Practice Areas

Practice Areas Description

- Credit Reporting

The Fair Credit Reporting Act passed by U.S. Congress in 1970 gives consumers specific rights in dealing with consumer reporting agencies. Consumer reporting agencies and background check companies, including Equifax, Experian, and TransUnion keep records on how you pay your bills, whether you've been sued or arrested, and whether you have filed for bankruptcy. These records are easily accessed by creditors, potential employers, and banks.

- Credit Report Errors

We have successfully represented many consumers in cases against credit bureaus and the companies that supplied the inaccurate information to them. Using the Fair Credit Reporting Act and other consumer protection statutes, we have filed cases that have resulted in the credit bureaus removing inaccurate information, along with obtaining money damages for many of our clients. We may be able to recover money damages to compensate you for the harm caused by the credit reporting errors.

- Credit Reporting Rights

Many types of inaccurate information can show up on credit reports. The credit bureaus sometimes misreport information from public court records, such as reporting a judgment in your favor as a judgment against you. It may mistakenly report that a debt remains unpaid or was paid late, or that a debt was included in a bankruptcy when you did not file bankruptcy.

- Unfair Collection Practices

Consumer protection and class action lawyers at the law firm of Edelman, Combs, Latturner & Goodwin, LLC, welcome inquiries by phone or email from consumers and investors whose rights have been violated through illegal predatory lending, interest overcharges, "junk fees" on mortgages, wrongful foreclosure of mortgages, inaccurate credit reports, unfair debt collection practices, breach of warranty involving automobiles, and discrimination involving fair housing.

- Fair Debt Collection

The Fair Debt Collection Practices Act provides rules debt collectors must follow when attempting to collect a debt. Even if you have no actual injuries resulting from a debt collector's abusive conduct, the Fair Debt Collections Practices Act allows you to recover up to $1000 in damages if those rules are violated. Depending on the situation, you may also be able to obtain compensation for actual injuries.

- Unwanted Telemarketing Calls

The Telephone Consumer Protection Act (TCPA) of 1991 and other related laws regulate unwanted telemarketing calls, junk faxes and text messages. These laws make it illegal for advertisers to make calls using automatic telephone dialing systems or artificial or prerecorded voices to cell phones or to residential phone lines without the consent of the dialed parties. It also spells out regulations for sending faxes and text messages.

- Identity Theft

Identity theft takes numerous forms. Sometimes a complete stranger obtains your personal information and uses it to open credit accounts in your name. Sometimes a family member takes advantage of your personal information. In either case, dealing with damages caused by identity thief can be costly and frustrating.

- Background Checks

Many employers rely heavily on credit and criminal background checks to screen job applicants. Prospective employees, especially those with common names, often find that information reported about them by background check companies is inaccurate. Sometimes an individual who has never been arrested will have criminal convictions linked to his or her name due to the sloppy practices of a background check company.

- Debtors Rights

Debt buyers buy debts from other companies and then try to collect the debts themselves. Just because a debt buyer claims they are owed money from you in court or in a letter does not mean they are entitled to anything. Many of the debts they purchase are undocumented, beyond the statute of limitations or legally invalid.

- Consumer Rights

The lawyers at Edelman, Combs, Latturner & Goodwin, LLC, can help you put an end to the endless runaround many consumers face when attempting to solve a problem with their mortgage companies.

- Landlord Tenant

Tenants sometimes feel powerless when they have a problem with their landlord. The consumer protection attorneys of Edelman, Combs, Latturner & Goodwin, LLC are on your side. Unlike some other firms, we refuse to represent landlords in cases against tenants. Our consumer protection attorneys have an in-depth understanding of rental ordinances, such as the Chicago Residential Landlord Tenant Ordinance, and use this knowledge to our advantage in resolving disputes.
