he has worked closely with assessors, appraisers and public officials to draft legislation and procedural rules to streamline the tax appeal process.

- Abatements and Refunds

The abatement and refund remedy is available to a taxpayer who believes that his property "taxes have been levied erroneously or illegally, whether due to erroneous valuation for assessment, irregularity in levying, clerical error, or overvaluation…" The abatement process is often used to appeal tax assessments when the property owner has missed the deadline for the protesting the assessor's Notice of Valuation. In the abatement process, a property owner may file an abatement petition with the county to officially request either an abatement of taxes due or a refund of taxes paid.

- Commercial Property Tax

At our law firm, we are well known for our experience and knowledge in commercial property tax appeals. - Personal Property Tax

If you own a business, you are required to file a personal property declaration with the county every year. Failing to do this may likely cause the valuation of your business property to be inaccurate. In this situation the county assessor will assign a value based on the best information available, often resulting in a value much higher than the property's worth. If you need to appeal a personal property tax valuation, make sure you have an experienced property tax lawyer at your side. With more than 29 years of experience in property tax law, Tom Downey has worked with many elected local tax assessors and their staff appraisers. He is extremely knowledgeable in this specialized area of the law.

- Oil and Gas Taxes

If your company is an owner or an operator of any oil and gas leaseholds or lands, you are required to file a declaration with the county assessor on a prescribed form by April 15 of every year showing the number of barrels of oil or the quantity of gas measured, sold or transported from the property during the preceding year. Failing to file the required declaration timely may likely cause the valuation of your production to be inaccurate. In this situation the county assessor may impose a late filing penalty and will assign a value based on the best information available, often resulting in a value much higher than the actual production.

- State-Assessed Property Tax

State-assessed property valuations are appealed to the property tax administrator. If the property tax administrator denies your appeal, you can challenge that decision by appealing either to the Board of Assessment Appeals or to the Denver District court. - Overdue Property Taxes and Tax Sales

Failing to pay your property taxes may ultimately cause you to lose your property. Delinquent taxes are listed and noticed for a public sale. At the tax sale, members of the public can bid for the opportunity to purchase the tax lien on the property. The successful bidder pays the delinquent taxes, interest and fees and is issued a certificate of purchase. The holder of the certificate of purchase has special statutory rights including, among other things, the right to be paid interest and the right to apply for a Treasurer's Deed in accordance with specific statutory provisions. If you have failed to pay the real property taxes on your property, you need to take corrective action as soon as possible to avoid additional interest and potential loss of your property.
