Fiol & Gomez, P.A., is prepared to stand up for your rights and pursue the money damages you legally deserve if you've been injured or have lost a loved one due to someone else's negligence. We offer free consultations, and if you decide to hire our firm, we will not charge you any fees or costs unless we are able to help you recover compensation for your injuries.

Our two partners, Alex Fiol and Leo Gomez, founded the Tampa personal injury law firm of Fiol & Gomez, P.A. in 2002. Previously, both were partners in one of the largest personal injury and workers' compensation law firms in Florida. As a smaller personal injury law firm, we are now able to provide personal attention to each of our clients. In addition to Mr. Fiol and Mr. Gomez, our team also includes associate attorney Frank Marsalisi, four paralegals - including a nurse paralegal - and three secretaries. Each of our employees is dedicated to maximum customer satisfaction.

We are a bilingual law office serving clients in both English and Spanish. Our main office is located near the courthouse in downtown Tampa, easily accessible by public transportation and major area highways with free parking. We also have a secondary office in New York. We have staff members available to answer phones 24 hours a day, seven days a week. When necessary, we can travel to meet with clients who cannot come to our office, and we can also meet on evenings and weekends.

Practice Areas Description

The attorneys at the law firm of Fiol & Gomez are prepared to handle personal injury cases that include but are not limited to:

- Personal Injury

If you have been injured due to the negligence of another party or as the result of a motor vehicle accident, dealing with the aftermath is not easy. It may be difficult to know where to go for help. You may be legally entitled to compensation after an accident, but how can you pursue that compensation and how does the process of filing a personal injury claim work? At the Tampa law firm of Fiol & Gomez, our personal injury lawyers have years of experience helping accident victims throughout Central Florida, including St. Petersburg, Jacksonville and Orlando. We have handled a wide range of accident cases and can provide you with honest answers, helpful advice and dedicated personal attention. At our firm, you pay no fees or costs unless we help you recover money damages for your injuries.

- Motor Vehicle Accidents

After an injury caused by a car, truck or other automobile, talk with us about your rights. Ask questions about your insurance policy and what benefits you may be able to receive after an accident. If you've been injured in any type of motor vehicle accident, you may have already been approached by the other driver's insurance company and asked to sign something or give a statement. These people are not looking out for your interests, and are actually seeking to limit their responsibility to pay you for your injuries.

- Bicycle & Pedestrian Accidents

Pedestrians and bicycles in Florida enjoy the same rights on the road as motor vehicles. Unfortunately, due to their lack of protection, pedestrians and bicyclists are also at a much higher risk of injury in those accidents. In the worst cases, these accidents can result in wrongful deaths, and families are left to deal with the devastating loss and financial burden. At the Tampa law firm of Fiol & Gomez, we believe that pedestrians and bicycles deserve protection under the law and pursue compensation for medical bills, lost wages, pain and suffering and other expenses in Florida.

- Drunk Driving Accidents

Drunk drivers are a menace to everyone else on the road. For that reason, they are held particularly culpable under Florida law when they cause car accidents. Sometimes, that means that the victims of drunk driving accidents caused by driving under the influence (DUI) - also known as driving while intoxicated (DWI) - are entitled to higher damages.

- Uninsured & Underinsured Motorists

Uninsured and underinsured motorist (UI/UIM) coverage can play a crucial role if you have been injured in a car accident and someone without adequate insurance was at fault. At the law firm of Fiol & Gomez in Tampa, we help clients pursue uninsured and underinsured motorist claims against their insurance companies throughout Central Florida including St. Petersburg, Orlando, and Palm Bay.

- Car Accident Insurance

After a car accident in Florida, one of the most important aspects for any victim to understand is car accident insurance and what benefits may be available given the policy of the other driver and/or your own policy. Since policies are often confusing, and insurance companies are more concerned about limiting their liability than helping customers understand the language in those policies. It is important to speak with an attorney who can answer all of your questions. At the Tampa law firm of Fiol & Gomez, our auto accident lawyers can explain your coverage and advise you on what options you have to recover compensation for medical bills and property damage.

- Texting and Cell Phone Related Accidents

While there are no laws against texting while driving or cell phone use in the car, it is clear that when a driver's attention is on the screen of a phone instead of the road, the potential for accidents is much greater. This activity is common among teenage drivers but is also popular among other segments of the population as cell phone use has become more widespread. This type of negligence may happen frequently, but that is no excuse and no comfort for when that negligence leads to serious accidents and injuries. We work with accident reconstructionists and other experts in order to pursue the compensation that our clients deserve from those who were responsible for their injuries.

- Premises Liability

If you've been injured in a slip and fall accident, assaulted in a building lacking property security, or injured because of the negligence of a property owner, you may be entitled to compensation under the legal theory of premises liability. At the law firm of Fiol & Gomez in Tampa, Florida, our lawyers have extensive experience representing clients in premises liability cases

- Medical Malpractice

If you have been seriously injured due to hospital or doctor negligence, or if you have lost a loved one during a medical procedure, you may be entitled to compensation for your pain and suffering as well as your economic losses under Florida medical malpractice law. Medical malpractice occurs when doctors, nurses and other medical professionals fail to follow the standards of their professions, causing physical injuries and/or economic harm to their patients. Common types of medical malpractice include but are not limited to: Surgical errors; Failure to diagnose cancer; Devices left inside patients; Infections caused by unsanitary procedures; Lack of informed consent for dangerous procedures.

- Workers' Compensation

If you have been injured in any type of workplace accident in Florida - no matter who was at fault for your injuries - you are most likely entitled to workers' compensation to cover your medical expenses, partial lost wages, and any long-term consequences of your injuries. The workers' compensation system covers all types of workplace injuries. Some of the most common types of accidents in our region are: Construction accidents; Delivery truck accidents; Amusement park accidents; Factory accidents; Warehouse accidents; Orange harvest accidents.

- Construction Accidents

There are many different types of accidents that can occur on construction sites, often causing serious injuries with long-term consequences. Among the most common types of construction accidents are: Falls from scaffolds; Falls during roofing projects; Excessive lifting incidents; Electrical burns; Machinery accidents. The workers' compensation system exists to provide medical care, partial lost wages and other benefits to people injured in workplace accidents, including construction accidents. You are entitled to workers' compensation whether you are a full-time employee or a temporary employee. Your immigration status is not relevant either.

- Nursing Home Abuse & Neglect

Nursing homes must follow a number of procedures in order to provide adequate care and attention to their residents. When nursing homes fail to do so out of abuse or neglect, their actions can cause serious and potentially fatal injuries such as: Pressure sores, also known as bed sores or decubitus ulcers; Fractures and other fall injuries; Dehydration and malnutrition; Infections caused by unsanitary conditions.

- Spinal Cord Injuries

Any sudden trauma, from a car accident to a bad fall, has the potential to cause serious spinal cord injuries that can leave victims paralyzed. If you or a loved one has suffered a spinal cord injury, you may be wondering where to turn for help. The lawyers at our firm work with credible experts such as medical doctors, vocational rehabilitation specialists, and economists as well as our own nurse paralegal to determine the expected lifetime impact of our clients' spinal cord injuries.

- Brain Injuries

Any car accident or other serious accident can result in a brain injury, and any brain injury can leave a victim with significant long-term consequences. Memory loss, loss of motor function and changes in behavior can all accompany a brain injury in addition to the possibility of paralysis and death. Medical treatment for brain injuries can be extensive and can last throughout the lifetime of the accident victims.

- Reflex Sympathetic Dystrophy (RSD)

The condition known as Reflex Sympathetic Dystrophy (RSD), also known as "Complex Regional Pain Syndrome," creates significant pain in arms, hands, legs and feet of people without known causes, which is poorly understood by the medical community. In many cases, RSD occurs after an accident and injury that does not directly damage the affected body part. As a result of RSD, medical treatment can be costly and compensation is important to exhaust every option of care.

- Wrongful Death

Under Florida wrongful death law, if a close family member has been killed in any type of accident, you may be entitled to bring a lawsuit against the responsible person or people. For most types of fatalities, the deceased person's spouse, children and dependents are entitled to bring wrongful death claims. Only spouses and children 24 years of age or younger can recover non-economic damages for medical malpractice fatalities. A wrongful death claim can allow you to: Hold the responsible party publicly accountable; Prevent similar losses from happening to other families; Obtain financial compensation for past medical expenses, pain and suffering, the loss of support and companionship. In some cases, the investigation process involved in a lawsuit may be the best way for you to find out exactly how your loved one was killed.

- Social Security Disability

For people who have been injured, sick and disabled, Social Security Disability may be a helpful source of benefits that can help people through the recovery process. Unfortunately, Social Security Disability law is complex with many confusing and frustrating rules and regulations. Finding the answers you need and getting the benefits you deserve is not easy, and it is important to work with an experienced attorney who can guide you through the process.
