A Chapter 7 Bankruptcy is far and away the most common form of bankruptcy. In a Chapter 7 bankruptcy, a debtor (the person filing) discloses all of their property, debts, and financial activities over the past several years. Around three months later (during which most if not all creditors must stop attempting to collect) the debtor receives a discharge or cancellation of most types of debts and emerge with all or most of the property they owned at the start.
- Foreclosure Defense
The possibility of losing one’s home is a gut-wrenching prospect. The anxiety, fear, and worry accompanying possible foreclosure can wreak havoc on one’s personal and professional life. When facing such an overbearing problem the first instinct for many of us is not to hire an attorney but instead to just walk away. It is estimated that more than 90% of homeowners facing foreclosure forgo hiring an effective attorney and instead just give up. This is exactly what a bank hopes a homeowner will do. Without the assistance of a dedicated lawyer there is no one protecting you from the bank, a bank can then use the courts to ensure the worst possible scenario for a homeowner including; quickly kicking a family out of their home, holding the family personally liable for deficient amounts, and sometimes even forcing them into bankruptcy.

This usually results in 8 months to 2 years of time to stay in your home while all payments to the bank are suspended. Having no mortgage to pay for such an extended period of time can allow you to regroup and plan the next step of your life. Foreclosure deficiencies can usually be negotiated, thus averting bankruptcy.
