Practice Areas Description
- Personal InjuryPersonal injury (tort) cases are usually due to negligence — the action or lack of action by another party that leads to an injury. Common types of negligence allegations include: motor vehicle accidents; medical mistakes/malpractice; wrongful death; work related injuries; premises liability; dangerous / defective products; slip-and-fall injuries; police brutality and civil rights violations; libel, slander and defamation of character; nursing home abuse / neglect; truck accidents; and dog bites.
- Motor Vehicle Accidents
Most of us have seen people who are driving while texting, talking on the phone, eating, writing, performing personal hygiene/grooming, and interacting with pets and/or passengers. While most of the actions listed are not illegal, Maryland enacted legislation that prohibits drivers from texting or talking without a hands-free device. Due to the size and weight of tractor-trailers, accidents with these big rigs tend to cause more serious injuries than car crashes. Some trucking companies try to site defective roadways and/or defective truck parts as reasons for the accident. Our skilled attorneys have significant accident experience and can establish who is at fault and how much they should pay. If you have been seriously injured in a wreck with a tractor-trailer, car or motorcycle, you need an experienced lawyer who can properly evaluate your accident to determine what kind of claim you may have and who should be held responsible.
- Medical Malpractice
Medical treatments that result in serious injuries or death can be difficult cases to prosecute because medical malpractice and wrongful death can be difficult to prove. Sometimes, people hesitate to contact lawyers because they aren't sure if other parties were at fault, and they don't want to cause problems for medical providers. Many illnesses can be cured if medical treatment is provided in a proper and timely manner. Catastrophic injuries or deaths can occur if medical treatment is not timely provided or is inappropriate. Medical malpractice and wrongful death can also be due to medication errors and/or health care services performed by doctors, nurses, hospitals, clinics, nursing homes, pharmacists and other medical professionals. Additional causes involve improper type/amount of medication, surgical instruments left in the body, anesthesia errors, cosmetic surgery failures / disfiguration and faulty surgical devices, such as the Sulzer hip implant. The Maryland wrongful death attorneys at Greenberg Law Offices have extensive experience scrutinizing medical records, lab reports and consulting with experts in the health care field to prove these complicated cases.
- Police Brutality
Sometimes, people feel an attorney is an unnecessary expense if they have a video or witnesses to support their claims of assault by law enforcement officers. Victims are usually unaware that Maryland has very strict guidelines that must be followed precisely to avoid dismissal of their police brutality cases. Our attorneys have thorough knowledge of important guidelines and deadlines that will affect your case of police brutality. It can be extremely difficult for victims of police misconduct to get justice. Sometimes, witnesses to the incident fear coming forward, and the physical signs of police brutality may disappear by the trial date. Even though the physical wounds may heal, emotional trauma, such as PTSD, can continue indefinitely. Cases of excessive force frequently occur at: sobriety checkpoints; traffic stops; areas in and around the Power Plant bars and restaurants; university sports events and celebrations; and protest and demonstration gatherings / marches.
- Workers' Compensation
If you have been hurt in the Maryland or Eastern Shore area on the job, or in a job-related activity, you probably qualify for workers' compensation benefits. Each state has different workers' compensation rules to handle claims from employees who suffer on-the job injuries. Our attorneys have comprehensive experience in this complex area of the law. This is essential because your injury may require future treatments, prevent you from resuming normal activities and/or result in the loss of your job. Most injured workers who are unable to return to work following their accident do not know how to get wage replacement benefits started promptly. Our dedicated staff will do that for you. A work injury could lead to depression, PTSD or other emotional trauma that damages a personal relationship. Our skilled attorneys carefully evaluate every case to identify such situations so they can be factored into a settlement.
- Criminal Defense
Criminal defense trial lawyers Mitch and Larry Greenberg have extensive experience working in the State's Attorney's Office as prosecutors and that unique insight ensures they can defend against the tactics used by the opposition. The entire team of legal professionals at Greenberg Law Offices is very experienced, and they have a thorough understanding of all state and federal laws. Fast and fair resolution of your case is our goal, but if necessary, we will go to trial and bring in veteran investigators and subject matter experts who can provide essential testimony. The Maryland violent crime defense lawyers at Greenberg Law Offices begin every case with the goal of restoring our clients' lives to normal. We have successfully helped thousands of people facing charges for drug crimes, domestic violence and a wide variety of additional legal issues.
- DUI / DWI
If you have been charged with driving under the influence, it is very important that you contact our Baltimore drunk driving defense lawyers as soon as possible for a free initial consultation. If you retain our services, we will immediately put our experienced DUI lawyers to work analyzing all evidence related to your case. If you took a roadside sobriety test, it may be invalid and, therefore, inadmissible in court. The difference between a DUI/DWI is significant. DUI charges are levied against drivers with a blood-alcohol content (BAC) of .08 or higher and could lead to a one-year jail sentence. DUIs carry higher fines and longer license suspensions than DWIs. DWI charges are for drivers with BACs of less than .08 but who are still considered to be impaired. The maximum jail sentence for a DWI is two months. In Maryland, refusing a breath test may result in a $500 fine and two additional months' jail time. It can also influence a judge's opinion when considering your case.
- Drug Charges
At the Greenberg Law Offices, our attorneys have significant experience defending people against drug-related offenses. Possible drug crimes include: drug distribution, drug manufacturing, drug possession, drug trafficking, and prescription fraud. The drugs themselves can involve many different things, such as "bathtub meth," crack cocaine, marijuana, powder cocaine, crystal meth, methamphetamines, "ice," and heroin along with prescription drugs like hydrocodone, codeine, oxycodone, morphine, OxyContin, barbiturates, benzodiazepines, dextroamphetamine, methylphenidate, and other commercially manufactured opiates, depressants, and stimulants. When appropriate, our attorneys also handle pre-indictment drug crime investigations. Through our various law enforcement contacts, we can represent individuals charged with and not yet indicted for drug offenses and, when desired, help our clients cooperate with law enforcement in exchange for favorable treatment.
- Family Law / Divorce
Our comprehensive legal representation includes referrals to trusted legal and business professionals who can help with the multitude of issues that often arise during family law proceedings, such as valuation of businesses, investments, pensions, real estate and other personal property. Our network includes immigration experts, financial management professionals, therapists and family counselors and lawyers who can help you amend wills, trusts and other estate products. For more than 45 years, our attorneys and legal professionals have been helping people along Maryland's Eastern Shore with a wide range of family law matters, such as: divorce, child custody / visitation, child support, equitable division of property and debt, paternity, life insurance beneficiaries, alimony / spousal support, separation, prenuptial agreements, decree modifications and domestic violence.
- Special Education Law
Greenberg Law represents families to ensure that their children with special needs receive a free, appropriate public education (FAPE). Often this means going to a due process hearing in order to force the schools to comply with the federal and state protections afforded children with special needs. Parents frequently do not know what their children's rights are in terms of the education and services offered by the schools, and they frequently feel intimidated by school staff during case conference committee meetings and feel that they have little input into the child's Individualized Education Plan (IEP). Greenberg Law can help ensure that your child succeeds in school, regardless of how poor his education has been so far, or how little the school seems to want to help.
- Veterans' Benefits
Medals are awarded to our veterans, and festive parades are held in honor of their dedication to protecting the rights and freedom of every U.S. citizen. But there are countless cases of war veterans who have been denied their right to collect the disability benefits they are entitled to. The VA has cited lack of resources as the reason for the problems, but regardless of the cause, the problem is still the same: lack of compensation for the disabled men and women who served the country. If your veteran's disability claim has been denied or delayed, contact us. One of our Baltimore VA benefits lawyers will promptly return your call and answer your questions. If you retain our services, we will create a game plan and start fighting for the benefits you deserve.
