Law Firm Overview Free Consultation

At the law firm of Gingold & Gingold LLC, we offer the services of some of the most experienced bankruptcy attorneys in Georgia. Attorney Ira D. Gingold has been a bankruptcy lawyer and Court-appointed Bankruptcy Trustee since 1971. Attorney Jamie L. Gingold has an extensive background in real estate and business law that makes a critical difference in almost every bankruptcy case we handle.

At Gingold & Gingold LLC, you will always meet with an attorney. In addition, we have an excellent support staff to assist you. Everyone on our team has at least 20 years of experience with Chapter 7 and Chapter 13 bankruptcy law. If you are struggling to meet your mortgage payments, pay your car loan or pay other bills, we can help you get control of your financial situation. Our clients are people who have fallen on hard times because of family illness, job loss, reduced work hours or divorce.

A Chapter 7 or Chapter 13 proceeding can help you deal with high medical bills or unmanageable credit card debt. We can help you stop harassing calls and letters and put an end to legal proceedings such as foreclosures, repossessions, garnishments and creditor lawsuits. We know that there is life after bankruptcy; we see it happen every day.

Practice Areas

Practice Areas Description

- Chapter 7 Bankruptcy

In a Chapter 7 bankruptcy proceeding, you can permanently discharge, or wipe out, some debts. Other debts such as tax obligations, student loan payments and child support arrearages cannot be wiped out in a Chapter 7 proceeding, but can be dealt with through a Chapter 13. Certain assets, including a principal residence and vehicle, can be kept in the bankruptcy proceeding. We will carefully monitor all proceedings to ensure that you are able to keep all property that you want. We handle the most challenging bankruptcy cases; if you own a business or have a high income, we can advise you about your opportunities.

- Chapter 13 Bankruptcy

In a Chapter 13 proceeding, we set up new payment arrangements for you to pay your creditors. When you file, an automatic stay goes into effect, prohibiting your creditors from calling or writing you to collect the debt, or using legal actions such as lawsuits, foreclosure or car repossession. We will help you put together a monthly repayment plan that you can afford. A Chapter 13 can help you keep your home and car, putting an end to foreclosure and repossession actions. You can also use a Chapter 13 proceeding to deal with tax debt and past due child support.

- Creditor Harassment

When you are struggling to pay your bills, it can be easy to promise a lot of small payments to different creditors or finance companies. When they all start calling, your life can be miserable. A personal bankruptcy filing under Chapter 7 or Chapter 13 can put an end to these calls, preventing creditors from trying to collect a debt. The automatic stay goes into effect as soon as we submit your bankruptcy petition. At the law offices of Gingold & Gingold LLC, we will show you how to avoid creditor calls. We will help you solve your financial problems, either by eliminating debt in Chapter 7 or by reducing your monthly payments in Chapter 13.

- Foreclosure

Under the bankruptcy laws, once you file a petition, an automatic stay goes into effect. Under the automatic stay, your creditors, including mortgage lenders, cannot call, write or take legal action against you. The automatic stay prohibits the lender from starting a foreclosure action and stops any proceedings that have already begun. At Gingold & Gingold LLC, we have a comprehensive understanding of mortgage foreclosure laws and how bankruptcy can stop foreclosure proceedings. We will help you, whether you seek to discharge, or wipe out, debts under Chapter 7 or repay your debts under Chapter 13.

- Repossession

When you are struggling to pay your bills, you can easily feel overwhelmed when creditors come at you from every direction. The automatic stay gives you the break you need to get your financial affairs in order. Under the automatic stay, your creditors must immediately stop any efforts to collect a debt. This includes attempts to repossess your car or other personal property. Have you fallen behind on payments for your car loan or loans for other personal property? Has the lender called or written threatening repossession? Personal bankruptcy can help you stop repossession efforts immediately.

- Wage Garnishment

Do you have a judgment against you for an unpaid debt? Are you afraid that your bank account may be garnished to satisfy the judgment? Is your employer garnishing your wages with each paycheck? A personal bankruptcy filing will stop any legal action against you, preventing creditors from taking money from your paycheck or your bank account. Known as the automatic stay, this aspect of filing bankruptcy gives people immediate relief from garnishments.

- Credit Card Debt

At Gingold & Gingold LLC, we know how easy it can be to get in over your head with credit card debt. We don't make judgments about how it happened; our only concern is how to help you get it under control. We know the credit card collection laws and how to protect your interests. Because credit card debt is unsecured, you can permanently discharge it, or wipe it out, through a Chapter 7 filing. We will prepare and file all the documents necessary to complete the process. We will also be there to represent you in court. With a Chapter 13 filing you may pay back some or even none of your credit card debt. We will help you put together a repayment plan that you can afford and that will make your high credit card interest stop.

- Student Loans

If you have substantial student loan obligations that you cannot pay, you may have considered personal bankruptcy filing. Student loans, like tax obligations, cannot be discharged. However, you do have opportunities that can significantly improve your financial situation and make it easier to pay your student loans. You want to work with an experienced bankruptcy attorney, one who has helped others in similar circumstances.

- Medical Bills

If you are overwhelmed by medical bills from a long hospital stay, ongoing outpatient treatment or any other type of medical provider, a personal bankruptcy filing can help you get a fresh start. You want an experienced bankruptcy attorney to help you determine the best course of action, one who has worked successfully with others whose medical bills have become impossible to pay.

- Bankruptcy / Divorce

If you are involved in or considering divorce, you may also be thinking about filing bankruptcy. You may be wondering what will happen if your ex-spouse files bankruptcy. Will a bankruptcy filing be in your best interests? If so, when should you file? If your ex-spouse files bankruptcy, will you be responsible for all the debts of the marriage? You want an experienced and knowledgeable attorney to help you understand your opportunities and help you protect your future.
