Practice Areas Description

Friedman Rodman & Frank focuses its practice exclusively in the following areas:

- Personal Injury

A personal injury is one in which the negligence or the irresponsible behavior of another causes you to suffer serious physical disability, mental impairment or financial harm. When you are injured in a personal injury accident, regaining your health may be difficult. If your injuries are catastrophic, such as a brain injury, spinal cord injury, burn injury or the loss of one or more of your arms or legs, you may need rehabilitation or assistive care for the rest of your life. Because serious injuries prevent you from working, the loss of income and the astronomical medical bills further add to the distress with which you and your family must cope.

- Wrongful Death

Simply put, a wrongful death is a death caused by the fault of another. For most people, the death of a loved one is one of the most difficult things they will face in a lifetime, no matter what the circumstances. Such a tragedy is one of greater anguish for you and your family if the negligence or irresponsible behavior of another caused the death. A wrongful death may be the result of a drunk driving accident, a boating accident, nursing home negligence, medical errors, a dangerous drug, a defective product or unsafe conditions in the workplace, or in a building or other structure.

- Car Accidents

Millions of car accidents occur each year, causing many serious injuries, deaths, and resulting in billions of dollars in property damage. In 2006, the National Highway Safety and Transportation Administration (NHSTA) reported that 2.5 million motorists and non-motorists alike were injured in traffic accidents and that over 42,000 people died in these accidents.

- Medical Malpractice

Each day, thousands of patients receive medical treatment in doctors’ offices, clinics and hospitals, as well as assisted living centers, nursing homes and a variety of institutional settings. When you turn to a doctor, nurse or other medical practitioner, you place your trust and confidence in them based on their knowledge and training; and you have the right to expect a certain standard of care. The sad truth is, doctors, nurses, technicians and pharmacists make mistakes. Some examples of common medical errors are:
misdiagnosis, delayed diagnosis, surgical errors, anesthetics error, birth injury, wrong medication, wrong dosage of medication, incorrect procedures and emergency room negligence.

- Workers Compensation

All states have a workers' compensation program designed to protect employees injured on the job. Florida law requires employers with four or more employees to have an insurance policy for work-related injuries, and the employer pays the premium at no cost to the employee. If workers are injured on the job, the insurance coverage provides payments for medical care and lost wages due to the injury. Workers compensation benefits available to you may include:

* Lump-Sum Tax Free Settlements
* Medical Expenses
* Payment for lost wages
* Physical rehabilitation and training
* Death benefits for a spouse and surviving dependents

- Products Liability

Product liability law deals with the liability of a product's manufacturer, supplier or seller, if a product defect causes a malfunction or does not perform as a reasonable person would expect and causes harm to the person who used the product. Product defects fall into three basic categories: design defects, insufficient instructions or warnings regarding usage, and manufacturing defects.

- Longshore & Harbor Worker Injury

Longshoremen, also referred to as dockworkers or harbor workers, load, and unload cargo from ships. Stevedoring companies contract the work, hire longshoremen and are responsible for both cargo and worker safety. Moving cargo between ship and dock where containers are stacked requires longshoremen to perform several tasks, many of which can be hazardous. Winch operators run machines similar to cranes, other dockworkers place slings securely around cargo containers and other workers repair ropes, rigging and gears, and ensure that all equipment is in working order.

- Premises Liability

Premises liability refers to a type of personal injury. If you are injured or if someone you love dies as a result of someone's failure to maintain premises, you may be able to file a lawsuit to recover damages you suffered. Property owners are legally responsible for ensuring that guests and the general public are safe while on their property. When injuries occur as a result of unexpectedly dangerous conditions, owners may be liable. Examples of situations for which property owners may be held accountable include:

* Slippery and wet conditions on walkways
* Poorly maintained sidewalks, stairs, carpeting
* Defective or inadequate lighting
* Lack of security in dangerous areas
* Poorly maintained landscaping, thick underbrush, fallen trees
* Failure to post hazardous condition warnings
* Toxic chemicals
* Toxic Mold
* Lead poisoning
* Improperly maintained or defective equipment
* Failure to post "guard dogs on the property" warnings

- Nursing Home Negligence

When caregivers at nursing homes, assisted living centers, and extended healthcare institutions subject those under their care to abuse or neglect, the caregivers and the nursing homes may be held liable for personal injury and wrongful death. Abuse and neglect are not always easy to recognize and are frequently covered up by nursing home staff. If a family member or friend is in a nursing home or assisted living center, it is important to always be on the lookout for signs of neglect and abuse.
Examples of nursing home negligence and abuse includes, but is not limited to:

* Medication and Prescription Errors
* Falls, Dislocations, and Fractures
* Physical, Emotional, and Psychological Abuse
* Inappropriate Use of Physical Restraints
* Dehydration and Malnutrition
* Bedsores and Infections
* Financial Abuse and Exploitation
* Negligent Supervision
