Practice Areas

Practice Areas Description

- Divorce

Under Virginia law, it takes at least six months to obtain a divorce, if the divorce is uncontested, the spouses have a written settlement agreement, and have no children. In divorce cases where the spouses cannot agree on all the terms of the divorce decree, the process can take up to a year or more.

- Child Custody

At the Nova Family Law Group, one of our primary areas of practice is representing parents involved in high-conflict child custody disputes.

Our lead attorneys have significant legal experience and bring a skilled focus on litigating family law cases in and around Fairfax and Northern Virginia. We are a division of the well-established and AV-rated* law firm of Hale Carlson Baumgartner, PLC.

- Child Support

One of the basic principles of Virginia's divorce laws is that a parent's financial responsibility for a child does not end just because the parents decide to divorce. Some amount of monthly child support is almost always included in a Virginia divorce decree.

- Division of Marital Property

Along with questions about child custody, conflicts about the division of assets and debts during a divorce are extremely common. Working to reach a successful resolution of disputes about marital property division requires a comprehensive review of each family's circumstances, as well as well-developed negotiating skills.

- Modifications and Enforcement

Like any court order or formal contract, a divorce decree, support order, or custody order are binding on both parties. If either spouse or parent fails to follow the terms of the divorce decree or applicable court order, the other spouse or parent may begin a formal enforcement action — asking a judge to order the non-complying spouse to abide by the terms of the order.

- Military Divorce

When members of the military go through a divorce or face other family law issues, they — and their families — have unique needs that civilians do not face. We understand that the missions of military service members carry stresses and challenges unknown to most of civilian society.

- Children With Special Needs

A child with special needs relies greatly on his or her parents for the support necessary to develop, learn and fight medical problems. When the parents of a special needs child decide to divorce, it is critically important that the divorce agreement make strong and enforceable provisions for the safety and continued care of a special needs child.

- Child Abuse and Neglect Cases

The family law attorneys at the Nova Family Law Group, located in Fairfax, focus our practice on representing clients involved in contentious and high-conflict divorces.

Divorce cases in which one spouse alleges that the other spouse has committed physical or sexual abuse of the child are among the most complex and emotional cases to handle.
