Practice Areas Description
Ms. O’Sullivan is experienced in several areas of domestic matters, and has successfully represented clients in:- Divorce
Divorce isn’t easy for anyone. No matter how complex or straightforward the circumstances, we recognize that divorce proceedings must be handled with the greatest care, respect and privacy. Ms. O’Sullivan is skilled in mediation, litigation and collaborative divorce. If you’re considering filing for divorce and need legal representation in Will County or Grundy County, at our firm, your case will be given personalized attention from beginning to end so that you can rest assured that every possible measure is taken to protect your family, your assets and your peace of mind.
- Child Custody
Child custody cases can be quite thorny, and our firm knows all too well that in the most heated battles over children, no one truly wins. That’s why she has dedicated her practice to helping clients in Will County and Grundy County find sensible and fair solutions to child custody matters. Even in mutually agreeable custody arrangements, Erin O’Sullivan can provide legal counsel and helpful advice to accurately structure your child custody agreement. And when cases are not so straightforward, she can also step in as a legal intermediary to help defray some of the stress related to these types of disputes.
- Child Support
After a legal separation or divorce, child support is designed to cover the costs of raising a child (or children) until the age of 18. In the state of Illinois, child support is calculated by using a strict formula that stipulates a percentage of net income based on the number of children between the two parents. Sadly, some people will try to forge W-2 forms or misrepresent their income from self-employment, commissions or bonuses in order to get out of paying child support. Erin Webster O’Sullivan, P.C. is proficient at uncovering fraud and investigating income reports, bank statements and tax forms to discover discrepancies. She will analyze every factor of your case to ensure that you’re being treated fairly and that your children are getting all that they deserve.
- Post-Decree Divorce
Erin Webster O’Sullivan, P.C. has represented countless clients in matters of post-decree divorce agreements. Ms. O’Sullivan knows that your life is in a constant state of motion and is skilled at determining solutions to all types of traditional and non-traditional family law matters. For instance, if your ex-spouse has violated a prior court order (i.e. not showing up for visitation, not paying child support, endangering your child’s safety, etc.), you may need to amend your initial decree in order to reduce visitation rights, re-calculate support or change some part of the original order. Additionally, Ms. O’Sullivan can also assist you if you simply want to take legal action to enforce the original court order.
- Collaborative Law
Collaborative law is an innovative and integrative approach to divorce litigation. Instead of simply arguing one side against another, as traditional divorce cases tend to do, collaborative law seeks to provide clients with an alternative to court-determined outcomes. Although each party has legal representation, collaborative divorces are handled completely outside of the courtroom. Our firm is one of the few attorneys in Will County or Grundy County to offer collaborative legal services to her clients. She is a member of the International Academy of Collaborative Professionals as well as a certified ongoing fellow of the prestigious Collaborative Law Institute of Illinois. This membership provides her with extensive training as well as connections to a vast professional community that she uses to help her clients.
- Family Law Mediation
Mediation is a process used by lawyers and their clients to come to a mutual understanding in family law matters such as divorce, child custody, child support, maintenance and visitation. Often, mediation is used when there is a difference of opinion between two parents regarding the children’s well-being. Attorney Erin Webster O’Sullivan is a recommended referral mediation lawyer in Will County and Grundy County and has worked with numerous couples to come to satisfactory conclusions regarding division of property/assets, child support, child custody and more. She knows how to handle the high emotions involved in family law cases and is proficient at creating a neutral legal environment for both parties in order to facilitate successful mediations.
- Orders of Protection
In family law, orders of protection (often confused with restraining orders) are designed to prevent abusive former spouses or boyfriends/girlfriends from harming their former partners. Sadly, in divorce proceedings and particularly intense child custody cases, abuse allegations are all too common. Attorney Sullivan is a respected legal advocate for clients throughout Will County and Grundy County. She is skilled at providing legal advice to those who fear for their safety and the safety of their children. Orders of protection can prevent an abusive person from entering your personal property, from visiting your children at home or school, and from contacting you in any way to harass you.
- Parentage
Parentage legally determines the rightful parents of any child or multiple children. Unmarried couples in Will County and Grundy County in Illinois must file for a parentage judgment for mutual children after a separation. Establishing parentage is important for a number of reasons, including determining child support, child custody, visitation rights and legal custody. Our firm has handled parentage matters for both mothers and fathers in Illinois. Ms. O’Sullivan approaches every family law case with an open mind and heart. She has a stellar reputation among her clients as well as her peers as an excellent listener and an aggressive client advocate.
- Pre-Nuptial Agreements
The state law in Illinois is very clear regarding division of assets after divorce. If you dissolve a marriage, assets are divided (usually equally) between spouses. That’s why it pays to set plans in motion prior to marriage to ensure a sound financial future in case of divorce. Attorney Erin O’Sullivan understands that broaching this issue with a potential spouse isn’t always easy. Still, she is comfortable dealing with couples in these matters and advising future spouses as to the incentives of pre-nuptial agreements. Think of it as an insurance policy – you take care of it now, though you hope to never need it.
