- Family-Based Green Cards

U.S. lawful permanent resident status ("green card") provides a foreign citizen the privilege of permanently living and working in the United States. Generally, anyone who seeks U.S. permanent residence must have a family member or employer as a petitioner-sponsor.

- Employment-Based Green Cards

Most employment-based immigrants are sponsored by an employer that has extended a job offer. The Department of Homeland Security ("DHS")/United States Citizenship and Immigration Services ("USCIS") Adjudicates the petition. If the employer petition is approved the beneficiary intending immigrant process to permanent resident ("green card"), generally, in one of two ways depending on whether s/he is in the United States in lawful status or is in a foreign country.

- Work Visas-Temporary Nonimmigrant

A citizen of a foreign country applying for entry into the United States generally must first obtain a visa, either a nonimmigrant visa for temporary stay, or an immigrant visa for permanent residence. The type of visa is defined by immigration law, and relates to the purpose of the travel.

Nonimmigrant visas are for international travelers, (citizens of other countries), coming to the U.S. temporarily. International travelers come to the U.S. for a wide variety of reasons, including tourism, business, medical treatment and certain types of temporary work.

- Physicians, IMGs and Health Care Workers

Foreign physicians have several options for coming temporarily or permanently to the United States. Physicians may come to the U.S. for a variety of purposes: to participate in medical conferences, perform research, engage in a medical training programs and residencies, teach courses, or to practice medicine.

Doctors who are seeking employment in the United States should explore all of their immigration options and understand the consequences of their choices. Planning should begin even before the completion of medical school, to ensure completion of all of the testing and license requirements. A qualified immigration attorney can advise foreign physicians to help navigate the complicated process of obtaining employment in the United States.

- Employing Foreign Nationals

There are three broad classes of foreign nationals allowed to work in the U.S:

1. Foreign nationals authorized to work incident to their immigration status, without restriction as to the nature or location of employment, but who in some instances may be required to first obtain an employment authorization document (EAD);
2. Foreign nationals permitted to work for a specific employer incident to their status, without obtaining and EAD; and,
3. Foreign nationals eligible for employment authorization, but who must first obtain an Employment Authorization Document ("EAD") from DHS/USCIS.

The various classes of foreign nationals who have employment authorization in the U.S. do not follow the same procedure to obtain the authorization, nor do they receive the same documents to establish authorization.

- Citizenship
