* False Claims Act & Whistleblower Cases
Under the False Claims Act, individuals who have knowledge of fraud on the United States or state governments can sue on behalf of the government in qui tam cases. Whistleblowers who pursue such claims are awarded a percentage of monies recovered by the government – up to 30% in some circumstances. We are a nationally recognized leader in false claims litigation. In 2004, our case set the record for the largest False Claims Act recovery in which the federal government did not intervene.
* Director & Officer Liability
We have successfully prosecuted cases against former officers and directors of companies whose wrongful actions led to or expanded corporate insolvency. These include cases where the former officers and directors looted the corporation, improperly entered transactions for their own personal benefit, diverted corporate opportunities, or performed their duties in bad faith. Although, numerous legal doctrines provide broad protection for corporate directors against claims for breach of duty, we have had great success in recovering substantial settlements from faithless officers and directors.
* Securities Fraud
We have handled these claims in many different contexts, and know when state, federal or common law remedies will provide our clients with the speediest and most complete recovery. We have helped all types of clients who have been deceived or misled, including mutual funds who were not told key facts when they purchased a private college’s revenue bonds; private investors who were betrayed by their financial advisers; banks that were deceived by reports of fictitious collateral; and businesses that were sold phony tax shelters.
* Bankruptcy Litigation
Our lawyers have frequently been retained by bankruptcy trustees and liquidating trusts to pursue difficult claims for the benefit of insolvent estates’ creditors. These cases include complex avoidance actions, such as fraudulent transfers that appeared to be arms length transactions and unwinding restructuring transactions that disguised the improper repayment of antecedent debt. We have also frequently been retained to prosecute claims that belonged to the insolvent debtor pre-petition, such as breach of fiduciary duty claims against officers, directors or controlling shareholders.
* Professional Malpractice
We have been a leader in the field of professional malpractice, handling claims for legal malpractice, accounting malpractice and professional misconduct by financial advisors. We have handled cases in which lawyers ignored their duties to a corporate client and permitted business deals to go forward that favored their own interests and those of the company’s principal shareholder; claims where lawyers failed to inform their clients of the true cost and risk of expensive litigation that only benefited the law firm; and cases in which tax accountants abused their client’s trust by selling abusive and highly lucrative tax shelters.
* Copyright Infringement
Copyright law is a specialized discipline that is not frequently litigated outside of media centers such as New York and Los Angeles. We are one of only a small number of firms in New England that has this capability. We have represented well-known rock stars whose compositions were improperly copied or sampled. We have also protected the rights of songwriters and other content creators who were not properly credited for their work or whose intellectual property rights were improperly transferred.
* Close Corp. /Freeze Outs
The rights and obligations of shareholders in non-public corporations may be considerably different than those in public companies. In some states, including Massachusetts, shareholders in a close corporation may owe fiduciary duties to each other. Our attorneys have experience in litigating close corporations disputes including freeze-outs, diversions of corporate opportunity and failure to disclose corporate benefits or contracts. We have represented corporations seeking the return of ill-gotten benefits and minority shareholders seeking to have their interests acquired at a fair price.
* Insurance/Bad Faith
Oftentimes, it is impossible to resolve a dispute that should be settled until difficult insurance coverage issues are resolved. When coverage clarification will assist our client, we will initiate coverage litigation, sometimes at no additional cost to the client. We have been able to resolve our clients’ claims on favorable terms once we demonstrated to the insurer that coverage exists. We also represent individuals in insurance coverage litigation, successfully demonstrating how insurers often refuse to pay contractual benefits such as disability payments as part of a larger bad faith scheme to avoid paying valid claims.

* General Liability and Auto Collisions
Greene, LLP represents individuals injured by unreasonably dangerous conditions existing on public and private property and injuries resulting from negligent operation of motor vehicles, trucks and aircraft.
Examples of cases we have successfully handled include: serious burn injuries and death caused from a motor club’s negligent failure to respond to a stranded motorist in a timely manner; death caused by the negligent operation of an 18-wheeler; death resulting from the negligent service of alcohol to an intoxicated customer; the largest settlement or verdict resulting from the crash of an American Airlines aircraft.
* Industrial and Construction Site Accidents
Industrial and Construction Site Accident cases are frequently difficult because when many persons are working on a complex project, it is difficult to reconstruct events and determine responsibility for unsafe conditions. Despite these difficulties, we have particular expertise representing workers injured in residential, commercial and industrial site accidents. We have successfully handled cases involving scaffolding and staging collapses, wall and roof collapses, falls through unprotected floor openings, construction elevator and material lift accidents, electrocutions, and other cases which resulted from violations of industry standards and government safety codes.
* Medical Malpractice
Greene, LLP represents patients who have been injured by negligence of doctors and other health care providers. Such errors can arise through the misdiagnosis of serious conditions such as cancer, obstetrical mistakes that cause cerebral palsy and other birth defects, surgical errors, and other breaches of the standard of care that cause serious injury or death. Some of the cases we have handled in this area include physicians who have: misdiagnosed colon cancer; failed to monitor and treat fetal distress; negligently performed surgery to restore vision; negligently performed cardiac surgery, which resulted in death; and negligently performed spinal surgery.
* Product Liability
Greene, LLP has represented numerous workers and consumers who were injured by dangerous and defective products. Successful cases we have handled include: defectively designed scaffolding that caused multiple organ damage and the permanent impairment of a mason; the defective window retention system in a Volkswagen bus that caused the ejection and death of a young high school student; a defective “mini-spare” tire that caused a young mother’s death; a commercial furnace explosion that resulted in a factory worker receiving third degree burns; and the defective manufacture of a die cast machine that subsequently blinded its operator in an explosion.
* Wrongful Death
Cases where a loved one has been killed due to the fault of someone else are often the most contentious. Defendants naturally resist acknowledging that their carelessness caused a death. Success is also difficult because the plaintiffs’ most important witness, the victim, cannot testify. Sometimes surviving eyewitnesses may be able to describe what happened, but many times the lawyer must tell the victim’s story through the physical evidence and qualified experts. Moreover, effectively presenting the magnitude of the survivors’ loss to a jury is not easy for the clients or their counsel.
