Practice Areas Description
GoldenbergLaw, PLLC is a national personal injury law firm with a Minnesota address. We represent clients with the following types of injuries:- Auto & Truck Accidents
Auto, commercial truck, motorcycle and other types of motor vehicle accidents are the most common source of personal injury lawsuits. People who have been injured in an auto accident, SUV rollover, semi truck or motorcycle accident, or if they were a pedestrian struck by an automobile, you may be entitled to an accident claim or compensation.
- Motorcycle Accidents
Motorcycle accidents often occur because car or truck drivers fail to see motorcyclists to their right, left, or in their blind spot. As a result, car drivers don't always signal when changing lanes or look to their right or left carefully when passing someone or proceeding through an intersection. Our attorneys work with accident reconstruction experts in determining the cause of a motorcycle accident. Since car and truck drivers, as well as their insurers, often try and blame motorcyclists for accidents, it's important to investigate what happened to determine who was responsible.
- Product Liability
Manufacturers have a duty to create products that are safe when used correctly, as well as when used incorrectly but in a way that the manufacturer should have foreseen. If you have been injured through the use of an unsafe or defective product, both state and federal laws provide that you can sue the manufacturer, distributor and/or retailer of the product for compensation for your injuries.
- Workers Compensation
If you have been injured at work or on-the-job in Minnesota, you are entitled to workers’ compensation benefits (sometimes called workers’ comp or workman's comp). The workers' compensation system's purpose is to minimize the impact of work-related injuries or illnesses on workers and employers. The benefits are paid by the employer’s insurance company, and the system is administered by the Minnesota Department of Labor & Industry, Workers’ Compensation Division.
- Medical Malpractice
Doctors, nurses and medical facilities have a duty to adhere to the proper standard of care when diagnosing and treating injury and disease. If you have been harmed by a medical professional negligently failing to adhere to the proper standard of care, you are entitled to compensation for your medical bills, lost wages, and for pain and suffering.
- Wrongful Death
If you have lost a loved one as a result of another person’s negligence, carelessness or recklessness, you are entitled to be compensated by the responsible party or their insurance company. At GoldenbergLaw, PLLC, our goal is to obtain a measure of justice for the heartbreak of losing a family member. With care and concern, we counsel our clients on the options available to them and guide them through the legal process. Our lawyers have achieved multimillion dollar lawsuit settlements for our clients.
- Dog Bites & Premises Liability
Property owners have a duty to provide a reasonably safe environment for people who come onto their property. Similarly, dog owners have a responsibility to control their pets so they do not injure someone by biting them, on or off the dog owner’s property. If you have been injured by slipping or falling on unsafe property, or if you have suffered a dog bite injury, you are entitled to compensation from the responsible party or their insurance.
- Construction Accidents
If you have been injured in a construction site accident, you are entitled to workers’ compensation benefits. These benefits include compensation for lost wages, medical expenses, as well as temporary or permanent disability that results from your work injury. If the injury is the caused by a third party such as a contractor or an equipment manufacturer, you may file a personal injury lawsuit against the third party.
- Machine Injury
Manufacturing, industrial, and construction work sites are governed by OSHA requirements and other safety regulations. The use of machines and heavy equipment means certain training, procedures, and safety measures should be in place to protect workers. At the law office of GoldenbergLaw, PLLC, our attorneys investigate accidents that involve heavy equipment and machines, including exposed moving machine parts, OSHA violations, poorly maintained equipment, and malfunctioning machine parts. Working with engineers and safety experts, we expose negligence on the part of employers, as well as machine and equipment defects that result in serious injury to our clients.
- Electrocution / Burn Injury
Injuries involving burns and electrocution often require extensive medical treatment and recovery time. Third degree burn victims may require months of skin grafts, pain medication, and reconstructive surgery, resulting in substantial medical costs, months away from work, and potentially permanent disability. At the office of GoldenbergLaw, PLLC, our lawyers consult medical economists and life care planners in determining the financial impact of a burn injury or electrocution. In cases involving negligence on the part of an employer or third party contractor, we investigate what happened in order to uncover safety violations the cause of a fire or electrocution.
- Toxic Torts
Exposure to heavy metals, carcinogens, and toxic chemicals can create significant short and long-term health problems, even death. Employers, apartment owners, and retailers who expose people to toxic materials can be held liable for injuries that occur as a result. At the law office of GoldenbergLaw, PLLC, our attorneys work with lab specialists, medical experts, and toxicologists in investigating the causes of our clients' injuries and health problems.
- Easy-Bake Ovens / Toys Injuries
Easy-Bake Ovens sold since May 2006 have been recalled by the U.S. Consumer Product Safety Commission and Hasbro due to serious child safety concerns. The recalled toys pose a significant danger to children because the traditional heating bulb was replaced with an electric element that can become as hot as a conventional oven. Additionally, the slot leading into the baking area has a "trap door" effect that can cause a child's hand to become lodged in the oven, causing severe burns. Several children have been injured due to these defectively designed Easy-Bake Ovens.
- Dangerous & Defective Drugs
If you or a loved one has suffered cardiovascular problems, stroke, heart attack, or death after taking the prescription drugs Bextra, Celebrex, or Vioxx; serious side effects after taking Fosamax, Ortho Evra, or Viagra; or corneal infection after using Bausch & Lomb's ReNu with MoistureLoc®, you may be entitled to compensation from the pharmaceutical company that made the drug.
- Defective Medical Devices
Goldenberg & Johnson is located in the same city as the cardiac units of the three largest manufacturers of pacemakers and defibrillators: Guidant, Medtronic, and St. Jude. This makes Minnesota one of your jurisdiction choices for a lawsuit involving defective and recalled pacemakers and defibrillators manufactured by one of these companies.
- Insurance Law
We are experienced in all aspects of insurance law including no-fault, underinsured motorist, uninsured motorist, disability, fire, life, commercial and residential insurance coverage. This also includes litigating long term disability policies from carriers such as Unum, Provident, and Paul Revere.
- Federal Employers Liability Act (FELA)
We are familiar with the issues that arise in claims involving railroad workers of various crafts, dockworkers and maritime injuries.
- Other Claims
We have handled many claims involving injuries from dogs and other animals, commercial actions, assault and battery cases, First Amendment right to privacy cases and private R.I.C.O. actions.
