- Division of Property and Debts

Determining what is marital or joint property and what is separate property can be complex. It is best to work with an experienced family law attorney to ensure your rights are protected. Franklin Family Law, LLC, provides knowledgeable divorce representation focused on reaching an amicable solution that meets the needs of all parties. We have experience with high-asset couples and small-business owners as well as couples with more modest incomes.

- Maintenance/Spousal Support

At Franklin Family Law, LLC, our goal is to help clients come to an agreement on spousal support. Attorney Michael Franklin will explain your options and the pros and cons of each. Divorce litigation is an expensive process, and the longer a couple fights over spousal support or any issue, the greater the final cost. If you would rather take your case to court, however, we will be able and willing to do so.

- Parenting Time

Parenting time, or custody and visitation, is determined by what is in the best interests of the child. In most cases, it is best if parents work together to determine what arrangement will be most beneficial for the child, rather than focusing on their own needs. Decision-making for the child is typically shared between the parents.

If possible, reaching an agreement about parenting time is better for all parties. When families are able to create a schedule that meets their needs, there is less animosity and more cooperation. However, when parents are not able to agree on a parenting time schedule, a family law judge will make the decision. Because the judge does not know the family, his or her decision may not be the best for everyone.

- Decision-Making for the Child

In Colorado, family court determines parenting time and decision-making by what is in the best interests of the child. Typically, parents will share parenting time and decision-making responsibilities. If they are unable to reach an agreement, a judge will decide how to allocate these responsibilities.

Families generally work better when parents create a parenting plan that is unique to their family's needs. They may get help from their lawyers, mediators or parenting experts to write the parenting plan. At Franklin Family Law, LLC, we have experience creating parenting plans. We strive to help families write plans that make sense for them and are in the best interests of their children.

- Child Support

At Franklin Family Law, LLC, we understand that finances are hard to discuss and that after a divorce, both parties may feel as if they do not have enough money. Because the court usually follows a formula to calculate child support, it is generally not cost-effective for parents to prolong litigation by arguing over child support. Attorney Michael Franklin can ensure that your child's rights are protected and that you pay or receive the appropriate amount of support.
