Law Firm Overview

Feldman Shepherd Wohlgelernter Tanner Weinstock & Dodig LLP, since its inception, has recognized a special commitment to each and every one of the clients we serve. Following careful investigation of each new matter, all cases accepted, with rare exceptions, are promptly placed in litigation, based upon our experience that excellent results are the product of early and extensive trial preparation. Our practice is based upon the conviction that no client should have to wait longer than necessary to achieve a result. In our experience, hard work, attention to detail and creative approaches tailored to each individual case are the bedrock of every successful settlement or verdict.

At Feldman Shepherd, your case will be assigned to a team of lawyers and support staff, with each team member having a detailed and intimate understanding of the issues in your case. Weekly meetings of all Feldman Shepherd attorneys are also utilized to discuss case-specific issues and to identify strategies which will allow us to obtain the best possible result for each client. All necessary legal and medical research, together with consultation with highly regarded expert consultants, is undertaken by our lawyers, with litigation costs advanced by the firm. Because most of our cases are referred by other attorneys, the firm’s tradition of providing personal service and accommodating special needs extends not only to our clients, but to our referring counsel as well.

While our approach to reaching the desired objective will vary according to the unique facts and circumstances of each case, our mission remains the same: to obtain the best possible recovery, as expeditiously as possible.

Practice Areas Description

Our areas of practice include:

- Auto Accidents

Motor vehicle accidents can and do happen. Automobile accidents include all-terrain vehicles (ATVs), cars, boats, buses, large passenger vans, mass transit vehicles, motorcycles, school buses, and trucks. Feldman Shepherd attorneys represent accident victims who may include drivers, passengers, pedestrians, or cyclists who are injured as a result of someone else’s carelessness or recklessness.

- Auto Defects / Crashworthiness

Motor vehicle accidents triggered by auto defects, product defects, or road defects can and do happen. Defects can cause rollovers, car and van fires, and roof crushes. These accidents can be related to defective car parts and products, including airbags, child car seats, infant and baby safety seats and boosters, seat belt defects, roof collapses, seat back defects, glass defects, tire defects, auto fires, door latches, ejection, and brake defects, as well as road defects. Feldman Shepherd lawyers also handle a large number of cases where the vehicle is not “crashworthy,” which we call crashworthiness cases. We represent automobile-defect victims, including drivers, passengers, pedestrians, and cyclists who are injured as a result of someone else’s carelessness or recklessness.

- Civil Rights

Civil Rights Law is the area of law protecting those rights guaranteed by the Bill of Rights and the 13th and 14th Amendments to the Constitution, including the right to due process and equal treatment under the law of all people regarding enjoyment of life, liberty, property, and protection. The violation of an individual’s civil rights can and does happen. This can include employment discrimination, police discrimination such as wrongful arrest, the discrimination of inmates in prison, and other violations.

- Class Actions

A class action is a lawsuit in which a large number of people with similar legal claims join together in a group (the class) to sue someone, usually a company or organization. Common class actions involve cases in which a product has injured many people, where a company has wrongfully overcharged for a product or service, or in which a group of people has suffered discrimination at the hands of an organization.

- Construction & Workplace Accidents

No one expects to get hurt on the job, but workplace and construction site accidents can and do happen. Construction and employment-related injuries can include injury resulting from construction companies, businesses, and government agencies who neglected regulations and codes; injury from neglect of worker safety by a property owner, subcontractor, or contractor involved with your construction site; motor vehicle accidents in a company car or vehicle; and job site injury caused by a defective product. We represent job site accident victims, including drivers, passengers, employees, union workers, and consultants, who are injured as a result of a company’s or individual’s carelessness or recklessness.

- Consumer Protection

Every consumer deserves to be protected under the law; unfortunately, some businesses violate those laws. Consumer protection covers a wide range of topics, such as overcharging and excessive billing, price-gouging, product liability, privacy rights, unfair business practices, fraud, misrepresentation, health and wellness matters, home repairs, and other consumer/business interactions. Feldman Shepherd attorneys represent individuals who feel they have been a victim of an unfair business transaction or defective product.

- Defective Drugs

If a drug manufacturer learns of a potential serious side effect caused by its drug, it has a responsibility to notify the physicians who prescribe the drugs in order to protect the safety of the patients. If a drug manufacturer does not provide the proper notifications and patients are harmed by its drug, the harmed patients may be entitled to compensation. The lawyers of Feldman Shepherd have successfully handled many cases of negligence by large drug companies. They have successfully represented and obtained substantial compensation for a number of patients who have been harmed by drugs.

- Defective Medical Devices

A defective medical device poses a serious health risk to people requiring its use. Medical device defects leave patients at serious risk of incurring a debilitating injury or even death if the problem goes undetected. Problems associated with defective medical devices have included short-circuit and malfunction, leakage of the product, product-incurred injury during a procedure, suffocation, breakdown, and post-operative complications.

- Disability Insurance / Insurance Coverage Claims

You may have purchased an insurance policy to protect you and your loved ones from unforeseen accidents; unfortunately, though, some companies do not live up to their promise to protect you. Some forms of bad faith claims include denied coverage or denied claims, hidden fees, discrimination, insurance fraud, and coverage disputes on any policy purchased. Our attorneys can help you deal with your insurance company, as well as the insurer of the other party or parties. Insurance companies have lawyers working hard to minimize their payouts; you need a lawyer who will work just as hard for you.

- Insurance Bad Faith

When an insurance company wrongfully denies payment of insurance benefits or delays payment of an insurance claim, this is known as bad faith—a violation of the insurance company's obligation of good faith. Bad faith claims can involve automobile insurance claims, liability insurance claims, medical payment benefit insurance claims, and personal injury protection insurance claims. We represent insureds who were treated unfairly or in an untimely manner because of their insurance company’s bad faith.

- Liquor Liability

There is a responsibility associated with being able to legally consume alcohol, and there is an even bigger responsibility for establishments serving the alcohol. In most states the stores, restaurants, and other businesses that provide beverages and/or liquor as a service or commodity are required to carry liquor liability insurance. In addition to making claims against such sellers under those insurance policies, customers can take legal action against the establishment from which they purchased and/or consumed alcohol if the establishment provided liquor in a way that did not follow mandatory age restrictions, it employed improperly trained staff, or it provided liquor to individuals who were intoxicated enough to be a danger to themselves and other patrons. We represent any individual who may have been affected by negligent alcohol consumption.

- Medical Malpractice

Feldman Shepherd is proud of the reputation it has earned in the handling of medical malpractice cases. In this complex field, medical expertise is as important as an understanding of the unique legal principles applicable to malpractice claims. Doctors and hospitals can and do make medical and medication errors. The lawyers of Feldman Shepherd have distinguished themselves in litigation involving the following areas: Anesthesia errors; ARDS – Acute Respiratory Distress Syndrome; Birth trauma and birth injuries, including birth hypoxia, brain-damaged infants, kernicterus, spina bifida, and cerebral palsy; Dental errors; Diagnosis delay, misdiagnosis, or failure to diagnose; Doctor and hospital mistakes and infections; Emergency room negligence; Obstetrical and gynecological malpractice; Orthopedic malpractice; Plastic Surgery; and Surgical mistakes.

- Nursing Home Abuse

Feldman Shepherd is proud of the reputation it has earned in the handling of nursing home negligence cases. In this complex field, knowledge of proper care and facility management are as important as an understanding of the unique legal principles applicable to nursing home claims. When a loved one can no longer take care of him- or herself, a nursing home is usually a safe and supportive solution to care for their medical needs; unfortunately, not all facilities take proper care of their patients. Our attorneys can help you understand the signs of nursing home neglect. Knowing the warning signs of abuse is a first step toward protecting elderly friends or relatives.

- Personal Injury

Any individual can sustain a personal injury at any given time. A personal injury is a physical or psychological injury that occurs to a person as the result of an accident or medical malpractice. The most common types of personal injuries result from traffic accidents, workplace accidents, slip and fall accidents, assaults, accidents in the home, and defective-product accidents. We represent individual victims of accidents or medical malpractice that resulted in serious injuries.

- Premises Liability

At any time or place, you could potentially face an injury. Supermarkets, sidewalks, parking lots and ramps, amusement rides, elevators, escalators, swimming pools, stadiums, shopping malls, hotels and motels, and bars and restaurants all pose threatening injuries. When an accident or injury occurs to a visitor or tenant renting another person's property, the owner of the property may be legally responsible if it can be proven that the owner's negligence led to the injury. Premises liability claims include slip and fall injuries, falling objects, dog bites, tripping hazards, toxic substances, and inadequate security.

- Product Liability

When you purchase or use a product of any kind, you expect the product to function properly; this may not always be the case, and you may have incurred injuries from various product defects. Some forms of product defects include the design, manufacturing, or marketing of dangerous items, as well as many ordinary household items such as home electronics, baby products, medicines, and even furniture. The attorneys of Feldman Shepherd represent individuals or groups who have sustained injuries from a dangerous product and who may be entitled to compensation from the product’s manufacturer, the product’s wholesaler, or the retailer who ultimately sold the product.

- Professional Negligence

Feldman Shepherd attorneys handle legal and other professional malpractice cases on behalf of our clients. We accept and vigorously litigate meritorious claims against attorneys and other professionals who have failed to properly serve their clients. There are many types of professionals who can and do make serious mistakes. They include: Accountants; Architects, interior designers, and engineers; Attorneys and lawyers; Barbers and cosmetologists; Pharmacists; Therapists, psychologists, and psychiatrists. Our success in this highly specialized area of the law has resulted in significant recoveries for innocent victims of professional neglect.

- Qui Tam / Whistleblowers

The False Claims Act, 31 U.S.C. Section 3729 et seq., allows private individuals to bring a qui tam action against another who had defrauded the federal government by knowingly presenting a false claim for payment. The Act has specific requirements a whistleblower (known as the “relator”) must follow in order to recover. The Act also limits who is eligible to file suit, how much he (or she) can recover, and under what circumstances. If a relator was involved in the false claims, the court has the discretion to limit his recovery and he will not recover at all if he is convicted of criminal conduct related to the suit.

- Sexual Abuse / Sexual Assault

Our lawyers have stood up for victims in Pennsylvania of such heinous abuse, and we have experience litigating claims against schools and universities who failed in their obligations to protect children and young adults. What many victims do not know is that a law passed in 2002 allows victims of sexual abuse 12 years from the time they turn 18 to file a civil suit against their abuser for forced or coerced sexual activity. This means that victims have until the age of 30 to file a Pennsylvania sexual abuse or sexual assault case. If you and other individuals believe you have been injured as a result of a sexual assault or sexual abuse, If you and other individuals believe you have been injured as a result of a sexual assault or sexual abuse, we can help.

- Toxic Substances

There are many toxic substances that can cause serious and potentially deadly consequences to anyone exposed. Toxic substances include fumigants, chemicals, and dangerous gases, to name just a few. We represent employees, union workers, and other individuals who have been unknowingly exposed to toxic substances. Some of the more common toxic substances include: Asbestos; Benzene; Environmental toxins; Industrial solvents; Lead-based paint; MTBE; Pesticides; Toxic mold.
