Divorce

Child Custody

Every parent and child involved in a divorce is concerned about the impact of temporary and final custody and visitation decrees on their relationships and the welfare of the children. Children need to know that their parents will still be there after the divorce, and need answers to their questions about home, school, and family finances. The Virginia courts recognize joint custody, sole custody, and shared custody. Child Support

The Code of Virginia sets guidelines which determine child support obligations, taking into consideration each parent’s income, health insurance, day care, the time the child spends with each parent, support obligation for other children, alimony, and possibly other factors. Support calculations are not necessarily easy; you need a skilled attorney to analyze any complexities that warrant consideration. In addition, Virginia courts may deviate from the guidelines and you need an experienced attorney to demonstrate why there should or should not be a deviation. In Virginia, division of property by the court is called “equitable distribution”. Assets can be considered by the court to be “marital”, “separate”, or “hybrid”. Marital property and the marital portion of hybrid property will be divided. The date of acquisition will be used to determine the classification of property. The valuation and classification may involve appraisals, tax assessments, or expert opinions. Other factors considered include the monetary and non-monetary contributions of each party, the duration of the marriage, tax implications, and circumstances contributing to the divorce.

Collaborative Law

Collaborative / negotiated divorce involves you, your spouse, and an attorney for each party. Your lawyer may be involved by counseling you, speaking for you, or crafting solutions. There may be a four-way conference, at the end of which you and your spouse have worked out the terms of your divorce. The parties may jointly work with outside mental health or financial counselors to investigate questions concerning child custody or finances.
