- Personal Injury

Personal injury law is an area of the law which is also known as tort law. A tort is a harmful act (or failure to act) which often results in a physical injury to the victim. The basic principal of tort law is that an innocent victim should be compensated for his or her losses by the person responsible. In Florida, certain types of incidents can be both a tort and a crime. When such conduct occurs, the state will evaluate whether to prosecute the wrongdoer for the crime. Whether or not the state prosecutes the criminal action does not affect your right to pursue the civil action.

- Auto Accidents

Every year in Florida there are thousands automobile accidents, many of which result in serious injury or death. Because of the complexities of insurance law and the potential loss of valuable evidence, it is extremely important that you take immediate action to protect your right to be compensated for your losses. When the Florida no-fault insurance system was enacted in 1972, it was supposed to lower state-wide auto insurance premiums. Unfortunately premiums have steadily risen since then. In exchange for the claimed reduction in premiums, limitations on the right to sue for injuries received in an automobile accident were imposed.

- Wrongful Death

If a person dies as a result of someone’s actions or failure to act, the victim’s survivors and estate may bring a lawsuit for wrongful death. Survivors are usually the decedent’s spouse, children or, in certain circumstances, their parents. The survivors may have a right to recover for the loss of the decedent’s support, services, companionship, protection and, in certain cases, pain and suffering. Florida Statutes Section 768.16-768.26 sets forth what is known as the Wrongful Death Act. According to this act, a personal representative of the decedent has the ability to recover damages that would be owed to the decedent if he or she were living. The personal representative can recover when the death is caused by a wrongful act, negligence, default or breach of contract or warranty of any person, including those occurring of navigable waters.

- Medical Malpractice

You have a right to receive competent medical care. The bringing of a medical negligence claim in the State of Florida is an extremely complicated matter with numerous hurdles to overcome. To be successful in your claim you must prove that the health care provider was negligent and that the negligence caused you injury. We may ask you to provide a written summary of the basis of your claim. We will immediately review the facts relating to your medical care to determine whether there is a potentially valid claim for medical negligence.

- Motorcycle Accidents

Due to the vulnerability of a motorcycle a Florida rider is much more likely to be seriously injured in even the slightest accident with any type of vehicle. Without the protection of a steel cage or airbags, the severity of these injuries is likely to be catastrophic and could even result in death of the rider. These injuries can occur even when the rider operates his or her bike with the utmost concern for safe riding. This is due in part to the decreased visibility of a motorcycle with only two wheels and less lighting than even the smallest of automobiles.

Many publicly and privately owned establishments such as airports, nightclubs, schools, and parking lots, have not only the responsibility but also the obligation to abide by the established standards of safety. Whether this is a slip and fall injury do to poorly maintained flooring surfaces, a physical harm due to negligently security, or even an attack from a known dangerous dog. Owners and landlords are responsible for providing secure and safe conditions whether you may be a customer, tenant, or employee.
