Practice Areas Description

Harold Shepley & Associates, LLC offers legal services on the following areas of practice:

- Bankruptcy

You have probably heard bankruptcy described as a "fresh start," but this does not mean that you are released from all of your debts. Only your unsecured debts are dischargeable. These include: Credit card debts; Medical bills; Utility bills; Personal loans. Other debts are not dischargeable, such as certain taxes and student loans. You are still obliged to pay non-dischargeable debts or you will continue to be subject to creditor action. At Harold Shepley & Associates, LLC, we consider bankruptcy to be the last resort for debt relief. When debt negotiation is no longer possible, our bankruptcy lawyers help you determine if liquidation or reorganization is the appropriate course of action.

* Chapter 7 Bankruptcy

When your debt cannot be managed through negotiation and you cannot afford a payment schedule, Chapter 7 bankruptcy may be your best option for relief. Most of your debts are discharged in exchange for the liquidation of your non-exempt assets. The attorneys at Harold Shepley & Associates, LLC help you determine whether Chapter 7 bankruptcy is right for you. If your income is too high or you cannot make your mortgage and auto payments, Harold Shepley & Associates, LLC may advise you to file under Chapter 13 to avoid losing your property.

* Chapter 13 Bankruptcy

If you can afford to pay off a portion of your debt over time, Chapter 13 bankruptcy may be the debt relief option for you. Chapter 13 is also known as reorganization. Your creditors are required by the court to accept a portion of what you owe, and you pay your debts in a single monthly payment over three to five years. Harold Shepley & Associates, LLC can help you use Chapter 13 to save your property, including your home and car. If your debt is not too high and you have a steady income, you may be able to use Chapter 13 bankruptcy to get yourself out of debt.

- Debt Negotiation

Bankruptcy is sometimes necessary, but it can remain on your credit report for up to 12 years. At Harold Shepley & Associates, LLC, we do whatever it takes to help you solve your debt problem without resorting to bankruptcy. Our experienced attorneys help you negotiate debt settlements with your creditors. Consolidation of consumer debt often requires the use of a home equity loan, placing a lien on your property. This puts your home at risk if you default on your payments. Our attorneys offer debt relief that is not tied to your real estate, so you do not have to fear the loss of your home. At Harold Shepley and Associates, LLC, we strongly advocate debt negotiation over bankruptcy whenever possible.

- Credit Restoration

You are likely to find that your credit report has suffered after you resolve your debt problem. Bankruptcy typically has a negative impact on your credit score for 10 to 12 years, and even debt negotiation can leave black marks on your credit report. You may be inclined to simply avoid using credit in the future, but sometimes it may be necessary for important personal transactions. The skilled Pennsylvania bankruptcy lawyers at Harold Shepley and Associates, LLC can help you restore your credit rating and give you back your financial stability.

- Mortgage Modification

Your lender wants to know that your income falls within an acceptable range to justify a mortgage modification. If you earn too little, the bank may be concerned that you cannot pay even at a modified rate. But if you earn too much, they will see no reason why you should not be able to pay your current mortgage payment. We help show your bank that your actual income level is neither too low to achieve a modified mortgage payment nor too high for you to deserve consideration. If your lender demands evidence of your financial hardship, we make a compelling case for your genuine need.

- Identity Theft

You may assume that identity theft primarily occurs via the Internet, conducted by hackers who steal your credit card number or Social Security number. However, a 2009 study revealed that online theft accounted for only 11 percent of identity theft cases. Nearly half of the instances were due to theft of: Wallets; Checkbooks; Credit cards; Debit cards. When your identity is stolen, you can face large bills for purchases you did not make and you may find that your credit has been damaged. Our attorneys work swiftly to help you recover from identity theft.

- Divorce

If you are a victim of divorce, there is hope. We are a Christian law firm dedicated to treating you with dignity, respect and compassion while helping you find hope in difficult times. Our services include: divorce, custody, support and protection from abuse. We offer low retainer fees with affordable payment plans.

- Estate Planning

Harold Shepley & Associates can assist you in preparing wills, living wills and powers of attorney. Everyone knows they need them. Everyone should have one. And now you can get them at an affordable price.
