- Business Torts

Duties between parties in business relationships are not limited to those created by contracts. Both statutes and the common law may impose a number of duties on those involved in business relationships, such as the duty to exercise reasonable care, fiduciary duties, duties to protect trade secrets and other confidential information, duties not to defraud or misrepresent, and duties not to engage in unfair competition. The significant business torts cases in which the firm has been involved include:

* Representing in criminal and civil cases businesses and individuals accused of having paid bribes to the Mayor of a major Connecticut city in return for favorable consideration with respect to public contracts
* Representing a supermarket chain accused in a class action of improperly collecting sales tax on meals not subject to sales tax
* Representing in criminal and civil cases a physician accused of billing insureds for services not provided
* Representing the former President of an iron works company in action alleging a conspiracy to defraud a purchaser of a work by Alexander Calder that was constructed by the company
* Representing a stock brokerage firm in the defense of an action to recover funds allegedly stolen from a brokerage account by means of forged checks
* Representing accountant in defense of action alleging accounting negligence and fraud in connection with the sale of a business

- Unfair Trade Practices

The Connecticut Unfair Trade Practices Act, known as "CUTPA," prohibits unfair competition and unfair and deceptive acts and practices in trade and commerce. Since it was first adopted in Connecticut in 1973, CUTPA has become a fixture of commercial litigation in Connecticut.

The statute prohibits unfair competition and unfair or deceptive acts or practices in trade or commerce. Unlike the usual rule that each party pays its own legal fees and expenses, CUTPA provides that a successful plaintiff may recover its attorneys' fees and expenses from the defendant. CUTPA also provides that a successful plaintiff who establishes that the defendant acted with reckless indifference to the rights of others or in an intentional and wanton violation of those rights may recover punitive damages.

- Civil Litigation

Our firm has represented individuals and businesses in a wide range of civil litigation arising from disputes where one party or another resorts to the courts, from nonpayment of debts evidenced by promissory notes, to complex multi-party civil matters including environmental and antitrust cases. The range of fact patterns that can give rise to civil litigation is essentially as broad as the range of subjects that people and businesses can argue about.

- Appeals

For many years Jacobs, Grudberg, Belt, Dow & Katz P.C. has handled cases on appeal. We have wide appellate experience, which includes prosecution and defense of appeals from trial court judgments in civil, criminal, family and administrative matters, in both state and federal court. We have also briefed and argued appeals from sentences under the Federal Sentencing Guidelines.
