Pre Litigation Early Mediation:
Experience shows that disputes in business (e.g. employment, contracts and construction) lend themselves to mediation when a threat of litigation looms. With the expenses of litigation very high and the uncertainties that accompany any court action, I urge clients to look at early mediation as an option. The commercial mediation service that I offer will try to help parties reach an agreement and avoid the courtroom.
Contractual Advice:
To avoid potential disputes, parties in a contractual realtionship must be aware of their contractual responsibilities and liabilities and the party who offered the contract must be sure that he has correctly detailed his requirements within the contract documents. John has drafted $ Multi Million USD contracts and dealt in tender negotiations on major infrastructure projects and with this experience he is available to offer preliminary advice in respect of any tender or contract that is being offered and can undertake a risk analysis for contractors during the bidding stage. John can also draft and review any and all contractual documents if requested.
Claims:
As a commercial litigation lawyer John can prepare, appraise, advise on the defence and negotiation of all claims on behalf of employers, contractors and subcontractors. John can offer advice on the avoidance and settlement of any and all disputes. John can also manage the submission of claims to either arbitration or litigation, he can assist in the appointment of lawyers in the relevant jurisdiction and the management of further submissions and proceedings.
Regional & International Services:
John is available to work throughout Thailand and in any region of SE Asia where the parties have agreed to Arbitration in the English Language under International Arbitration Rules. If required John can travel also to the Middle East, Europe or Australasia to assist parties.
Lectures and Training:
John is available to attend seminars and give lectures and training both on conflict resolution and how to avoid conflict through preplanning and effective contract negotiation.
