- Legal Separation
Arizona legal separation procedures are almost identical to divorce proceedings. The most significant difference between a legal separation and a divorce is that the spouses remain married and cannot, therefore, remarry in the future without subsequently converting the legal separation to a divorce. All assets acquired by either spouse during marriage are legally presumed to be community property. The determination of when a particular item of property was acquired is based upon when transfer of ownership of that property was completed regardless of when actual possession of that property occurs. Typical examples of community property include income earned by a spouse’s effort during marriage regardless of the form of that compensation including, but not limited to, salary, increases in retirement benefits, stock options, and accumulated vacation and sick pay. Child support calculated through the Arizona Child Support Guidelines is based upon a determination of the gross incomes of the parents, the number of children for whom child support is being paid, the cost of health insurance and day care for the children, and the relative parenting time spent by each of the parents with the children.
